Karnataka contests Kerala's claim over 'KSRTC' trademark, terms media reports as 'incorrect'


Bengaluru, Jun 5 (IANS): Terming the reports in a section of media as "incorrect", a top Karnataka official on Friday contested Kerala's claim that the Central Trade Marks Registry had upheld its appeal on using the abbreviation 'KSRTC' for Kerala State Road Transport Corporation, and not for Karnataka State Road Transport Corporation.

"As no final order has been passed by the Registry in the appeals, media reports on the verdict are factually incorrect. We have not received any such order from the Registry as claimed," Karnataka State Road Transport Corporation (KSRTC) Managing Director Shivayogi Kalasad said in a statement here.

The Kerala State Road Transport Corporation had on Wednesday claimed that the Registry had issued an order under the Trade Marks Act of 1999, allotting the abbreviation 'KSRTC' to it in a legal dispute between the two state-run undertakings that began in 2014.

Kerala has all along argued that it has been using KSRTC since 1965 when it began the bus service, while 'Karnataka' came into being after the state's name was changed from Mysore in 1974.

"As the Central government had abolished the Intellectual Property Appellate Board (IPAB) by an ordinance on April 4, 2021, all such pending applications will be transferred to the high court for adjudication," reiterated Kalasad.

Asserting that there is no legal bar on using the trademark 'KSRTC' for the state-run corporation, Kalasad said Kerala's claim that Karnataka cannot use the trademark for its undertaking is untenable.

"We are consulting our lawyers to take legal steps to protect our rights. If Kerala issues a notice to us, we will respond suitably. We reserve our right to legally defend our claim," added Kalasad.

    According to my understanding of the judgement, Karnataka can not stop Kerala from using the abbreviation KSRTC, which in no way means exclusivity for Kerala. Karnataka still can use the same is my understanding. As far as the comments regarding Kerala & Mallus, have only one thing to say, Kerala is United by language whereas Karnataka is Divided by Religions. It is this unity which helps the State gain many things which others are jealous of.

    I strictly instruct Modi ji and Amit Shah ji to make Kerala union territory and instruct Nitin Gadkari ji to change name from 'KSRTC' for ‘’MSRTC” Malyali state road transport corporation and this is my order not long ago Kerala was part of greater Mangalore due to some wrong mapping by central government Kerala become a separate state This issue is nothing but the new government in Kerala knows that people in Kerala like strike and just want a reason to go on strike and for Keralites strike is like a festival every one over there participate with great gusto and fervor also during strike they wake up early wear new clothes visit place of worship distribute sweets and burst cracker and hit the street teh scene over the street is like some carnival .

    Its is very pathetic to know and read about the fight between The Karnataka State Regional Transport Company & Kerala Regional State Company over the common acronym After all both the states name being with the letter 'K' .So, What's in the name when we have a separate state and government with a decent capital ' Bengaluru '. When will the country at large and Karnataka in particular improve if these on going fights take place? When will we see the light of progress?     There shouldn't be problem using KSRTC name. (ULLAS SINDHI ASSOCIATION) Maharashtra ULLAS NAGAR business SINDHI community Used USA brand in their trade. Finally SINDHI'S are allowed to USA brand name & won the case.
