Sullia, Mar 8: The contempt of court petition filed against the commissioner in the department of religious and charitable endowments for not adhering to the directions issued by the court relating to payment of salaries to employees of Lord Subrahmanya temple stands dropped. The high court (HC), on Tuesday passed this order in connection with the petition filed by 23 employees of Subrahmanya temple.
The employees of the temple had contended that the commissioner had flouted the order of the single judge bench of the court to disburse salary to them as per fifth and sixth pay commissions. The division bench comprising Justice B S Patil and Justice B V Nagaratka said it will consider the petition entirely and give a decision, duly setting aside the issue of contempt of court.
At the same time, it has given an opportunity for the petitioners to file contempt of court petition again, if the issue of contrmpt of court is established. It said that the commissioner in the muzrai department is being allowed to escape action because of the fact that the single judge bench has withheld the order passed in the past.
