The complaint relates to raising of a loan amounting to seven lac rupees by Gopal Pandit, employee of the resort, from a bank by hypothecating a vehicle belonging to the resort.
Pandit Health Resort in Alangar is a unit of Benefit Film City India Ltd. In 2009, president of the company, Ruby Agarwal, had bought a Toyota Innova car, and handed it over to Gopal Pandit to enable him to monitor development activities at the resort. It is said that Gopal Pandit created forged documents and availed a loan of seven lac rupees from Kankanady branch of Mangalore Catholic Cooperative Bank Ltd, duly transferring this amount to the account of his wife, Rajeshwari S Pandit.
Ruby claims that she came to know about the fact that a loan had been raised against the said vehicle, only after the bank seized the vehicle because of overdue installments and interest. Thereafter, she filed a complaint of fraud in the local court.
In a counter complaint filed in the same court, Gopal Pandit said that Ruby Agarwal had borrowed an amount of seven lac rupees as loan from his wife, Rajeshwari, and that Ruby had borrowed the above money on the security of the vehicle to repay the money borrowed by her. He has said he has not defrauded the company.
