Italy's refusal to send back marines unacceptable:PM

New Delhi, Mar 12 (PTI) : Prime Minister Manmohan Singh today termed as "unacceptable" Italy's refusal to send its two marines back to India where they were facing trial for killing two fishermen and said the issue will be taken up with that country.

Singh conveyed this to delegations of Kerala MPs from Left and Congress, who met him separately to express anguish and demand his intervention in the "serious" matter.
The Prime Minister said it was "unacceptable", according to CPI(M) MPs K N Balagopal and M B Rajesh.

Singh told the Left MPs that he will ask External Affairs Minister Salman Khurshid to take up the issue with Italy.

His comments came in the wake of Italian Foreign Ministry statement that the marines Massimiliano Latorre and Salvatore Girone will not return to India from Italy where they had gone to cast vote in last month's elections after special permission granted by the Supreme Court.

The two marines are facing trial for allegedly killing two fishermen off the Kerala coast in February last year, mistaking them for pirates.

The Italian Ministry claimed India had not responded to its requests to seek a diplomatic solution to the case and there was now a formal dispute between the two countries over the terms of the United Nations Convention of the Law of the Sea.

Khurshid said the government is studying Italy's decision, its reasons as also implications.

"We will study and take a rightful position... We will take informed position," he told reporters on the issue which is very sensitive in Kerala politics.

Rajesh said, "We met the Prime Minister and took up the issue of Italian marines. The Prime Minister told us that he came to know about this from newspapers. He assured us that he will ask the External Affairs Minister to look into this issue to intervene in this issue." Balagopal alleged that it was "the result of a high level conspiracy between somebody holding the highest post in Indian government and Government of Italy." He, however, did not specify.

A delegation of MPs from Congress-led UDF also met the Prime Minister separately.
"More than saying whether this is acceptable or not, the Prime Minister has said that he will ask External Affairs Minister to take up this issue and use all diplomatic channels to bring them back," Congress MP P C Chacko said after the meeting.

MPs from Indian Union Muslim League (IUML) and Kerala Congress (Mani) were also part of the delegation.

Law Minister Ashwani Kumar said the Ministry of External Affairs and his ministry will consult with each other and "make sure that we proceed ahead as effectively as we can."

He observed that "there are complications" as the issue relates to a foreign country.
"We are dealing with foreign diplomats within the framework of the established diplomatic conventions and norms," Kumar said.

At the same time, he emphasised that the government needs to ensure that Indian laws and court processes are "respected by foreigners".

Congress Vice President Rahul Gandhi was asked by reporters in Parliament House to comment on the issue but he did not answer.

Rome, March 12  (IANS/AKI) : Two Italian marines being tried for murder in India will not return to the country as New Delhi does not have jurisdiction over the case, the Italian foreign ministry announced Monday.

"Italy has always argued that Indian authorities have violated their obligations under international law...especially the principle of immunity from trial by the organs of a foreign state and the United Nation Convention on the Law of the Sea," the foreign ministry said in a statement.

The decision not to send Massimiliano Latorre and Salvatore Girone, who had been allowed to come home to vote and meet their families, back to India was taken by Italy's defence and justice ministries in consultation with the prime minister's office, it said.

The two marines have been at the centre of a year-long international row for allegedly shooting dead two Indian fishermen after mistaking them for pirates off the southern Indian state of Kerala February 2012.

Italy claims the incident occurred in international waters and has been trying to get Latorre and Girone tried in Italian courts, while India contends the shooting occurred in its own territory.

India's Supreme Court last month allowed Latorre and Girone to return to Italy to vote in the Feb 24-25 national election. It had earlier allowed them to go home for Christmas.

    It was naive on the part of the Chief Justice of the supreme court to accept an affidavit from an ambassadoe who has diplomatic immunity from prosecution.

    Would Italy have sent two Indian soldiers home for Diwali and to vote in General elections? NO

    So why did we?

    There must have been some quid pro quo

    The families were offered one crore. Although a life is precious, the family would never have earned this kind of money in their life.They should have taken the blood money and walked away.

    Now no justice, No money, no case and no conviction.

I admire how those governments take care of their citizens. Our own people rot in Paki and middle east jails for years without trial and there is no one to help them.

    There can be no doubt to the fact that the killing of fishermen was deliberate and intentional. Being well trained and specialized in the field of marine security, there shouldn't have been difficulty for the Italians in identifying those fishermen using their latest devices and instruments. Moreover those fishermen were unarmed and there no any kind of resistance from their side. This avoidable tragedy wouldn't have occurred had they been in European or American waters. It was a display of white hegemony over the blacks.

    In no country of the world, whether a citizen or a foreigner, is allowed to travel out of the country until and unless pending case against him is settled. The Supreme Court's decision is indeed surprising. Was it under some pressure from the one who is above law? In case of US arrangements to vote are made in their embassies and consulates for citizens living out of the country. Similar arrangement could have been made by the Italian Embassy also. Allowing them to leave the country to cast their votes is only an excuse for their actual release which was planned ahead with the connivance of the government.The case involving foreign culprits should have been tried in a special fast track court. Such undue long delay of justice has now finally resulted in denial of justice to the poor victims and their families.

    Italian Govt. had offerred Rs 1 Crore compensation to the families of the victims for a out of court settlement.Even the victims families were prepared to accept the compensation and withdraw the case. This was the best solution for a settlement as the marines i belive fired at the fishermen thinking them as pirates.We cannot blame Italian Govt. fully as they have agreed to compensate the family of the victims.Now the biggest losers are the victims as they have lost both-family member and compensation.We have to speed up our Judicial system in delivering Justice in this type of cases so that the matter is not dragged for years.

    EVEN WHILE TOURING EUROPE SPECIAL WARNING IS GIVEN TO PROTECT PERSONAL BELONGINGS IN ITALY.
    THERE IS AN ELEMENT OF CHEATING AMONG ITALIANS WHICH IS PROVED BY HISTORY OF EVENTS.
    HOWEVER INDIAN AUTHORITIES SHOULD NOT HAVE SENT THE CULPRITS BACK WITHOUT PROPER PUNISHMENT.
    NOW THE POOR FISHERMEN WILL NOT EVEN GET ANY COMPENSATION ALSO LET ALONE JUSTICE.

    At the first instance India shouldn't have allowed them to fly back to Italy. There is no value for poor fishermen's life. The best thing is to sever all diplomatic and trade exchanges between India and Italy. India is not depend on Italy = but they do business by bribing Indian middlemen.

    It is th eright decision by Itlaians. What is the use of rotting in India because the justice is not likely for a few more years anyway. It is tragic that they killed... but it wasn't intentional. It is not as though they murdered in cold blood. We are killing and raping thousands of our own citizens.     In case he was allowed, India would have handed over its Citizen meekly to Italy or Pakistan.

It means no other convicted criminals are having daughter nor they got married till date?
