Mangaluru: Jeppu Residents vs Bishop - MLA Lobo offers mediation

Mangaluru, Feb 13: After the press meets, an open letter to bishop and threat of going back to original religion did not yield desired results, the residents of Jeppu Compound, gathered under the banner of 'Jeppu Parishioners Association' at Jeppu Club ground on February 12, and submitted a memorandum to J R Lobo, MLA of Mangaluru South.

The association claiming to represent 270 families led by Wilson Baptist, president of the association and Sathish Fonseca, secretary gave a detailed picture of the issue including the history of the residents of Jeppu Nagar. In the memorandum submitted to the MLA, they demanded the immediate withdrawal of eviction notices given by Mangaluru diocese to Valerian Texeira and Victor Pais, residents of Jeppu Nagar.

The association also urged the diocese to stop exercising authority over Jeppu Compound and urged that the people living there be given their legal rights over their house and properties. They also pleaded that Bishop of Mangaluru diocese should make sure to involve residents when there is any activity of land sale, lease agreement or other developmental works inside Jeppu Nagar.

They also stressed that residents, who were originally outsiders, but have bought land inside the Jeppu Nagar are also eligible to become original residents and the authority should give them the status of original residents.

The leaders of the association also stated that they are ready for dialectical discussion on this subject at any time and any place.

Accepting the memorandum and hearing the demands of the residents, J R Lobo said, "I know your sentiments and feelings. I will discuss the issue with concerned people. But I cannot give the assurance of a solution because it is a matter of land between two private parties. I will try to become a mediator and put all efforts to bring both the parties to the table. Both parties belong to the same community and religion. It will help if both parties move together and understand each other easily,”

"Do not connect this issue and the forthcoming assembly elections. It is not a matter of politics or governance. If people want to continue for another term, they will elect me. Otherwise, they will elect another candidate who they feel is better than me. This is my sincere effort to solve the issue before it severely harms our society," Lobo added.

The meeting that started with a prayer was compered by Eric Ozario.  

Diocese responds

Speaking to Daijiworld, Fr William Menezes, PRO, Mangaluru Diocese said, "Diocese is discussing and trying to clarify this issue on the basis of government records and legal documents. Around the year 1880, the Jesuit priests purchased 37 acres of land which starts from the present day Mangala Hotel to Nandigudda, Attavar road,”

"Out of this 37 acres, 10 acres belongs to Jeppu Seminary and 17 acres to Jeppu workshop. Later 6 acre of land was given to Infant Mary Convent from the land that belonged to Jeppu Workshop. Currently around 10 acres of land comes under the ownership of Bishop of Mangaluru diocese,” he added.

"In the year 1880-81, Jesuits started a workshop by the name of 'Jeppu Workshop'. They gave employment to destitute and poor people and constructed rental houses for them in Jeppu Compound. At the same time, some independent houses were also constructed in the compound by the management. The management also constructed a colony at Belve with the intention of providing job and stay for poor," he informed.

Continuing his clarification on this issue, Fr Menezes said, "If Jesuits had the intention of giving the ownership of the land to the residents, then they would have given the same to the residents that time only. The basic documents of these lands are now misplaced and untraceable. Also these documents are over 100 years old and the quality of the paper of that era was very poor,”

"But as per the 'Settlement Registrar of 1902', the entire land belongs to Bishop of Mangaluru diocese and the documents are available to us. As per the record of 1929-30 Bishop of Mangaluru diocese has a Patta for the entire land and also RTC in his name for Jeppu Compound. Later the managers of Jeppu Workshop handed over part of the land to some residents of the Jeppu compound on the basis of 'Mulgeni Perpetual Lease' and for some with 'Complete Ownership'. The decision of giving lease deed to tenants was completely looked after by workshop management committee,” Fr Menezes said.

"From past many years, Valerian Texeira, Victor Pais and Wilson Baptist, the residents of Jeppu compound, with the help of Right to Information (RTI) are trying to know the land details of the Jeppu compound and the authority of the Bishop of Mangaluru diocese over the same. They are engaged in making queries from village accountant to the President of India. When government officials and departments asked the details from us, we have provided them all without any failure,” he said.

“Now they are alleging that Bishop has encroached the government land that exists in Jeppu Compound. Bishop does not have any records for his land and whichever he has is all forged. Bishop is not the owner of the Jeppu compound and the residents are not tenants. So the ownership of the land should go to residents," he added.

Fr Menezes also said, "Valerian Texeira and Victor Pais should prove their allegations which they have made against the Bishop of Mangaluru diocese. They should bring proofs and documents to prove what they have alleged is correct. We have already filed a case against them in this regard in the court and the matter is sub judice."

Rs 17 crore bungalow

“It was alleged in a press meet by Eric Ozario that the bishop has built a bungalow worth Rs 17 crore to live after his retirement. Some newspapers carried this news without verification of facts. But this information is completely untrue. Juze Vas Home, built near St Antony Ashram in Jeppu, is a house for 45 retired priests where bishop has a single room. This is not a luxury home at all, but a home with basic needs. The home has a convent also. Workers also stay there. Bishop does not need any luxury as he lives like a simple person. Moreover, Juze Vas Home was not built on any land of Jeppu Compound. That is a separate land which belonged to the diocese,” Fr Menezes said commenting on the news reports which appeared recently.

Leaving the religion

“It was threatened in a press meet that some residents will leave Catholicism and go back to their original religion. Everyone is free to choose any religion. He or she can go to any religion of choice at any time. But an atheist does not belong to any religion. So an atheist migrating to another religion does not look like a coherent statement,” opined Fr Menezes.

Dispute

“We never stopped anyone from building houses or not enjoying the rights over the properties. Efforts have been made to project that diocese has a dispute with all the residents of Jeppu. But we do not have any such dispute. Three people have taken the diocese to court. So the dispute is between those people and diocese. Once they have approached the court, why should they use other means to settle scores? Let them wait for the court verdict,” Fr Menezes concluded.

    and save time for everyone involved, whatever land belongs to Mangalore bishop belongs to the catholic community and not the just three greedy persons who want a share of it, if property is the main reason to stay in religion please go back to wherever you belong.

    I remember listing from a Jesuit priest during my youth;

    " What is belong to God give it to God, What is belong to Government give it to the Government and man should work & earn and keep some of his earning for himself and rest he should share it with fellow citizens in justice”.

    We should not take what is not belong to us. Received in charity should be spent only for basic needs and excess should be returned back to the Charity.

    May Lord Krishna Bless the decedents of the generous people Who gave Land, wealth and labor to charity.

    This land transaction is much earlier to World War 1 and pre-independance. Hence the issue need to be attended on human angle. Our present Bishop is already on the verge of retirement. So let him not do anything on this issue , until new Bishop is nominated to the Diocese. Whatever the present Diocesen management does, the future Diocesen management have to bear both positive and negative consequences. Once the communities and society is divided, it is not easy to re unite. We have seen the same in the past in different places and parishes. Hence, J R Lobo should wait , to begin his dialogue process, till the appointment of new Bishop. Jeppu people should cooperate until then.

    About 250 families were gathered there NOT to change their religion but to get justice.

    Surely Bishop will provide them justice because they were got converted into Christianity. More over, Jesuit Priests left behind lot of land to Mangalore diocese to care of them as per their land or any other needs.

    Bishop did not deny to provide them justice but these leaders are hurrying before justice is meted out for them.

    Anyway without getting justice, leaving Christianity is not good meaning to say, if justice is provided to them they will not leave Christianity.

    Therefore, let us not say, ' if they want let them leave the religion" Let good will prevail among us all.

    Thank you so very much, Mr. J. R. Lobo for your kind intervention in the delicate but deserving situation of the residents of Jeppoo Compound. It is a delicate issue, and the residents of Jeppoo Compound have their own sentimental reasons to possess their humble home as their own dwelling for themselves as well as their future generation. At the same time, as explained by Fr. Willie, there are so many unavoidable circumstances that preclude immediate resolutions because there are
    delicate issues that go back to more than a century of history.

    We have been in the neighborhood of Jeppoo Compound for more than 75 years, and we have always admired and respected the residents of Jeppoo compound who have always been God fearing and humble people. Most of them worked for Jeppoo workshop, and the hard work and honest work has always been deep rooted in them. They have generations of loyalty and dedication towards the Jeppoo Parish, and we have to find, sooner or later, some favorable solution to their grievance.

    Hopefully, your wise intervention, Shriman J. R. Lobo , might bear some fruit sooner or later - sooner the better because majority of the residents of Jeppoo compound have been there for so long, and their attachment to the land is deep and strong. Let us all pray that sooner or later the situation will be resolved in the interest of simple and kind hearted people.

    I was shocked when people said they will change their religion for a piece of land. They should have been greatful for the diosce for allowing them stay there many years in that place without any rent.

    If bishop or priests are enjoying the people's money then they are accountable to god not to Taxera, Eric baap or William Baptist.

    Eric Ozario no doubt has made a lot of money in name of religion getting soo much funds for kalaangan and the person who took all sort of feliciation from bishop and said that he strived for konkani is now getting religion in between. Shame on such people who have 2 faces. Why religion in between ? Why he has to interfere in someone's problem.

    As Fr.William said Valerian Texera along with his so called chaddis have approached everyone for documents to prove their land but not succeeded. Now when are asked to leave the place they have become restless.

    Eric have you ever donated a single fils from your kalangaan income to the needy? You collected soo much money from foreign countries and your assistants who helped you with that have built big houses just working for kalaangan. Please don't talk about others keeping dirt in you.

    As our MLA said let him take a lead to sort out this problem and you please stay away or one day every Christian will make sure they dislike you and feel shame to see your face.

    As Fr. Menezes rightly said, just wait for the court to pass the verdict. Why use other means to settle score. We don't political figure who is not a judge so let's wait on the judge to give the verdict. Amicably yes, but since matter has gone far, let it be done legally. Jesus said, I have not come to abolish the law but to fulfil it. So we are all equal before the law. But once the verdict is given, who will pay for the character assassination of the bishop?

    Stop escalating this dispute to a religious level. All parties should settle it with the offer of mediation from the people's representative, Hon. JR Lobo. After all, the land and structures belong not to the bishop or the church, but to the entire Catholic community who made their contributions to church funds out of which the land was bought. The bishop got it from the Jesuits who originally bought it to house converts (later derisively called by main street Catholics as "compounders" because they were housed in the so-called Bishop Compound.
    In other circumstances, the Karnataka Government through the Land Reform Act has statutorily granted ownership rights to the occupiers of land who had held them without even a lease for a long period of time. If the dispute is not settled amicably, and the residents (be they owners or long lease tenants) are not given full ownership rights, perhaps it is time for the state government to step in.
    We should not have another "Babri" masjid style litigation.

    Irrespective of these meetings/discussions please note there is the constitution of our country and legal framework on land ownership and inheritance. This has to be respected and followed by every individual.

    There is no need to bring religion, ego and other matters of less significance to complicate and politicize this matter.

    If we deviate from the legal framework here then there are many others similar /related issues that will come up.

    Those who want to leave any group or religion can do so without any announcement. We are first the citizens of this great nation..! Follow the law of the land.

    A tenant is always a tenant in that land as he is only possessing the land but not the ownership title of the land. The ownership title remains with the original party.

    Here Mangalore Diocese are the owners of the land, as they have the ownership title. The residents are only dwelling there. Majority of the dispute are for money and here the possession of the land, might be eying for big money from the real estate.

    Now most the tenents in that land are well to do, why they still cling to the same land. They have the choice to move to other places where they can have the title of the land.

    My question to the tenents who are fighting, here against Diocese or with the original owners of the land is; if they are the owners of the land and they have the tenets, do they offer the demand as you are asking from the owner of the land. Definitely NO.

    Let the truth be investigated and made known to the faithful along with the facts, documents, records and evidences.... At the end of the day, as Pope Francis has said, "The church belongs to the laity "...
    Jesus built his church ministry with lay people- fishermen and tax collectors and not with high priests or the preachers at the synagogues...
    It's important for our Bishops, priests and nuns to understand that they are only facilitators chosen and ordained to carry on the work of Christ...
    Hence such matters should be sorted out by amicable means, instead of resorting to mud slinging in an already polarised public medium, which will only lead to giving advantage to elements waiting out there, to dismantle the secular fabric of this country and the rights of minorities....

    I had my own doubt knowing Bishop and his family. But after I reading this I leave the person who made false allegation in the hands of God. Honestly public person should not stoop into that low level.

    @AF.mangalore ,may be they are having some backing to do so,saying "come to us ,we will help you to get back your home and land"otherwise people who are firm in their religion wont say so even when they loose the fight. we have enough examples peoplewho roamabout to bring back lost sheep in their row.Or these people who said it thought Bishop will get frightend about religion and give off.There are people who travel in both boats.Sad it had to come to this level.Hope and pray that it may settle peacefully without much malice ,whoever the winner is.It is a big headache about land dispute.Last tie there was one case about Aloysis college too.That time too enough dirty clothes were washed on a public stone.There comes a lot of viewers when it is a religious head /catholic priest or Bishop is involved.

This is the issue of Land which is very sensitive and closely connected to the ones sentiments. Roti Kapda Aur Makaan are essentials to every human being. In this regard my humble request to our Mangalore Bishop to take care of his people (Church) and help needy families of Jeppu.
    Guys please have control over your sentiments and frustration and PLEASE STOP PRESS MEETS, SENDING AUDIO RECORDS in Whatsapp/FB etc and ALSO PLEASE STOP FORWARDING THOSE AUDIO OR VIDEO CLIPS TO OTHERS. Keep your Egos away. There is a solution for every problem only when we sit across and discuss the mater peacefully.     Mercy shown for a long time does not become their right.
