Yadgir, Apr 13: In an interesting case, a woman has filed rape case against her husband. Sunita, wife of Bheemaraya Mareppa Nayakody from Vibhutihalli village in Shahapur taluk in the district, has made this complaint.
Sunita was married when she was 13. She became mother of a female baby within two years thereafter. After she was driven out of home by her husband due to differences between them, she approached the court for alimony. The court of the junior magistrate (first class) rejected her demand for alimony, sighting that she was a minor girl.
When the case came up before the Gulbarga circuit bench of the state High Court, Bheemappa argued that child marriage is illegal, and hence, the child did not belong to him. Judges of the circuit bench, Justice K L Manjunath, and Justice B Mohanar, who formed the division bench, noted that under law, there is a provision for filing rape case against him, as he has admitted having copulated with her when she was a minor.
On the basis of this observation, the lady has filed a case against her husband. The case has got an interesting turn because of this development.
