Bengaluru, Sep 20: The state high court, which observed on Wednesday September 19 that investigation had not been properly carried out relating to a case in which a lady teacher was murdered, ordered the government to suspend Tumakuru rural deputy superintendent of police (DySP), O B Kallehsppa, from service.
A division bench of the high court comprising Justice Ravi Malimath and Justice Michael Cunha, which heard an appeal filed by the accused in the case, H S Manu and others, passed this order.
The above DySP was to personally appear before the division bench on Wednesday September 19 to record evidence and explain about deficiencies found in the matter of collection of evidence. But he failed to appear in the high court at which the division bench expressed displeasure. It observed that Kalleshappa had, by not putting together the evidences which were available during the investigation, helped the accused. Moreover, the cellphone and sim card which had been collected from the accused during the inquiry were not produced before the subordinate court. It accordingly absolved six persons charged with murder of the charge, noting that the investigating officer had failed to prove the crime with the help of proofs and evidences.
