Beltangady: Arrest in cheque bounce case - accused assault police executing warrant

Beltangady, Jan 3: Personnel belonging to the police station here have arrested Geetha Shenoy from Kanyadi in the taluk, who currently lives in a first floor house in BSP Compound near Kankanady Garody, Mangaluru, on Tuesday January 2. The police were armed with arrest warrant relating to a case in which the cheque issued by Geetha towards repayment of loan raised by her from Sri Gurudev Multipurpose Cooperative Society's Kalladka branch was returned unpaid for want of funds.

It is learnt that Geetha had raised a loan of one lac rupees from the above society's Kalladka branch. She had failed to repay the loan, and the cheque issued by her towards repayment of loan was dishonoured upon presentation by the bank. Thereupon, the society filed a cheque bounce case in the court here. As Geetha Shenoy remained absent from successive hearings in connection with the case, the court had issued arrest warrant against her. Based on this warrant, the police went to her home at Kankanady to arrest her.

It is said that during the execution of the arrest warrant, both Geetha and her husband, Vittaldas Shenoy, attacked the police. A case about this incident was filed in Kankanady police station. The accused has now been remanded to judicial custody.

    Cheque bounce section 138 of Negotiable instruments act should be used only for cases in which a goods has been delivered for which cheque is used and If that cheque bounces then it becomes exact case
    But in India always laws are used to coerce and then recover money
    Actually for recovery of money loan recovery case should be filed in Debt recovery Tribunal unless lender has done other criminal offences
    Geeta Shenoy should have hired a good lawyer and presented the case well
    But lawyer s also demand hefty fees . Philanthropic people should support them .
    Now they have committed real crime of assaulting police

    Issuing cheque to some one means commitment made by the issuer to pay sum of money. In UAE the government will arrest the issuer if the cheque is bounced and keep the person inside jail until he pays or make arrangement to pay..... No bail in this case in UAE. Even for stop payment of cheque they have take letter from Bank and bank will issue only if the person keep sufficient funds in their account so that if any claim comes from anyone against the cheque will be paid by the bank.

    In many countries issuing a cheque without sufficient funds in the bank account is considered a fraud whether or not goods or services have rendered.
