Bengaluru, Dec 14: 'The medical tests conducted on Sri Raghaveshwara Bharathi Swamiji, who heads Sri Ramachandrapura Math in Hosanagar, has proved the rape allegation levelled on him. His DNA test ia positive. This evidence is enough to file charge sheet against him,' claimed state advocate general,Prof Ravivarma Kumar. His claim made in a division bench of the High Court comprising Chief Justice D H Waghela and Justice R B Budhihal which is considering an appeal preferred by the Swamiji aginst the order of a single judge bench that had quashed his plea seeking cancellation of first information report registered against him. Kumar however did no elaborate more on the findings of the medical tests.
Senior advocate, B V Acharya, who is representing the Swamiji in the case, argued hat the medical tests have not brought out anything which proves rape charges against the Swamiji. He expressed confidence of proving that the allegation of rape is part of a conspiracy hatched against the Swamiji. He said he would continue to place his arguments on the subject. He said that as per statement given by the aggrieved couple before some television channels, they had admitted to have raised the issue of rape after the Math filed complaint against them. He also added that the complaint of raping over 150 times is unbelievable and impossible. Acharya also pointed out about some inconsistencies in the complaint.
As soon as the case came up for hearing, the Chief Justice wanted to know whether the investigation is in final stages and whether police are ready to file charge sheet in the case. The advocate general handed over details of investigation in a sealed cover. The advocate general also said that the Swamiji is yet to be subjected to some more medical tests.
Hearing in the case stands adjourned to Monday.
