Katju urges Andhra to free constable jailed for killing ACP


Hyderabad, Apr 6 (IANS): Press Council of India chairman Markandey Katju Saturday appealed to Andhra Pradesh government to release Abdul Qadeer, a former police constable who is in jail for last 22 years for gunning down a police officer.

Katju submitted a letter to Chief Minister N. Kiran Kumar Reddy urging him to pardon the 51-year-old former constable on humanitarian grounds. Katju pointed out that Abdul Qadeer has already spent 22 years in jail and one of his legs was amputated due to diabetes.

"He committed a heinous crime. No doubt about it. He deserved harsh punishment and he got it. Twenty-two years have passed. His one leg has been amputated. When he committed the crime, he was young. Now he has turned old. Have some mercy on him," Katju told the chief minister at a Urdu conference here.

The former Supreme Court judge reminded the chief minister of Shakespeare's famous statement that justice should be tempered with mercy. "If you have mercy on him, your prestige will go sky high," Katju told Kiran Kumar Reddy.

It was during communal riots in December 1990 in Hyderabad that Abdul Qadeer, then a 29-year-old constable, shot dead Assistant Commissioner of Police N. Satya. Two years later, a court sentenced him to life imprisonment.

Katju also told the gathering that he recently launched in Delhi a "court of last resort" to free people languishing in jails for several years. The NGO is headed by eminent lawyer Fali Nariman.

Katju said the organization would have units in states. It will study cases of those who were implicated in false cases and other undertrials. "There are many people from minorities. We will study their cases and help them," he said.

He cited a case of a youth named Amir was arrested when he was just 17 but 14 years later he was found innocent.

"This is not happening only with Muslims. There should be no repression whether they are Muslims or Hindus," he said.

Katju said he spoke to Zahid Ali Khan, editor of urdu daily Siasat, for opening a unit of the court of last resort in Andhra Pradesh. He said the organisation require students, lawyers, media persons, academicians and other professionals, who can work as volunteers.

    This man thinks he is above law. just because he was the rtd judge of supreme court he can do/ say anything. One hand he is telling the Delhi Gang Rape accused must be punished, strong anti rape laws etc are required to get the guitly to br punished on another hand he is teling release the culprits

    It is true that former police constable shot dead his superior Assistant Commissioner of Police N. Satya. No doubt it is heinous crime, but what is the reason he took this drastic step?

    “On December 8, 1990 the most deadly riots in Hyderabad’s history started, in the span of four days more than 200 were dead and hundred others injured. The then chief minister N. Chenna Reddy blamed his opponents within the congress for the violence. The master mind of the riots was projected to a young M.P and Ralayseema congress faction leader Y.S.Rajshekar Reddy who later rose to become the chief minister. It was alleged that Y.S.R called goons and faction leaders from violent Rayalseema region into Hyderabad to instigate communal riots between Hindus and Muslims in the capital to destabilize the government of a Telangana Congress faction chief minister.

    Abdul Qadeer was witnessing the injustices of police on the people especially Muslims, higher police officials were encouraging riots and rioters and sometimes they even instigating the riots by burning a property of a particular community and then blaming it on another community. They even gone to the extent of playing the voice recording of screams for help, when local people came out for help they will open fire on them. He was disillusioned by seeing his superiors in those communal acts. That is why he took that drastic step.”

    Just because injustices happen to people it does not give anyone the right to kill others.

    However, Katju could be better advised to dedicate his time and efforts in trying to cleanse communal/religious,social,language and gender discrimination that is deeply rooted in our country.

    I believe it is true that communal riots wherever they have happened in India have taken many innocent lives. This is where Katju needs to focus.

    Keep-up the never ending fight for justice and do not look for Revenge because Revenge does not solve problems but only perpetuates the cycle of violence.

    A person who was given a role to uphold the law itself has commited a grave crime and was punnished accordingly may be court was lenient he should have been hanged, shame on katju to say convict has lost his leg to diabetes so pardon him did he lose his leg while trying to save a life or something??

    Katju's interference and sympathy in the judiciary system is unwarranted. Katju is desperately creating a Vent for Sanjay Dutt. It is high time retired judge should take refuge in himalayas with some Baba.There are enough judges to take care and deliver justice. Why Katju is breaking his head? Why can't the government punish Katju for his stupid Behaviour.

    I Think Sir Markandey Katju sir should be bestowed with Nobel peace award I also strongly recommend to have similar award after him like we have for Alfered Nobel to ‘Sir Markandey Katju Nobel peace award’ for his relentless service toward the weakest of the week people of society who are in desperate need WHAT SAY ?

    This guy is a Nut and out of senses. He bargains for releasing the criminals and so who is a Retd Supreme court judge. If you really want to do something good to your motherland then there are many innocent people still languishing in Pakistani jail(POW)for over 30 years.Try for their release rather than supporting the release of criminals and traitor like Sanjay dutt.

    This man has already been shown mercy by receiving life imprisonment instead of the Death Sentence which he deserved for killing another human being. Katju has lost it. He is unable to judge who deserves mercy and who does not.

    I am baffled this SOB was a supreme court justice ! It is clear to see he is trying to attract votes from a certain community, but asking the govt to pardon everyone from mafia/terror goons like Sanjay Dutt to a constable who murdered his superior is mocking the judiciary in which he served for years.

    ..Katju is out of mind..the culprit was a civil servant, who supposed to protect lifes, instead what he did?..He may see light some day.what about the victims family who are permanently pushed to darkness by this guy??.why Katju not speaking about Rajiv killers??..why he did'nt taken action he was in SC..Katju's action surely undermine peoples trust in judiciary, a section of society surely feel they are victimised, where as Indian judiciary not biased on caste,creed or religion..Why Katju not allowing law to take its own course..
