Bengaluru, Dec 4: Women normally want to become lean but their bodies most of the time do not bend to their wishes. A woman here, who was hell-bent on imposing her dietary habits at her husband's home, had to part ways with him within a month of their marriage. Moreover, the family court also permitted the couple to separate. Her husband, a software engineer, was so fed up by her antics that he contacted a lawyer and legally separated from her within 30 days of their marriage.
The lady in question is from Andhra Pradesh.She married a software engineer from the city in September this year. Initially, the boy was reluctant to marry this lady as he felt she was on the heavier side. He however, agreed to marry her under pressure from his family members but on the very next day of the marriage, the groom said, his bride started pressurizing him to live with her in separate house. She also fought for silly reasons, the husband said, but he steadfastly refused to separate form his mother as she does not have anyone else to care for.
The man later said in the court that as against his expectations that his wife would mend her ways, she turned more adamant with passage of time and harassed him to no end. The court upheld the application made by the husband seeking to annul his marriage under section 12 (1) c of Hindu Marriage Act.
The youth, fed up by the tantrums thrown by his wife, approached advocate, Chetan Patel from the city seeking his help. Patel noted that there is no provision to seek divorce as the marriage was less than a month old, but there is a provision to seek annulment of marriage under section 12 (1) c of the said act. As the wife too told in the court that the marriage had been held against her wishes, and that she had no objection to separate from her husband, the court upheld the man's application.
The lady was into dieting seriously. She forced her husband and mother-in-law to consume sprouted items and raw vegetables which she ate regularly. It is said that she turned wild when she was asked to cook food. She often attacked her husband and mother-in-law on this issue, and had left the backbone of her mother-in-law broken, it is learnt.
There is a provision under section 12 of Hindu Marriage Act to invalidate the marriage subject to verification of facts by the court which also obtains statements from the couple.
Senior advocate, Prameela Nesargi, and advocate of the family court, Rajarajeshwari, confirmed that forcible or marriages through cheating can be sought to be annulled under section 12 of the said act. Concealment of things like earlier marriage, religion, caste, serious health problem, pregnancy, mental or physical pressure to marry someone etc can be grounds to seek separation at any time within a year of marriage, they stated.
