Mangalore: Visa Fraud - Complaint against Mumbai-based Agents

Mangalore, Aug 17: Two alleged fraudsters from Mumbai have allegedly deceived a local concern dealing with visas, passports, real estates, and travel tickets, based in the city.

In a complaint filed with the Kadri police station, John Pius Ferrao, having his office in Marnamikatta Kankanady Shalimar Complex, who runs an agency that helps people to get visas, passports, properties, air and other travel tickets, said that he came into contact with a Mumbai-based agent named Abubakker, who dealt with passports, visas etc., two years ago. Abubakker and a man named Mustafa had an office that was recognized by the government. So, John used to transact with them.

As per a requirement sent to him, John had forwarded passports and medical test reports of 45 candidates, for being considered for jobs in Dubai and Kuwait, in August, 2008. However, no visas were received even after several months. John, growing suspicious, asked for the return of passports and money. Even though 42 passports were sent back, the Mumbai-based agents did not send back the balance three passports and the money remitted to them. During inquiry, it transpired that both Abubakker and Mustafa had fled and not traceable, John Ferrao stated in the complaint.

    I''m not getting in to the issues of visa fraud here but would like to make it clear that typical Indian laws about passports that passports are government property. unfortunately most of the holders are unaware about it and interpreteate the statements to suit with their own point of view.

    A passport represents the right of a passport holder to consular protection while he / she is abroad, and his / her right to return to the country which issued the passport. The right to consular protection arises from international agreements, and the right to return arises from the laws of the issuing country.

    To avoid such incident, if government introduces a law declaring that retaining others passport is illegal and punishable offence, it may help poor and innocent employment seekers.

    Lydia. I only disagreed on your statements saying passports are personal property of a citizen whereas majority of passport holders are not aware that their passport is property of the govt of India. This has been clearly written in the front face of last page in every Indian passport.

     I have not commented anything on the misuse of passports by holder and it’s legal consequences. Law will take its own action against them. Mr. Qardos, Mumbai – I know that passport is not required to come Mumbai from village. Don’t jump in to conclusion when you hear or read something new from any sources. Many have succeeded without an MBA but none has succeeded without common sense. Qualification does not take us anywhere unless we educate ourselves.

    Mr. Fernandes, The Passport is issued to a certain person by the Govt. of Inida and the holder is responsible thereafter. If the holder gives it to a third person and the document is misused, then the person (holder) is punishable not the govt. It is indeed a property of Govt. of India hence must be returned to India of it is found abandoned outside India for tracing down its holder.

    Dear Lydia Lobo, Kadri. Please note that our passport is the property of govt of India not a personal property of a citizen as you mentioned. Please double check before giving out any statements in public forums to avoid confusions. Passport should be in the custody either of the holder or of a person authorised by the holder. Please refer last page of your passport for further guidlines.

    Doesn''t Mr. John know that a Passport is a personal property of a citizen and no agent (including himself) has any business with an original passport of another person ? All they can have is a copy of a Passport. Services like ECNR stamp or vsa stamping formalities are to be done by the applicant personally.

    Innocent people hand over the Passport and money to the agent and wait for years in vain. It is possible that the agents sell the Passport to fraudsters to use it with a changed photograph. People, remember, a Passport is a document to prove your origin (Nationality) and it is required only for travel outside India.

    Do not hand it over to unauthorized people except to the government officers for services as above. Always retain a copy with you in-case you need to submit it for these services so that you can report it''s missing before police come looking for you after someone else used it and got caught.
