Kasargod, Dec 19: The family court in Kasargod has delivered a verdict in which it has asked the wife to pay alimony to her husband, as a punishment for filing a false complaint against him.
While normally in most or all the cases, a husband is asked to pay the maintenance or alimony, here, the wife has been asked to do so. The situation in this particular case is different, hence the verdict too is different.
P D Dharmaraj, the judge in the case has directed P M Nivya from Nellikunje Ambedkar road to pay Rs 6,000 maintenance every month to her husband N K Shivaprasad of Nellikunje beach road in Kasargod.
The husband had approached the court complaining that he had lost his job as a result of the false complaint lodged by his wife. The couple had a love marriage, but thereafter lived together only for five months.
Nivya had complained to the police alleging that Shivaprasad had taken her to different places and raped her. The police came to a conclusion based on investigations that the complaint was false. They even came to know that the couple had gone to Wayanad and other places on honeymoon. Also, the medical tests done on Shivaprasad turned out in his favour.
Later, the police registered a case against Nivya for lodging a false complaint. Nivya then approached the high court for anticipatory bail. When the court did not honour her request, she applied for divorce.
The couple had married on January 22, 2011 in a temple, when Nivya was still studying. The marriage was registered at Yenmakaje village panchayat on January 31, 2011. On May 1, 2011 Nivya went to her mother's house, never to return to Shivaprasad's house. On June 2, 2011 she lodged a complaint of rape against her husband, and in July, 2011 she went to court for divorce.
Shivaprasad who was working in a private firm had lost his job because of the case lodged against him.
Presently Nivya works in a college in Mangaluru.
Advocates U S Balan and Benny Jose had represented Shivaprasad and Nivya respectively. Shivaprasad had demanded compensation from his wife as he had lost his job because of her.
