NRIs, PIOs don't need to link bank account, PAN with Aadhaar: UIDAI


New Delhi, Nov 18 (PTI): NRIs and PIOs are not required to link bank accounts and other services with Aadhaar, the Unique Identification Authority of India (UIDAI) said on Friday, while instructing various implementation agencies to work out a mechanism to verify the status of such individuals.

It said the Prevention of Money laundering Rules 2017 and the Income Tax Act clearly stipulate that the linking of bank accounts and PAN respectively, "is for those persons who are eligible to enrol for Aadhaar".

It said all central ministries and departments, state governments and other implementation agencies should bear in mind that Aadhaar as an identity document can be sought only from those eligible for it under Aadhaar Act, and that most NRIs/PIOs/ OCIs may not be eligible for its enrolment.

The Aadhaar-issuing body said several representations had been received about problems faced by Non Resident Indians (NRIs), Person of Indian Origin (PIOs) and Overseas Citizens of India (OCI) where Aadhaar was being demanded with regard to various services and benefits.

It said that some Departments and implementing agencies were asking NRIs/OCIs/PIOs to submit or link their Aadhaar for availing services and benefits, despite the fact that they were not entitled for the 12-digit biometric identifier.

"The laws regarding submitting/linking of Aadhaar for availing the services/benefits applies to the residents as per the Aadhaar Act 2016... Most of the NRIs/PIOs/OCIs may not be eligible for Aadhaar enrolment as per Aadhaar Act...," the UIDAI said in a note dated November 15 to central ministries and states.

It has further instructed the implementing agency to device a mechanism "to ascertain the genuineness of status of such NRIs/PIOs/OCIs".

    Any NRI who has obtained Aadhar card and has given declaration of his/her stay in India for 6 months, that is required according to Aadhar act, either commits perjury according to law or loses his/her status as NRI.
    Perjury is an willful offense punishable with prison and/or penalty accordingly in India where it states " an affidavit is evidence and a person swearing to a false affidavit is guilty of perjury punishable under Section 193 IPC which prescribes the period of punishment as seven years imprisonment."
    So those who want to have SIM Card, better apply on behalf of some one resident, than having some one sue you with.

    Every now & then Govt. changing the rule. They themselves are not sure. some years back they used to issue Adhaar card to all Indians. Moreover if a NRI kept Deposits in NRO a/c , they deduct 30% TDS then to get the refund he has to file income tax returns for which he need adhaar . For Indian school children's studying in CBSE need Aadhaar to sit for exam.

    All of you who think that NRIs got their Adhaar cards made in a hurry, please be informed that the Indian Schools' management outside India insisted on submitting a copy of Adhaar card of every student studying in their school. It could be that the Central Education Board asked the school authorities for this step. A school will not impose something like this from their pocket.

    The matter in discussion right now is the LINKING which is mandatory for tracing down tax payment and to match it with a person's bank account/s. An account holder who did not submit a copy of Adhaar is asked to do it by the end of 2017 because in Jan 2018 such accounts will be deactivated. This LINKING is not mandatory for NRIs because they don't pay income tax. Nevertheless, NRIs MUST have Adhaar because other formalities such as applying for a sim is not possible for them. Earlier it was issued upon submitting a PP copy but right now PP copy is not sufficient.

    While you apply for aadhar, there is a point where you will have to declare that you have been staying in India for more than last 6 months, continuously. If you say yes, you are no longer an NRI. Most of the NRIs have said yes and obtained an aadhar card.
    Now, all those NRIs who have linked accounts with Aadhar should be prosecuted for giving false information to the government.

    Without Aadhar card NRI cannot apply for a sim card. Are we serious or running a tuglaq government every now and then changing rule.

    Not linking Aadhar card with bank accounts is fine, then let us know how to get a sim card in India.

    Irrelevant of whether you link PAN with Adhaar or not, its mandatory to have an Adhaar card especially when a child is studying outside India in an Indian school. The School management insists on submitting Adhaar card copy of a child upon admission and also to those who are in higher classes.

    Linking business is a minor issue which could be necessary to trace transaction details of citizens in order to keep trace of their income so that tax payment will not be escaped hereafter. Since NRIs don't pay income tax, the linking issue might not be applicable.

    Dear Jennifer I am talking on NRI prospective. You cannot get a phone SIM card without Aadhar Card. How a NRI will apply for a SIM card is the question. Hope you understand what I am trying to say.

    I am proud of brainless Indian public and Indian politicians...... If the child is Indian schools and if they want to appear for exam they have show aadhaar card.... In one hand they are telling for NRI no aadhaar card...... So many Indians got medical or other insurance item.... now they are asking link aadhaar card to Insurance also.... Indian will return to Indian after retirement and which Insurance company will cover him after 60 years of age?????? Why can't they give solution for these things???

    My honest question to Supreme Court of India. Indian's with multiple identifications "WHICH DOCUMENT IN INDIA IS THE MOST VALID OR RECOGNISED DOCUMENT FOR ALL TRANSACTION DOMESTIC AS WELL AS INTERNATIONAL FOR NRI OR PIO"?
    I would appreciate if five-judge statute Bench who are going to decide on Aadhaar validity.

    - Can NRIs also get Aadhaar?
    As per the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, only a resident who has resided in India for a period or periods amounting in all to 182 or more in the 12 months immediately preceding the date of application for enrolment.

    When Aadaar card required for all the places and even NRI can't apply for mobile no than why can't the Indian government make arrangement to issue Aadhaar card to NRI and PIO's on the basis of Passport in foreign country through their consulate????? The telephone companies were giving mobile No. to NRI's on the basis of Passport..... Now they stopped all the facilities than how these people can have basic facilities in India during their visit?????

    NRI's are not supposed to apply for Aadhaar cards in the 1st place unless they have been residing in India for a total of 182 days or more during preceding 12 months prior to applying for Aadhaar. It is even clearly mentioned at the top of Aadhar application at the beginning itself which you need to tick off.

    Those who have done without checking or bothered to check might have done it at their own peril. This is like you are giving wrong declaration to UIDAI set up by the government.

    If your banker doesn't agree or not qualified enough to agree send him aadhar application 1st page scanned copy & your passport details including your entry exit date details to/from India as per passport stamp. Note that it is the entry exit details to/from India that matter rather than employment visa abroad as many professionals including IT guys, businessmen, medical professionals, artists are globe trotting as per their profession. It is only inside India or outside India for 182 days that matter.

    If you have already done it by ignorance despite being an NRI, let concerned decide whether it is legal or illegal as you are not supposed to apply for it in the 1st place.

    NRIs are not supposed to apply for Aadhaar cards as per Aadhaaar Act 2016. Whether this rule was applicable before 2016? Because many NRIs have got Aadhaar before 2016.

    I think best option is to check with UIDAI. Still easier is to email them & ask for a copy of your aadhar application you filled & signed. If the same condition is there on the form, then your doubt is cleared.

    I know many NRI's done aadhar in a hurry as the heads of schools where their kids may be studying in India were hell bent on to get aadhar details of kids & their parents. I pity these educators as they where not enough educated to check the aadhar forms as NRI's are not bound to apply & get aadhaar.

    And if you got Aadhar before becoming an NRI, don't worry. It is a valid document now.
