'Not competing with Kerala': Karnataka hints at still using KSRTC


Bengaluru, Jun 4 (IANS): With Kerala winning the 'KSRTC' trademark after a seven year legal battle, Karnataka Deputy Chief Minister, Laxman Savadi on Thursday said that the state government would not like to make it a prestige issue but hinted at continuing to use the trademark.

The Karnataka State Road Transport Corporation and its Kerala counterpart were locked in a legal battle over the acronym KSRTC for the past seven years, as both their buses and websites were using it.

Savadi, who holds the Transport Ministry, told reporters that there is no harm if the same acronym is used as both transport corporations aren't fighting a trade battle.

Noting the state government is yet to receive the judgement copy that is delivered by the Controller General of Patents Design and Trade Marks under the Union Commerce Ministry, he said: "Until then, the question of taking a legal course does not arise. Let everyone know that both transport corporations are not fighting a corporate battle here... we both are government organisations and our motto is to serve the people without causing any trouble."

He added that within the federal structure, both states will have to abide by the decisions given by judicial or quasi-judicial authorities.

"Both states' intention is to set up such a corporation is to provide subsidised public transport and with an intention to connect every village within their respective states. We both states have never competed in this sector nor we (at least Karnataka) intend to," he said.

In 2012, the Karnataka State Road Transport Corporation had requested its Kerala counterpart to refrain from using the name KSRTC after obtaining a trademark on the name from the Trade Marks Registry.

Karnataka's RTC has a two-headed mythical bird 'Gandabherunda' generally portrayed in temple motifs as clutching elephants in its talons. Kerala RTC's logo referred to as 'Aanavandi' also has two elephants on its logo. Kerala RTC had started using it much before neighbouring Karnataka but Karnataka had got the name registered with the Trademark Registry in 2012.

Contesting this claim, the Kerala RTC had filed an objection with the Controller General of Patents Design and Trade Marks in 2014 and won this claim on Wednesday.

The Kerala State Road Transport Corporation is one of the oldest public transport utilities in the country. The Travancore State Transport Department was re-established as the Kerala State Road Transport Corporation on April 1, 1965.

In Karnataka, it was started as the Mysore Government Road Transport Department and became the Karnataka Transport Corporation in 1973.

    Prashanth, Badiadka : I hope u read the news properly... It was not Karnataka went to the court. Karnataka tried to register the firm and Kerala put the stay claiming they have already registered. and both states using th esame names also no problem. the KSRTC Karnataka amount goes to Karnataka and kerala ones goes to kerala. Instead of going to court and spending so much tax payers money for the lawyers they could have sorted out the problem outside the court itself.

    Dear Edmond, You are right. But my point is, both were using the name from decades, all of a sudden these guys wanted other party not to use it. And now they lost the right to use the name themselves. This is really poor planning and execution. Last year during lockdown, inorder to prevent people entering DK from Kasaragod, DK adminstration closed the roads by heaping mud at the borders. Some places they even dug the road. Finally what happened?? Karnataka lost some land at Talapady border and also in Kallapalli border at Sullia Taluk. Our govt officials and politicians have very poor foresight of consequences of thier actions These embarassing situations could have been avoided

    As a unbiased "ಕನ್ನಡಿಗ", I feel Kerala deserves KSRTC. (sorry, if I am harsh to fellow ಕನ್ನಡಿಗ) See the chronology 1. Kerala state is formed in 1956. 2. Existing TSTD is named as Kerala state road transport corporation (KSRTC) in 1965 3. Karnataka state is formed in 1973 (till 1973, ours was Mysore State) 4. Existing MSRTC is renamed as Karnataka state road transport corporation (KSRTC) in 1973 If we further go for ಮರು ಪರಿಶೀಲನೆ, get assured of ಮಂಗಳಾರತಿ. Hence Karnataka should gracefully accept the verdict. No point in bullying others in every matter, particularly unjustified cases.

    .I agree with RSRB' comments. It is Karnataka who took Kerala to the court in 2012 to gain complete rights on the name, when there was no issue both were using the name from decades. Very poor legal planning. They though the other party will just surrender without fight. Now they lost everything including self-respect

    Instead of getting into a legal dispute, Karnataka can use the name "KESARATTISI" (ಕೆಸರಟ್ಟಿಸಿ) or KARAARASAANI (ಕರಾರಸಾನಿ) which are already used by people. I hope the Mallus will have no objection to that.

    Logos are not same for both corporations. So both states can use the acronym KSRTC. Important need is to change the website so that people may not get confused.

    On what grounds did you loose the battle ? You need to explain ..I am sure your lawyers might not have attended the case proceedings .. You need to explain who was appointed as the lawyer to fight this case ? How much money did he gobble up along with you MR Minister ..My issue is not that the trade mark or brand name has gone to KErala ..But I Want to know what was your effort and who was the lawyer who fought this for karnataka ? Isnt there a poilcy in place before you started using the name ? Where you sleeping in the first place when you decided to give this name ?

    How will they name the lawyer, most of the time lawyers representing states or center are affiliated to the party, this is why most of the lawyers join political parties and they become millionaires, they are not bothered about winning or loosing the case.

This is because of the highest corruption in Karnataka.. going by the IT hub in blore, Karnataka should have been no. 1 state in India.. but it is unfortunate the political leaders of the state are probably the worst in South India...
