Mangalore: Youth convicted of raping college girl in 2010

Mangalore, Oct 2: The fourth additional district and sessions court on Tuesday October 1 convicted a youth of raping a college student three years ago in Gandottu, Mucchur.

Prashanth alias Rupesh Devadiga (25) was convicted of raping a 17-year-old girl and threatening to kill her on December 10, 2010.  A case was registered in Bajpe police station in this regard.

The quantum of punishment will be pronounced on October 5.

The hearing in the case began on September 17, 2012 in the fast track court. The case was later shifted to fourth additional district and sessions court, where the charges were proved.

The final hearing regarding quantum of punishment will be held on October 3, and the pronouncement will be made on October 5,  said justice B K Naik.

The doctors who examined the girl did not find any marks on her body. However, in the report they stated that absence of marks did not mean that the rape had not taken place.

The statements by girl’s mother and family members, and investigation by police helped in proving Prashanth as guilty, said prosecutor Shiva Prasad Alva. None of the villagers had come forward as witness.

During the hearing, the defence lawyer maintained that Prashanth and girl were lovers and villagers had seen them together. Prashanth has been falsely charged in the case, he contended.

The then SI Vinay of Bajpe police had registered the case. The chargesheet was filed in the court by inspector Valentine D’Souza on March 2011. Manjunath V Bhat Penne and Shivaprasad Alva were the public prosecutors.

    Hello, please be realistic. If he is 100% guilty then Indian Law have to up hold the judgement. Why there is no fear among these guys? You just think cooly and you will get the answer.

    Its a case from 2010 and the Girl was then minor.If they had sex with their own wish it cant be a rape and Boy cant be blamed still Boy had to think because Girl is minor,second they are not married couple.Now whoevers fault,he has to bear the consequenses.Girls also are not innocents always.when Boy cheats her or neglets,they can turnout as furies.

    I have fearlessly voiced against atrocities against women, at the same time, I don't support victimizing men in every/all cases.

    In a saga that a couple was in love for a specific length of period, if they indulge in physical relationship, it should not be termed as rape. Well, (1) the girl being a minor and (2) Indian law generalizes physical relationship with a minor as rape, it is indeed tragic. Of-course if she was abducted and abuse took place, I would have agreed with the rape concept.

    They both should have been responsible and not have indulged in such activity. When they did, both should have owned it up.

    I sympathize with a young man and hope that there will be a chance to appeal and the couple reconciles.

    Where is Roshan Braganza anyway ?

    I am sorry for what had happened to the victims you have mentioned and also respect all women who sacrifice and give their selfless service to the world we live. But as all men are not rapist, all women are also not the same. Sometimes I find it hard to believe what women says because of few incidents which have happened in our family and neighbourhood. For whatever reasons if there was consensual sex and later if the girl feels that she is cheated or breaks up with the boy, then it is not rape.

    I strongly recommend capital punishment if he is guilty. Dear Defense lawyer or prosecutor, please bring death fear among men by giving death punishment for all these cases.
    Our ladies will be respected and they could live safely.
    No mercy in these cases. No way.

Your sacrifice will not go to waste as the tragedy of Dec., 16, has awakened the women of India. The above case in Mangalore and many other cases will bring fear to men who use women for their selfish needs. Don't treat women as sexual object but ensure that they are equal to man and are also capable to do much better/good things in life than men. A Woman has the right to live a dignified life and we men should respect that.

    If they lovers there is high chance of consensual sex(not 100%).
