Bengaluru, Nov 13: The state high court (HC) has quashed the criminal review petition filed by former minister D K Shivakumar and others seeking to drop charges levelled against them by the income tax department with regard to recovery of Rs 8.06 crore in cash in some flats at Delhi reportedly owned by Shivakumar.
Shivakumar and his close ones N Rajendra and Anjaneya Hanumanthayya, had filed this review petition. Presiding officer of the single judge bench of the high court Justice B A Patil, who had concluded hearing in the petition and had reserved the orders, announced the order on Tuesday.
Because of this order, the hearing into this case will resume at the special court for people's representatives here.
The bench came to the conclusion that the complaint filed by the income tax department conforms to the provisions of Income Tax Act and section 120B of Indian Penal Code relating to criminal conspiracy to commit an offence. It observed that the order passed by the court for people's representatives is in order and therefore decided that the case against the accused should be pursued.
