Bangalore, Jul 18 (IANS): Karnataka Chief Minister B.S. Yeddyurappa's petition against his prosecution on corruption charges will be heard by a larger bench of the state high court as it involves constitutional issues.
The petition will be referred to Chief Justice J.S. Khehar for referring it to a larger bench, Justice A.S. Bopanna said Monday after hearing arguments for and against the petition filed by Yeddyurappa.
The chief minister is challenging Governor H.R. Bhardwaj's sanction to prosecute him on charges of corruption and illegal land deals.
He filed the petition July 14, nearly six months after Bhardwaj gave the sanction to two Bangalore advocates.
The advocates, Sirajin Bhasha and K.N. Balaraj have filed five complaints in Bangalore trial court against Yeddyurappa, his two sons, son-in-law and several others.
Appearing for Yeddyurappa, senior counsel Ram Jethmalani said the "governor's action is not immune from judicial scrutiny if it is found to be vitiated by doctrine of bias".
Senior counsel P.P. Rao, arguing for Bhasha and Balraj, opposed Yeddyurappa's petition saying the chief minister has not denied the charges in the complaints on which the governor granted the sanction for prosecution.
