Bengaluru woman gets talaq on WhatsApp from husband of 15 years

Bengaluru, Dec 29: Despite Supreme Court denouncing the unconstitutional practice, USA based surgeon from Bengaluru, gave triple talaq to his wife of 15 years through WhatsApp text and audio.

Javeed Khan who is married to Reshma Azeez kept on abusing her, as per her complaint. "He started abusing me emotionally and kept insulting me. He never asked for a legal divorce but kept asking me to leave. In the initial days of the marriage, we lived UK and then moved to the US. Last month, he brought me back to Bengaluru. He later went back to the US, taking all my documents along. He wanted to resolve the issues between us after speaking with the families," Reshma said in her complaint.

"Once we reached, he left with his family, while I was stranded at the airport. He had taken away my passport, academic certificates and other identity cards. On December 4, a day after I filed the police complaint, he sent me talaq on WhatsApp," she added.

The couple has two kids, aged 13 and 10 who continue to live with Khan in Illinois, while he has cut off all communication with Reshma.

"I speak to my children through their school staff now," she said.

"TALAQ I am sending this message in my full sense and I am not under any influence of anger or intoxication. ALLAH as my witness. I, Dr. JAVEED KHAN (dob 01/19/1976), son of late Taj Ahmed pronounce TALAQ (Divorce) to RESHMA AZEEZ (dob 12/06/1978), daughter of Mr. Azeezuddin, according to ISLAMIC LAW OF SHARIAH, Meher has been completely fulfilled [sic]," is the last message from Javeed, which was also sent to their family group.

The officer who took up the case said that the accused was out of the country when his wife lodged the complaint. He said that the investigations will continue with cooperation from airport officials.

On Thursday, the Lok Sabha passed the Triple Talaq Bill, aimed to make the Triple Talaq a criminal offence with a jail term of upto three years for the husband.

    Parliament has passed a bill to stop triple talaq at one instant. But after lot of opposition from people, who should really be concerned. Why? The Government is being criticised for this step. Do we still want our daughters to be deserted thus? If we want progress, we should support policies beneficial to the public. People also point out several other practices by people belonging to other religions. Let us wait, the Governament with support of people will also abolish these practices also

    The Supreme Court has ruled that the marriage doesn’t get annulled as a result of pronouncement of Triple Talaq. The holy Quran of Muslims in Chapter 'Nisa' and 'Bakra' exclusively in detail laid down the codification.
    Any bill needs to become law has to be President of India's signatures or passed both houses of the parliament. In this case, the simple voice vote to make law bypassing the 'Muslim personal law' and constitution of India does not annul the marriage in the first case.
    The Doctor who may have an American Passport may not get punished but his religion of Islam gives both the party to break the contract.
    It is unfortunate that 15 years of marriage is coming to an end with a single message that might have saved with an intervention of elders or following the basic principles of Quran teaching of 90 days with separate 'Talaq' pronouncement.

    Whatever indifferences were there in thier marraige life,it was but not good what he did .coming to India without children,leaving back his wife in airport ,going back taking with her personal identitaet like passport ,her academic papers,etc,.why this cruelitatet?Afterall he lived with her 15years,had two children.Now is she for him a old thing?Is there a new youngblood is sicht?with all academic grades,he is still not worth to be called doctor.Atleast mother can be given a chance to talk to her children official without help from school teachers.why should be children deprived from mother before they reach the age of adolescent.?He is not human and respect los.

    In 1968, a person, from Gujarat, aged 18 years (born 1950), married a woman at her age of 16. Even the current CM of Gujarat knows him. I don't know why the law abiding Sriman Modiji has not succeeded in bring that person under law for marrying a minor.

    Unless we know the truth we cannot comment. Suppose the wife was involved in an extra marital relationship then will any Husband would wish to keep such a Wife. Naturally any Husband would divorce such a wife. In such a case innocent Husband has to go to jail. Triple talak law has not been looked into from all angles. Whoever has made is surely an insane person.

    Brother, this is not Triple talaq case. The husband has iterated just first of 3 talaqs before the divorce is valid. It is clear from the whatsapp message of husband. Has he mentioned triple talaq anywhere in the message?

    Why did Dr.Javed Khan took passport academic certificates ID cards...when he already pronounced talaq. When you cut-off all relationship with begum...why you carry all the necessity things which not belonged to you. It's an big offence. A well to do educated guy do such thing is beyond imagination. Now Reshma cannot able to do nikkah with javed once again unless and until she marry-off first to other guy. So cruel act..cannot foreseen in any other religions. They rule womens in the name of religion.

    Please don't give twisted facts to fool the innocent people; and to portray that men legitimately rule women in the name of religion.
    How come is it true that the men rule women, when the permission of the lady is "The Must" before the Remarriage.? It is not that the husband can remarry her ex wife as and when he wishes to do so.

    With Regards to the condition of Remarriage (that the ex wife becomes unlawful for Remarraige until another man has married her and then they have been divorced); note that, in one way, this rule is being put in place to avoid any of the couple giving divorce and using it as a threatening tool to get the desired things get done to remarry again. And also, this rule avoids the couple taking divorce lightly.

    In any case there is no "force factor" involved in remarriage when the permission of both the parties is " a must".

    Regarding your concern for the condition of re- marriage with ex husband; let me clarify you something by giving an example.

    For the sake of argument, let us assume that the wife was given divorce, which she did not deserve. So why should that wife prefer to remarry with her ex husband by leaving the current husband? Where is the question of men ruling women come to the fore?

    Only Instant tripple talaq is punishable!
    This seems to be the first one, and there is waiting period of three months, and they can do patch up, and continue to be couple. If no patch up happens in waiting period of e months, then actual separation takes place.
    The bill passed in parliment is for INSTANT TRIPPLE TALAQ!
