Mangalore: Tussle over property - SAC gets house demolished

Mangalore, Jun 26: The controversy over a property at Karangalpady between its occupant John Baptist and St Aloysius College management took a decisive turn on Thursday June 26 with the College administration getting the house demolished.

John Baptist Lewis, said to be the adopted son of Alice D'Souza, had claimed that he had been living with Alice D'Souza for 40 years, at a house in Patrao Lane, Karangalpady, and later, St Aloysius College claimed ownership of the house and asked him to vacate.

However, St Aloysius College maintained that John Baptist had been illegally residing in the college premises and refusing to vacate despite repeated requests. The College had said that it has all the documents to prove its ownership of the property and that attempts to negotiate had failed.

Speaking to media persons, John Baptist, a painter by profession, said that at around 3 pm, around 40 persons including Fr Francis Almeida and Fr Cyril representing the College administration came to the spot and got the house demolished. Baptist claimed that when he refused to give in, he was threatened and forcibly carried away in a jeep, and later when he was dropped back, he found the structure of the house demolished, along with his belongings like television and others.

Baptist's lawyer, who did not want to be named, said that the case is pending in court. He also alleged that a laptop and Baptist's daughters' gold ornaments which were in the house were taken away, and that the girls, who arrived later, were 'manhandled'.

Baptist's two daughters were away at work at the time of the incident. One of the daughters, Savitha, speaking to media persons, said that when she received call about the incident, she informed her sister and both of them rushed home and found the gates closed. "When I enquired with the priest, he refused to answer and pushed me away," she said.

P B D'Sa of PUCL and Suresh Bhat Bakrabail of Komu Souharda Vedike arrived at the spot and condemned the action taken by the College. They said they would filed a complaint with the police.

Speaking to daijiworld, Fr Almeida said that the College had clearance from the city corporation and the authorities concerned to demolish the house. He said that Baptist's belongings were taken in a truck to Fajir where Baptist owns six acres of land. He also denied allegatons that Baptist's daughters were manhandled and said that the girls were not at the spot. 

Fr Cyril D’Mello speaking to mediapersons said that all allegations about usurping John Baptist's belongings were false, and that that the property had been donated to St Aloysius College by Alice D'Souza in her will. He further alleged that Baptist had made fake documents to claim the property as his, while the College was in possession of the original documents.

He further said that the College would be directed to build a house for John Baptist.

 

 

Media Release from St Aloysius College

"This is to bring to the notice of the Press that the property bearing survey no. 224V-10 in 89A Kodialbail Village of Mangalore Taluk, DK District (House No. 14-1-49, 49A) belonged originally to Alice Lydia D’Souza and who donated it through her Will to St Aloysius College on May 15, 1986. However, the Will also directed the College to build a house and give to her (Alice Lydia D’Souza) nephew, Errol Flin Gonsalves, or allow him to reside in the house that existed in the property (House no. 14-1-49, 49A), till his death. After the death of Alice Lydia D’Souza, the property (Survey No 224 V-10) was transferred legally to Karnataka Jesuit Educational Society that runs the College. Further, as per the wish of Alice Lydia D’Souza, her nephew, Errol Flin Gonsalves was allowed to reside in the house that stood on the property without any interference. Errol Flin Gonsalves passed away on July 9, 2013.

But, Errol Flin Gonsalves had brought John Baptist Louis to look after him in his old age. John Baptist Louis has absolutely no relationship to the property and to the original owners of the house.

The Mangalore City Corporation (MCC) in its recent order dated 25-1-2014 (Revenue/CR 255/R 12216/2014-15/A5) has rejected John Baptist Louis’ dubious resident letter which was acquired by producing false documents. In another order dated 25-2-2014 (Revenue/CR 358/R 14947/13-14/A11) MCC has annulled his application questioning the ownership of the property held by the College, following his inability to produce any documents.

During the recent rainfall, a tree fell on the old house existing in the said property and damaged the dilapidated construction further, risking the lives. Also, as the College administration wants to develop this property for the good of students, it demolished the dilapidated construction existing in the said property, the College being the legal owners.

In the undertaking given to the police by John Baptist Louis (dated 8-11-2013), it is stated that he has no residence. However, the College has documents to prove that he owns a property and a house which is vacant (house no. 1-2-77) situated at Dharmatota, Boliyar Panchayat limits, Mangalore Taluk, DK District. The College also has documents to prove that he has illegally acquired two ration cards.

This only shows that John Baptist Louis has been trying to deceive the law and the authority by producing false documents. The two orders of MCC too bear witness to this character of John Baptist Louis. Added to this, he is also frequenting the premises of the PG Ladies Hostel of the College which is nearby, thus causing nuisance to the inmates."

    Legally, the priests are in the wrong. It is a criminal offence to take the law into one's own hand.

    The court will eventually decide and the truth will prevail.

    Becoming a priest in M'lore is not a vocation anymore, it is a profession. There are those that join priesthood to be served and not to serve. To succeed and get the top job in a priestly order, one has to have Machiavellian attributes or else one is considered a failure. How very sad. Pope John Paul must be rolling in his grave & Christ must be weeping tears of sorrow at how horrible his creation has turned out to be - and that includes us too. Saying that some of the finest priests I have come across are the missionaries, the monks and those that dedicate their lives to serve others in good works and prayer. Unfortunately, the few good priests that exist in the Mangalore diocese are either disillusioned nobodies or have left the priesthood altogether.

    Whom do we blame here? The skyrocketing prices of land and property in Mangalore that's destroying the peace that once prevailed in the beautiful land we all grew up. SAC in the past used to help needy families overcome their problems by doing social work and teaching the students to do the same. Everything is acceptable but not taking the law in one's own hands. Hiring Goonda's and threatening an individual? This is similar to what happened to those girls when they entered the Bar in M'lore.

John Baptist may be wrong but there is legal procedure to follow and there a better way of handling the situation. From far away from US this act of demolish of house by priests seems very wrong!     It is scary and appalling how people comment without giving deep thought to the truth of the matter, which is that John Baptist Lewis is a fraud, if what SAC has said about him in their media release is true. It's just simple to understand that this guy wanted to appropriate, through illegal means, the property of someone else. Why should anybody feel sorry for him. He came to look after somebody, in somebody else's house and then said this is mine, because he knows it is very valuable. And we lay people, just because we think that we can, insult and derogate the priests for doing the right and the legal thing. I would like to know, what would the people, who have bashed SAC and priests, do if you bring in a helper to your house to help your parent during his/her last days and then this guy says that your house is his....can there be anybody more deceitful....more selfish and ungrateful? Come on guys....be realistic and fair. Human rights is good but not at the cost of the one who is rightful and considerate. Let this guy donate his 6 acres to SAC, because of which and because of the sacrifices of the priests there are so many, including myself, in Mangalore are well educated and call ourselves proud Aloysians. Only request is guys...don't be over emotional...consider the facts and don't side with the thieves. By your logic, anybody can mis-appropriate anything and then cry that he/she is mistreated and put false accusations....and you guys will side with them

    My dear Maxim which year you went to Doha??
    In Doha, the Municipality used to Demolish the houses left and right 25 to 30 years back, Today your house is there, tomorrow it is not there. You have to run pillar to post. Now the scenario has changed and Doha has become a Modern City with skyscrapers and 5 Star Hotels broad roads etc. etc.,
    You must have gone there only during its modern time, where as we have seen Doha during the olden days.

    Now imagine, you are a Mangaloren, In India, we cannot demolish a dwelling house without proper documentation. You have to vacate the people first, then demolish.
    and in this case you know the full story...what is necessary for the Priests to demolish and put the Man and 2 girls on the road. If they had re-located them, then the story would have been different.

    If Alice Lydia Dsouza died in the month of May, 1986, then a Probate is a must. Has St.Aloysius secured a Probate through process of Court or is it to hoodwink the general public ?

    If it is illegal and if there is no proper heir, the said property wrests with the Karnataka State Government under Section 34 of the Indian Succession Act.

    Can St.Aloysius College produce the original WILL and PROBATE ?

    Let us forget about John Baptist. He may be anything and only God will judge that.

    The point is as to how SAC secured this property ? The Tahasildar or DC could not have mutated the RTC ( in 1986 ) just on the basis of a WILL. Probate may not be a must now for Christians but it was a must in 1986 ! That's the point. The Tahasildar & DC could be in trouble if the matter is pointed out in Court.

    Moreover Mr.Harish Salian Advocate has rightly pointed out ( the Law ) that the property could wrest with the State Govt. if Late Alice Lydia Dsouza had no heirs ( and the WILL fudged ), under Section 34 of the Indian Succession Act.

    If not mistaken, the rightful will was done in between 1980 to 1986, when Rev Fr Rony Prabhu was the Rector the SAC Mangalore.

    This is also a wake up call to all Religious bodies, whenever the faithful and congregation donate the land to them by WILL, see that at the earliest to complete the formalities & the lawful title is transferred in their name.

    Even though the occupant was illegally occupying the house and that too for decades (he was not an overnight encroacher/land grabber) as a tenant, he is protected from unlawful dispossession and he can get stay to the extent that the landlord shall not be entitled to dispossess him forcibly. However, he can be evicted by following the due process of law!! If it was done by completing the due process of law then nothing wrong with that!!

    If "John Baptist Louis has absolutely no relationship to the property and to the original owners of the house." then how can he try produce the proof that he is related to the original owner of the property? If someone else occupies my land, what will I do? Priests getting involved does not look good, but authorities would have convinced Mr. Baptist to move into his new house, if the SAC had build one for him! If SAC agrees to build one, that does not mean that SAC is automatically guilty as one so called doctor claims!

    This a good job done by the SAC Administration. They say , today if you give a person to bite your finger tomorrow he will bite your hand .This is what exactly Baptist tried to do. I feel the SAC Community has given enough time for Baptist to Vacate and this was the last solution . Its very easy to write and Comment on Jesuit priest on this issue but nobody sees how good they did to the society and people of Mangalore from last 130 years . This City is grown because of the Education that people gained through the Jesuits and Carmel Sisters.But when it came to Property , even Baptist did not spare the priest because of his greed . The tenants come like a sheep and walk out like tigers . I myself remember a tenant who lived in our house in those days payed
    5 Thousand throughout his life time occupancy and walked out with
    10 Thousand when he was asked to leave and threaten us. The Jesuits are really good when you are good . People who have commented against the Jesuit do not know the truth and just keep giving negative comments. I still remember Fr Francis Almedia begging from student to student with a bag to help a Hindu Student of St Aloysius College to meet her medical expences. If he was so cruel he would have not done this for the student . I have studied in this College for 17 years and know these Jesuit priest well . They do the best for the society keeping all their selfishness away.

    please ex Aloysian who ever you are please do not boast about what is good check out what is bad too, these priests renouncing all worldly things in the name of a totally Innocent person named Jesus of Nazareth has not learnt anything from his sacrifices and deeds but has done enough evil which is the (un)recorded history also called Dark ages first try to know what & why it is called dark ages . I have a great deal of resentment towards these priest because they had taken my mother to court for a trivial issues after getting our money , you have your own view we also see what and why they do these in the name of God , Jesus did not build churches or institutions and did not crave for money it was Judas betrayed for money and the Satan spoke about wealth and Riches, know your bible and know the truth as one of poison can spoil the whole well of water, one rotten apple can ruin the basket full of apples, and one small sin can ruin your whole life.

    I think the SAC management has handled the situation within the confines of the law. There is no religion or beliefs involved. Law of the land is sufficient. If SAC is being blamed for being business minded, that is unfair criticism especially since SAC is an important educational institution of Mangalore. Go around India and you will find lot of money minded people opening educational insitutions when it made business sense and close it too. SAC has evolved well and grown by catering to the educational needs of Mangalore and surrounding areas. Lets face it, any small piece of land today for SAC would be huge as it is already situated in a crampy area. Priests as heads of institution is much needed in today's materialistic educational scenario. They bring that much needed philosopical element into the mix without which education is not holistic.

    brother's daughter.Errol Gonsalves is
    her sister's son.Ally Bai & Lilly Bai
    were just two sisters.In 1983 I visited her at Karangalpady.That's
    when Errol was living with her and
    she told me he was married.That he
    was living with her resulted in a
    dispute with her own son. She gave
    me his address and requested to make peace.I wrote him, but he never responded.Some years later I
    heard Errol's wife had left him.
    Ally Bai needed someone to stay with her and Errol fit the Bill.In
    his parent's house he was persona
    non-grata.Errol provided some sort
    of security to Ally Bai.
    Since she and her son never fully reconciled, and Mrs. Errol's
    wife had left him, it is more than
    possible she bequeathed her property to SAC.
    But, there are more questions
    than answers here.Was the Will regi
    stered.? How did the SAC come to
    know it had been gifted property
    with proviso that Errol had right
    to reside there until his demise.?
    Did the Court grant a probate.Did
    SAC obtain RTCs in it's name.? Did
    the Taluk Office or the MCC Office
    have authority to demolish a dwelling house.? What arrangement
    did Errol make with Mr. Louis.? Was
    it legally valid after his death.?
    I have no sympathy for Mr.
    Louis.But, he should be ousted by
    Due Process of Law.Were demolition
    notices served on him.? Compromise
    seems to be out of the question.
    Nobody seems to know the whole
    story.How can anyone reach a judgement without full evidence.?

    Just imagine, someone illegally encroaches your property, puts up shed and starts living. What will you do? Oh..what a poor man...Let him live in my house.. I will give a room for him...How many will say this? SAC management has done the right thing. SAC property in not priests' property.It is the generous gift of so many benefactors.     This is only breaking news, trailer. Picture abhi baaki hai. Have patience. P B D'Sa, Suresh Bhat, so called "the guardians of society" will make a secret deal with illegal occupant, since there is a police complaint now- there will be FIR, court case etc etc. So please wait, let justice decide. As Modiji says -" Dood ka Dood, Paani ka Paani ho Jayega". If Baptist had shunned his greed, he could have been in a better place now. But today as per Tulu saying- "Jenjila ijji, kaila ijji" and a Kannada saying -"ati aase gati kedu". Why blame priests, is the property for their personal use? is it not for the society? If such thoughts were there 134 years back in the mind of priests, would this education institution exist? Why they are begging people and building these educational institutions- is it for their children or for the future generation? Let us see both sides of the coin. 30 years back, If I had not taken action like this, the Govt land outside our property would have been encroached and we would have been in difficulty. Charity is not only for priests but also for all human beings. I support the action taken by SAC management and especially my brother Fr. Francis D' Almeida, who had always worked for the poor, marginalized, dalits and weaker sections of the soceity in Anekal, Nagaland, Bijapur, Bangalore, Mangalore and many more places risking his own life.

    To all the people who are supporting Baptist- What will you do if someone encroaches your land or property that has been written in your name? Will you keep quite and let them take it? No right. Then why so much love and support for a thug like Baptist. Pls give your house for him and his family to stay.SAC has done the right thing.     In 2003 the Son of Late Alice D'Souza Mr.L.P.D'Souza has checked the will of his late mother and found it to be Genuine and in order and did not want to go against his mother's wish. The Priests of ST. Aloysius College have gone totally by the wish of Late Alice D’Souza. John Baptist was staying there illegally and this house should have been demolished on the very next day after Errol's Death.

    After reading entire story I felt sad, but there are some thick skinned people in this society. Action from SAC seems to be correct. Similar incident happened in our 5 acre property, when our neighbor encroached into our property and started some pooja and gathered public and claimed part of our property. Later we had to conduct some evacuation drill and then property was claimed back. You believe it or not that incident never reported in any media since some influential people involved in that incident. That is the few years back story but that happened for good!

    The Rector and Administrators of SAC know the real estate value of the property which they got free of cost. They are bigger businessmen than we think ! This is exactly what the MCC did to those petty and poor street omlet / fast food carts. It is sad that a Catholic institution had to do this inhuman act or stoop to this.     Explanation given by SC.authorities Looks plausible.The Baptist de souza was asked to move many times and he showed no reaction.Even though he had property elsewhere ,didnt move.he had no proper documents to this house,.It is not correct what he had done .too much greedyness is not good.Now he cant complain about missing his belongings.had time to move.As owner of it ,college has also a Point where they cant anymore.It should be settled and cleared.They wont do it without clear documents.I dont think anyone demolish house with the items in it.As a good catholic he should also know lie and put in others land is a sin.He was looked after well.now let him build a new future in his land.

    God is fair to the poor and also fair and just to the SAC college [priests]. Remember it is the property of the college and non of the priests own a single cent on their own name.

    Therefore, the college management has the responsibility of preaching, teaching value education and literally and virtually take care of the property that belongs to the Institution.

    It looks very odd to evict Mr John Baptist Louis but SAC has been forced to go for such an action. We need to be more realistic persons in this world of today. Any way SAC is going to build a house for Mr John Baptist on his own 6 acres plot of land in Fajir.

    This is the only way to demolish the overconfidence of the people who try to use law to their benefit by forging documents. I think SAC has done a good job. Those who show sympathy towards the family can see the photographs, I could not see any personal belongings of the family (Like clothes, TV, Computer etc. SAC has taken good care to demolish the structure and not the belongings....!!!!????     Me having been born in a Roman Catholic family, but not particularly fascinated by any organized religion and always a condemner of wrong doings going on in society, after reading the entire story in various media sites, it appears that the affected person is totally wronged and was trying to take undue advantage of the circumstances to his benefit despite offers of negotiations!!

    The allegations against the priests of manhandling and taking away certain goods are certainly bogus!!

    However, do not understand and digest how can a "private party" go about wielding its bulldozer and demolish a structure with inhabitants living in it, which I think is completely against the law of the land!!!

    A very similar case is hot news in Mumbai, the "Campa Cola Compound" demolition, just read the details and see how tough it is even for the "authorities" to evict a person from his abode and decided for yourselves!!! Jai Hind!!

    Comments from most readers seem prejudiced. SAC and its administrators have gone by the law of the land and have rightly demolished and claimed the property that was willed to them. Here we have an opportunist in John Baptist Lewis, who is cashing on public sympathy and intending to usurp what does not belong to him. I ask the commentators here, many of whom have amassed wealth and are professionals (Dr.??) if they would let their tenants continue to live on their valuable property paying a pittance as rent on compassionate grounds ??? It is easy to sit in your rooms and pass comments. SAC or its priests are using this place for the betterment of society and the premises is not used for their family, but for the betterment of generations of students who join this centuries old institutions. This property will be registered under the Jesuit Educational Trust and not a single individual. SAC is not a run of the mill, money making educational body, they have done immense good to society without distinction of caste or creed and the bottom line is the upliftment of society thru' education. Reports from Lewis and his daughters of highhandedness by the Jesuits are just to garner public sympathy. The comments from many readers are like :- If there is an accident - a cyclist hits a pedestrian - support the pedestrian (irrespective of whose fault it is) between a - bike and cycle - support the biker - car and bike - support the bike - Bus and car - support the car - Truck and bus - sympathies with bus - logic bhai .. logic .. I am glad SAC has published a clarification as they are well aware of half baked people - gunning for thier blood.

    SAC’s action is wise and totally justified. Contrary to some of the comments here, along with legal angle, humanitarian angle also has been well covered and taken care of by SAC management. The illegal occupant was given more than enough of opportunities to come for negotiations, but looks like he relied on some half boiled advice given to him by some people who must be as nutty as fruit cakes. Now also he doesn’t have to lose much apart , as college is going to build a brand new house for him, in place of this dilapidated (now demolished) one. Of course he doesn’t have the luxury of peeping into lady’s hostel as mentioned in this report! And of course, if he had any dreams of selling this piece of land, those dreams are certainly shattered, for, considering the prime location the deal would’ve fetched him an amount enough to build a 5 star mansion in his Fajir property. Looks like he grossly underestimated the Jesuits!

    Well done SAC management. Once upon a time some of the priest of SAC management must have allowed him to stay as a help when college doesn’t require the land at that time to Mr. Baptist. It doesn’t mean that it is given to him permanently. Now college may be having development plans they want it back, so give it. This court cahhery is all useless.

    I know the case it was the genorisity of the College community to allow him in this house. Actually present days he and his lived in another house of his own. This house was simple occpuied for the sake of it. I am neither student nor nothing to do with college i was happend to be part of all the proceedure going around. Mr. John Baptist was offered compensation but he refussed to accept...There is no question of violation of humanity he has his good house elsewhere he resides.

    This family was living in that place illegally. Whatever illegal is illegal. Tomorrow somebody will occupy SAC Chapel and say that it's my house. Can the priests allow that? This family was given many chances to vacate and this family owns 6 acres of land at Fajir. So before condemning SAC management, just see the reality of case.     College has taken sufficnient steps to esnure settlement where as Baptist is not flexible and has not compromised a bit.

    Here in this issue, I am taking up, for the college not because I have studied in that College but the attitude of Baptist. He has nothing to loose but whatever compensation he gets is profit to him.

    Those who have supported, all will be with him for one or two day, and then , this issue will be buried. Afterwards, he has to fight the battle alone.
    At the same time, If Baptist has 6 acres of land at Fajir, why he is clinging to this property, which is not his own. Is he willing to part, some of his own property which is in his name at Fajir.

    Agree with u totally with regard to the patron saint of Jesuits, St. Aloysius as per your write up.

    Charity should not be deprived. In doubtful situations, in line with charity, it is better to be duped rather to dupe a charity.

    But here in this case, as per the press report by the SAC management, Baptist has 6 acres of land at Fajir.

    A person who is hungry requires bread & water not dinner as in the five star hotel standard. So the question here of charity for shelter will not arise to Baptist as he has a place of 6 acres of land in Fajir.

    I support SAC management to the core in this issue.

    Hope both parties will sit across the table and settle the issue. Hope to hear the good news of COMPROMISE settlement.

    Dear priests this is the worst you can do, remember when you are on the alter u just preach Jesus and when it comes to reality you act like devils.
    by a small piece of land nothing changes for the SAC but a lot to a poor man.

    I Being a Catholic I Condemn the act done by St. Aloysius college management.
    This is not the way at all and above all being as a priest this clearly shows that the matter of money to the management was important.
    As per the news written above PUCL and KSV have arrived at the spot
    This issue should be taken very seriously.
    If found guilty put all the college management who are involved behind bars,
    I don't bother whether he is a priest or anybody,
    The truth should come out immediately.

    Totally surprised and shocked with the behavior of SAC Management.

    Priests are the ones who preach that we should not be carried away by earthly belongings but aim at the heavenly abode, then why are they demolishing a poor mans house....

    This should have been handled in a better way..... i cannot see any christian virtues practiced here....

    Humanity is more important than anything .What is the use of Money ,Property if Human Values are absent .If SAC has got the Municipality order to demolish it always comes with a Clause that no human should be damaged .Gross injustice

    SAC already sits on 20 odd acres of prime property in down town Mangalore. How much more property do these priests require and for what purpose?

    Reputed colleges in big cities and abroad have property no bigger than 1-2 acres.

    When i was a student in its High School long back, i was appalled to see that in classrooms there were no fans during the scorching summer, broken glasses on its huge 8-10 black doors and even worse- it had no proper latrines for boys, the infrastructure was outdated and inadequate for a reputed school of its nature.

    Will all of the above, i now wonder where did all the money disappear which our parents used to donate?

    The property dispute might be there and the priests side might have won the case in the court BUT
