Mangalore, Jun 17: Javed Ali (22) from Ullal, who had been arrested along with four other suspected terrorists from an inter-state police team three years back, has succeeded in securing his release on bail. Javed, who had secured bail from the state High Court two months back, complied with all the legal formalities and judicial processes, and got released from Parappana Agrahara central jail here on Thursday June 16.
Javed, accused to be a member of the Indian Mujahideen, had been arrested in a joint raid conducted by Anti Terrorist Cell from Mumbai, Anti Naxal Force of Karnataka and Dakshina Kannada district police, on August 3, 2008. Along with him, Ahmed Bawa from Haleangady, Naushad from Pandeshwar, and Javed’s father, Mohammed Ali from Mukkacheri, were arrested. They had been taken to Mumbai for questioning.
Javed, who is expected to reach his home on Friday, has been ordered to be present at Ullal police station on specified days.
Although the charge that Javed had taken part in a meeting organized by the Indian Mujahideen in 2006 at Bhatkal is true, he was a minor then. The second charge is that suspected terrorist, Riaz Bhatkal, was given shelter at his home. Even this happens to be true, but the house belongs to Javed’s father. The other charge is that he was found to be in possession of banned literature published by terrorist organizations. His lawyer, Jagadish, argued in the backdrop of Binayak Sen judgment, that this cannot be construed as a crime.
After hearing arguments from both the sides, Justice A S Pachhapure had upheld the bail petition, and granted conditional bail.
