Supreme Court bars Italian envoy from leaving country


New Delhi, March 14 (IANS): The Supreme Court on Thursday asked Italian ambassador Daniele Mancini not to leave the country, after the Centre pointed out that Italy had reneged on its undertaking to send back two marines to face legal proceedings here.

In a major development, the Union government informed the apex court about the “note verbale (diplomatic missive),” received from Italy on March 11, which stated that the “two marines (Latore Massimilano and Salvadore Girone) will not return to India on expiration of the permission granted to them.”

New Delhi has also started reviewing all aspects of its ties with Rome, indicating that diplomatic relations between the two countries may sour if the Italian government does not send the two marines back to stand trial here. India’s new envoy to Italy, Basant K Gupta, is unlikely to be sent to Rome anytime soon.

The apex court on February 22 allowed Massimilano and Girone to go to Italy for four weeks to vote in the general elections there. The period of leave will expire on March 23.
Attorney General G E Vahanvati mentioned the matter before a three-judge bench presided over by Chief Justice Altamas Kabir. “The government is extremely concerned about what has happened, more so, because it is under the order passed by the court,” he said. “I want to bring it to the attention of the court. This is untenable. It is a breach of undertaking given to highest court of the country.”

Taking the matter into consideration, the bench, also comprising justices A R Dave and Vikramjit Sen, issued notices to Italy, the marines and Mancini and directed them to file responses by March 18.

Vahanvati read out the undertaking given by Mancini on February 9, in which he admitted the “concession” given by the apex court through its “carefully-worded order” and assured that the marines “will be constantly under the care, custody, control, supervision and guardianship of the applicant so as to ensure their production on or before the date prescribed by this court before the commissioner of police, New Delhi.

“Therefore, failure of the accused marines to return to India within the stipulated time would be a breach of the sovereign undertaking given by Italy to the Supreme Court of India. It was affirmed that Italy was obliged to honour the sovereign undertaking given to the court and, therefore, it had to ensure the return of marines to India to face legal proceedings here within the period stipulated by the order of the court,” Vahanvati said, reading out an affidavit filed on behalf of the Ministry of External Affairs.

    This order from the Supreme Court might trigger a diplomatic tension between the two countries.Italy which has a upper hand in the European Union might screw India if India persues the matter aggressively.

    Italy does not have upper hand in EU. Germany, France and UK are key rule writers! All of these 3 countries require India for the export of capital goods and Supply of services from India! Italy is debt ridden and will soon be bed ridden! Lets stand by the sovereign pride of India keeping aside our differences. If the EU and US does not dare to stand against China and there is no reason why India should bow down! Enough of oppression against our land in the past..Lets stand united with our heads high..whoever it may be.

    Respect the rule of the Land,it is important! it is a Italian govt or any other govts. Sanctions or other actions it should be dealt accordingly. A amicable solution is a good sign of respect by both parties while solving these kind of problems without any unwanted hiccups !.

    India will get thrashed by the European Union and the world body regarding Diplomatic staff and their privileges. We are playing a dirty game as per the Vienna Convention. The Indian Supreme Court has no legal jurisdiction over the Vienna Convention.The world body is supreme. Lets now get ready for European sanctions and local inflation to rise high. The Indian Rupee will then touch Rs 75-80 against the US$. Cost of Petrol will touch Rs 125/ Ltr.

    The Italian Govt. has already paid a compensation of Rs 1 Cr to each of the families. Rs 6 Cr is kept as deposit to release the Italian ship.

    Coming back to the Aircrash in Mangalore : How much did Air India pay each of the families ? Did Air India higgle to pay the compensation ? At that time we shut our mouth because it was an air crash in India. This is our double standard.

    I agree that killing those 2 innocent fishermen was wrong and the law should take its course whether the incident happened in International or Indian waters .That the Court will decide.

    This present Supreme Court act contradicts the Vienna Convention regarding Diplomats. Italy is part of the Europe. Any silly action by India could result in trade sanctions on India by European countries which will effect the Indian economy and raise inflation. So we have to watch out very carefully.
