Bengaluru: High court directs private doctors, hospitals to restore medical services

Bengaluru, Nov 17: The Karnataka High court on Friday November 17 directed all private medical establishments and practitioners to withdraw their strike and restore their medical services.

Hearing three PIL petitions, a division bench comprising acting Chief Justice H G Ramesh and Justice PS Dinesh Kumar passed the interim order.

The PIL stated that Act of medical establishment and societies in denying basic medical facilities to the people was 'inhuman' and highlighted the plight of patients suffering due to the protest.

In its brief order the Bench said 'basic medical services are a right to life for every citizen' and orally observed that violation of its order will result in violation of the court order.

On Thursday, the High Court had said that it can pass appropriate orders to deal with the issue but is in favour of doctors themselves withdrawing the strike.

The Bench had then adjourned further hearing to Friday after the Advocate General has submitted to the court that State government has an open mind on doctors’ grievances and will table the bill only after meeting doctors’ representatives. The Chief Minister will meet heads of committees that are looking into grievances of the doctors against amendments to the Karnataka Private Medical Establishments Act, he had said.

Private medical establishments and doctors have been on a strike since November 13 protesting against the proposed amendments to the Karnataka Private Medical Establishments Act.

    Was just google searching Hippocratic oath “ I will attend to my own health, well-being, and abilities in order to provide care of the highest standard," is the new clause added recently . A healthy doctor for healthy society. If you go through KPME act definitely adds more stress to honest treating doctors . There are bad apples in every profession . It’s govt job to find them and punish . Govt has to stress on allocating more money in health care . Increase the standards of govt hospitals. One can’t go for war without the proper weapons . Holds good for docs joiningi govt hospitals with no proper infrastructure and expect docs to do heroic work! Spend more on education and healthcare and make sure the funds are utilised properly docs will love to join govt hospitals .Even patients will love to go to govt hospitals . Let the rich go to private hospitals no worries .

    Doctors are crying wolf. Some of them have amassed disproportionate wealth to their known earnings, possibly without giving genuine receipt for their service and carrying out transactions most in cash thereby avoid paying due taxes to the Government.

    Court should order the IT department to audit all practicing doctors income tax returns for the last 7 years and any benami assets they are holding. In addition, their services should be considered essential service and they should liable to loose their practicing license, if they go on strike endangering the human lives.

    This act against the corporate system...and pro people .This act will not harm Hospital like Fr Muller, St Johns..they are all service oriented Hospitals. Those who are faced the problem only understand what is the behavior of hospitals. The Doctors who are charging exorbitantly will get punishment in this act not for one who charges normal...This act bring down the capitation fee of Medical seats . There is a accountability in Medical field.This act Pro people and Pro poor citizen.

    If the Govt wants to help the poor let them open Indira Clinics just like Indira Canteens and give medical treatment at Rs 20 every one will be happpy .Delhi Govt has done Mohalla Clinic .Why pressurize Private Drs ?Announce that KPMEA will be withdrawn will not be tables Drs strike will be withdrawn

    Yes Hon Court says stop strike .But if Govt Doctors would have been on strike then Govt and Hon Courts could invoke ESMA act and threaten the Doctors to remove from service .Here is striking Doctors are private citizens from where will they be removed from service ? You can throw a person down if he is sitting at a height how to throw a person down if he is sitting on the ground? Private Doctors have not got the Govt job so they started private practice .Now there also Govt wants to push them to the wall .So sorry .Several rounds of negotiations have taken place in past in all the talks Health minister says the KPMEA is pro poor it should be passed .Even Doctors have been doing service so long .If Govt wants to do service of the poor Let them open Indira clinics just like Indira canteens .Why coerce Doctors to get less fees ? Why threaten them to jail? In simple terms I would say Govt is trying to give service to poor out of flesh and blood of Doctors .Not all Doctors are rich lot of them have huge loans ,They have got life style diseases like BP ,Diabetes Heart ailments etc due to over work.In India average Life span of Doctors has come down to less than 65 where as in other countries it is much above 85 .They are dying due to work pressure

    I partly agree with you Karnataka Private Medical Establishments Act is a crude act written by some 'Semi-literate' Government Servants....

    However Medical profession is not like other professions like auto rickshaw drivers or plumbers....you cannot take patients as hostage( like hijackers of Aeroplane) for State Government faults...

    You cannot do 'Yettige Jwara ...Yemmege Barre'...hope you understand my point...

    Even if the patient is dying never try to save him if your life itself is in danger .Like if there is fire first we have to save ourselves then we have to try to save some one else life
    To make you understand still mare clear when you travel by air they announce if there is Oxygen defficiency first wear your mask and then try help others ,assist others in wearing the Oxygen mask

    The sad fact is because of high fees from Medical colleges the freshly graduated doctors are already under the loan burden..unless they come from the business or jana Sevak (politician) family.
