Udupi, Feb 1: The state high court has paved way for the continuance of senior advocate, Shantharam Shetty, as the special public prosecutor (SPP) relating to the case pertaining to the murder of NRI businessman, K Bhaskar Shetty.
The court had earlier granted stay against the said appointment on the basis of objection by way of writ petition filed by wife of Bhaskar Shetty and one of the main accused, Rajeshwari Shetty. Against her application, Rajeshwari's mother-in-law, Gulabi Shetty, was represented in the case by Jagadish B N and Prof Ravivarma Kumar. Advocate, Arun Shyam, appeared on behalf of the petitioner.
Justice Phaneendra vacated the stay. He asked Rajeshwari Shetty to appeal to the principal secretary in the home department about her objection if any over the appointment of SPP, through an order issued on Wednesday January 31.
The bench refused to dismiss the order passed by the government in this matter. It said that the home secretary would dispose the application off if made by Rajeshwari within 15 days. At the same time, it asked subordinate court not to conduct hearing in the case till this happens.
Senior advocate, M Shantharam Shetty, had been appointed as special public prosecutor in the case in October last year.
