Mangaluru: Association of Medical Consultants rubbishes allegation made against doctor

Mangaluru, Jun 4: After a woman alleged that a few doctors in the city had denied her treatment for Covid during her pregnancy and that a doctor threatened her and attempted to murder her, the members of the Association of Medical Consultants (AMC) discarded the allegations by the woman deeming it to be false.

The office-bearers of AMC said that there is a persistent atmosphere of fear and a hostile working atmosphere for doctors managing Covid cases in private hospitals.

Addressing a press meet here Medico-Legal Cell chairperson of AMC Dr Sathish Bhat said that though the doctors and staff in the hospitals are attacked or abused, the police department has failed to take proper action against the accused. There have been three separate incidents that took place in different private hospitals in the city, but still, the police department did not take any necessary action.

Though an FIR has been registered against the accused, the police are not arresting them. Though there are provisions in the law like Karnataka Prohibition of Violence Against Medicare Service Personnel and Damage to Property in Medicare Service Institutions Act, 2009 and Karnataka Epidemic Act the accused have not been arrested while in some instance cases they have not even been booked, he alleged.

"The woman who made the allegations against the doctors is false. Moreover, the woman never listened to the advice given by her doctor. During this pandemic, the doctors are doing their best to provide treatment for Covid patients," he said.

Delay in following instructions of Doctor led to a desperate situation where complex treatment was needed but they could get it only after visiting 5-6 hospitals.

Denying the woman's allegation that Dr Priya Ballal refused to treat her as she was pregnant and suffering from Covid infection, Dr Bhat state it very unlikely for a doctor to make such a statement. "The police should arrest the prime accused who has manhandled the doctor," he argued.

Dr Yusuf Kumble, AMC Insurance Cell chairperson said, "Those who break the law should be punished. Even if there are 98% of good people in the world, 2% of the bad people can cause unrest in society. These people do not belong to any religion or caste but will only indulge in anti-social elements. They should be exposed."

He also questioned why do doctors deny treatment or kill a patient. The allegations made against the doctors are false.

Dr Murlidhar, Dr Priya Ballal shared their experience stating the despite of busy schedule they have treated patients and never denied treatment to any of the patients in their professional carrier." The false accusation made by the woman against them and their profession have severely hurt us and they pained by this."

Dr Priya Ballal said that in her 21 years of experience she has not denied treatment to any patient. Being a gynaecologist, I have examined several Covid patients. "The woman has alleged that I have given her a wrong advice which is untrue and such accusations are not acceptable."

Murlidhar also said all doctors and staff in Wenlock hospital are working tirelessly to provide treatment to the Covid patients.

Dr Jayaprakash who has done his MD in critical care medicine from Tata Memorial Center speaking on the occasion said, "If I wanted to earn money, I had several opportunities to make money by joining various medical institutions abroad, Mumbai or in Bengaluru. But, I decided to serve in my city. We are away from our family and committed to our work. If I start at 8 am, I return home at 3 am. I have treated the lady in her critical condition. I am pained by the false allegations made against me. The fact that despite the complaint, the police have not arrested the main accused is disheartening."

It may be recalled that one Kadheeja Jasmine had filed a complaint with the police that her gynaecologist Dr Priya Ballal denied providing treatment to her. The complainant had also alleged that few doctors threatened her and even attempted to murder her.

President of AMC, Dr KR Kamath, Dr GG Laxman Prabhu, and others were present during the press meet.

Excerpts of the press note issued by AMC

As you would know, more than 1,000 doctors have passed away due to corona, while serving society as frontline warriors across the country. Karnataka right now continues to be in the top 2-3 states for corona cases in India. DK district is having close to 1,000 cases daily during the second wave, even though the stringent restrictions have been in force for more than a month. While the number of deaths with other frontline Covid warriors is less this time unlike in the first wave, healthcare workers who have died due to Corona refuse to decline.

Over the last few days, many of our members have contacted us about their concern and fear in handling the behaviour of relatives of critically ill patients admitted with corona in various private hospitals of Mangaluru. This is different from the situation in the past, as we are in the middle of a pandemic. By now all know well, no country in the world can be completely prepared during a pandemic, with complete facilities for every person who falls sick. This is the harsh truth. In such a situation, when family members get emotional, is it fair to make the doctors face their anger, especially if hospital beds, oxygen supply, ventilator/ICU beds or critical medicines are not available?

In one incident at Indiana Hospital on May 19, the patient's relative forced himself into an ICU and abused the hospital manager and lady doctor attending the patient. A police complaint was made the same day, but it was registered only as an NC complaint.

Following the death of a high-risk 60 year patient in Mangala Hospital, despite two weeks of treatment, there was an abuse of hospital staff, vandalism in casualty even after the bulk of lawfully raised invoice was reduced by 3/4th. A police complaint was lodged on September 17, 2020, and FIR 0083/2020 at Kadri PS was registered. There was major defamation on social media by the accused, but to date, the police have not arrested the accused, and stringent sections under Epidemic Act were not included in the FIR.

Most disturbing is the defamation and allegations on the entire medical fraternity following the treatment provided to a lady who was into her third trimester who developed complications after the Covid infection. It resulted in her needing ventilator care and caused the termination of her pregnancy. Delay in following the instructions of the doctor led to a desperate situation where complex treatment was needed but they could get it only after visiting five to six hospitals. Now, this has led to allegations of mistreatment with abuse and threat to doctors. With the arrest of a few of their family and friends, one Khadeeja Jasmine, initially called her gynaecologist Dr Priya Ballal on May 17, 2021 complaining of cough, cold and fever. She did not follow the advice of undergoing a Covid test and come with a report immediately so that a checkup could be done. Instead, she came to the hospital two days after she reported breathing difficulties. She was given appropriate medical advice, but she still stayed home. By the time she came the next day for admission, finding a hospital bed with Ventilator in Covid ICU, it was difficult to do a C-section on her. Where it was available, the patient did not want treatment, and where they agreed to do the treatment, bed was not available. This led to further delay and deterioration of her health. However, fortunately, a healthy baby was delivered by C-section in Lady Goschen hospital on May 20, 2021. Thanks to the heroic support provided by doctors in a difficult situation, the mother also recovered after another week.

What was unfortunate was the blame game after delivery against the very doctors who were treating her, which turned to allegations by the mother that the doctors are trying to kill her. Her attenders called the doctors to discuss, which led to the manhandling, abuse, a threat with bodily harm and a fatal attack on three of the doctors by the mob.

Ironically these very people are the ones who were responsible for saving her life, as well as that of her unborn child. They changed hospitals twice even after delivery. Though doctors went with a complaint against the mob, FIR was registered the next day. Even though the entire incident was captured on CCTV, the arrest did not place until the next week.

First Patient accused of Dr Priya Ballal denied her treatment , irony is she actually got treatment from Dr Priya Ballal where she is a HOD in LGH . It's soo disappointing to see that people don't even know who treated them and simply accuses the doctor for not getting treatment . DR Priya Ballal is THE BEST OBG Professor and DOCTOR in entire city there is no question of she denying the patient . Main thing about this patient is ****Why Can't she take care of herself in this pandemic and not getting this COVID . make her pregnancy complicated and put her baby in Danger ??? *** . All this happened because of Careless of the Patient and the bystanders who is questioning about the duty of doctors mainly Dr Priya Ballal, On the first day she got admitted to Athena hospital , The Intensivist admitted her to give immediet treatment to reduce her severity and reffered later to other hospital , now these Literate bystanders accusing that intensivist admitted her simply to take money !!! Seriously!!???? He is the reason behind her and her baby survival . Please think first and talk. This patient would have delivered baby normally if the bystanders would have taken care .

I dont think these doctors who have dedicated their lives to save others deserve this. Its very sad that ppl who have failed to follow doctoes advice can then very conveniently turn around and blame the dr.. when this go bad because of their own decisions. Goondaism and threats r not to be resorted to just because u cant or are not willing to own up to yourself even that you made a wrong decision for yourself. Pls dont blame dr's for your own bad decisions. In such trying times they r working hard to help others survive. If they are embroiled in such hate and wrong accusations.. their will to serve can be destroyed. That is not going to do any of ua any good.

The patient is lying that junior doctors delivered her, in Lady Goschen all Cesarean deliveries are done by senior doctors alone including this one, I watched this patient, s narration about 3 ventilators being available, that's a total lie, a patient who could hardly breathe easy and just undergone cesarean is talking about the available ventilator beds, how does she know? Is she the Covid ICU in charge in Wenlock? She's an expert liar is what is evident from her FB talk, she was the classical kind of patient who thought that she knew everything and that she would decide her own management, when things worsened she and her family blamed all the doctors who helped her to stay alive so that she is fit and fine enough to lie against the very beings who helped her survive a critical situation. Thankless!

Reading these comments Is so disheartening. All these people who have commented. I would like to know if they wud enter a covid ward to help someone else out . No one would. We are in a situation where it isn't bout money anymore. Please have a look at covid wards ... only doctors n nurses wear that suffocating ppe n stand for hours . In a time where ppl don't even meet their covid positive relatives doctors constantly work with absolute strangers. U all really think they risk their lives for money ????? U think it's worth it. The patient was told to come to the hospital early which she ignored. Wat should the doctor do personally go pick her?? And u think doctors are rude ? They aren't rude ... they have to answer a lot of relatives. Not just one.. they are human they are allowed to have feelings. N bout the explanation. Covid is very unpredictable. No doctor can tell u not to worry everything is OK in a situation like this because there are situations where perfectly improving patients have gotten bad suddenly. So no doctors can't sugar coat . Because if something goes wrong these same relatives will question " u said he's fine ". Don't show hatred to one's protecting u . Because I they decide its not worth it anymore we won't know wat to do

I usually stand against doctors in these type of cases. But my stand is different here because Dr.Priya Ballal is more of a human being than a 'doctor'. I have seen Dr. Priya Ballal driving to Lady Goschen hospital at different times in the night. I have seen her leaving the hospital at around 2.00 am and returning back at 5.00 am to attend a patient. At her hospital in Kadri, one evening she was all dressed up to attend an event I think, a cardiac patient was brought in. Mind you, the hospital is a gynec one and they do not admit any other cases. Since the patient had a massive cardiac arrest, the doctor just kept her bag in the counter and asked the patient to be shifted to the ICU. She did the primary treatment and meanwhile a cardiologist was called. She denying a treatment for a patient is simply not believable. Please do not harm a few good species in the current corrupt ecosystem of healthcare.

It's important to know both sides of the narrative even before giving the final verdict. There are a few reasons why patients go from one hospital to the other. 1) The hospital has run out of facilities that would be important for the treatment such as ICUs beds or ventilators, dialysis facilities etc and so the patient gets referred to other centers for further treatment. 2) The hospital has the facilities and at the time of admission the patient and their attenders are explained about the charges for the room, medicines, investigations, etc wherein most of the charges are FIXED but vary from hospital to hospital and but the patient side are not willing for the same (due to affordability or any other reason) and hence go to another centre. 3) The hospital has the facilities and patient are affordable to avail but just choose to discontinue the treatment for whatever personal reason and choose to either go to another hospital or maybe back home. What is important to remember is that even after doctors explain the treatment requirements, etc the patient or patient party can choose not to avail the treatment on their own risk. They would be required to sign stating that they have no issue with taking the patient to another hospital/ home. The patient is free to say no to either certain medications or investigations or even admission but would be required to sign a consent stating the same and that it is on their own risk. NOBODY FORCES THEM. There might be a few doctors who do it for the money but just because of those few please dont blame the rest of the medical fraternity. It is easy to sit behind screens and comment but how many of you all will be willing to work endless hours, not see your family, get paid even less than the bare minimum, with no insurance, with no safety. You call it noble profession. You call doctors God's or heroes but are they asking anything of that? No. Just treat doctors and other healthcare workers with basic decency and respect.

Those who are commenting all nonsense about Doctors have no clue as to what it takes to become a Doctor or support staff in health services. Beside not only the amount of money , one has to have lot courage, intelligence, patience, perseverance and endless hard work without proper sleep and food on time to become a Doctor or Health worker. Given the amount dirt and filth they have to handle of patients with chronic diseases on a daily basis fighting to save lives at the cost of their own life and family life, it is not everyone's cup of tea to get into health services profession. It is very unfortunate and painful to see how our Doctors get treated for all the good work they do in these critical times. Does anyone talk about how many doctors lost their lives some of them very young, in this pandemic and what their families must be going through. Treating and bashing them on duty like street thugs is unacceptable and wrong doers deserve severe punishment and require tough laws to protect the Doctors and Health workers. It looks like we have lost humanity for our arrogance and power of wealth. God Bless all our Doctors and Health Staff.

But patient also alleged strong observation on dr jayaprakash of him asking patient family to not damage hospital, pay bill on time and patient will die and tell your family members to meet the patient one last time. Dont know if truth, but statements like this by doctor to a family who are concerned about their patient recovering in good health, is uncalled for. Doctor mite say something lightly, but it will have strong effect on patient under stress. Also There is so much gross errors in all the hospital billings but these association will not discuss it with hospital owners. Where has their ethics gone regarding this? Govt rules also say that corona patients shud not be referred which seems like have been violated here. Doctor has clearly told one hospital did not have facility for covid delivery hence referred. Facility should have been provided as per law. Both parties have suffered. One emotionally, other physically. This issue shud have been settled amicably.

Please wear ppe kit and stand for 14 hours without drinking water or having food on time and see hundreds of patients . Then let’s see where your patience remains

Most people are sitting at home due to lockdown. But these doctors are working hard in ppe suits night and day. You forget they are human beings and also feel like everyone else. And to people judging doctors for the money they make, nobody is perfect. There are corrupt ppl in all professions . Don’t judge every doctor by the same yardstick. There are extremely sincere , good doctors too. Can’t say much about hospitals though

Doctors aren’t different . We are human beings .We have our parents , we have our siblings, We have our spouses . We leave everything and are working day and night all we expect is some gratitude nothing beyond that . Some Hospitals are making money I won’t deny but most of the doctors are salaried. During last lockdown doctors were paid half salary , yet nobody went on a strike and all were performing their duties relentlessly.
