Mangaluru, Apr 21: In connection with the attack on and robbery of Kannaiahlal Gupta, owner of Polo Sales, who was engaged in the sale of readymade clothes at Hampankatta in the city, the fourth additional district and sessions court has awarded sentence of seven years each to five of the accused. They also have been fined.
The incident had happened four years back. The accused happen to be Irfan (39) and Muhammed Mushtaq (30), both from Farangipet, Sameer K M (27) from Shantiangady, B C Road, Muhammed Irfan (35) from Pudu village in Bantwal taluk and Dilshan Avninash Cardoza (29), a resident of Meremajalu.
The gang of five had arrived at Polo Sales showroom at Hampankatta in the evening of March 13, 2015. The gang members then attacked owner of the shop, Kannaighlal with iron pipe and hands, snatched away his laptop and tossed it on the pavement, inflicting damage to it, it was alleged. The gang had then robbed the shop owner of Rs 2,700 found in his pocket and Rs 25,800 found in the table drawer of the shop.
In a complaint filed in Bunder station here, Kanhaiahlal had said that the robbery had happened on account of professional rivalry. Police circle inspector, Shantam Shetty, had investigated the case and filed charge sheet in the court. Judge of the court, Mallanagouda, who heard the case, came to the conclusion that the charges have been proved. Out of the fine collected from the accused, one lac rupees has been ordered to be disbursed to Kanhaiahlal.
The court imposed different terms of sentence and fines to the accused based on seriousness of crimes under different sections of Indian Penal Code. Seven years imprisonment and Rs 10,000 fine was imposed on each of the accused for attack during robbery.
Public prosecutor, Harishchandra Udyavar, had represented the prosecution in the case.
