Allahabad high court revokes NSA against Dr Kafeel Khan, orders release

Prayagraj (UP), Sep 1: The Allahabad High Court on Tuesday September 1 pronounced verdict in the habeas corpus plea filed on behalf of Dr Kafeel Khan. The court revoked the National Security Act (NSA) charges against Dr Kafeel Khan, and directed his immediate release.

Khan is presently lodged in the Mathura jail under the National Security Act. He was arrested from Mumbai in January this year, for allegedly giving a provocative speech at the Aligarh Muslim University on December 13, 2019, amidst the anti-CAA protests.

The Division Bench comprising Chief Justice Govind Mathur and Justice Saumitra Dayal Singh had reserved judgment in the matter after perusing the original record of the proceedings against Dr Khan under the NSA. The Bench conducted two days hearing last week and the matter was listed for final disposal on Tuesday. Notably, Khan had been granted bail by the court of CJM, Aligarh on February 10. However, he has been languishing in jail under the NSA Act, which was slapped on him by the Aligarh District Magistrate on February 15.

The present habeas corpus plea was moved by Khan's mother, Nuzhat Perween. She had first approached the Supreme Court in March this year, seeking release of her son.

However, a bench comprising CJI S A Bobde, Justices Surya Kant and BR Gavai disposed of the plea with an observation that Allahabad High Court is the appropriate forum for dealing with the matter. Through an order dated August 19, the High Court sought for the original record of the proceedings against Dr Khan under the NSA.

    People,

    Supreme Court should order an independent inquiry to find facts who is responsible for NOT ensuring adequate oxygen supplies to the hospital....Dean of the hospital blame Contractor...Contractor blames Dean of the hospital....

    How this Kafeel can in between the 'Cross Fire' ...I don't know....

    Whoever is responsible....need to be punished....otherwise this will happen somewhere else...

    If NSA files a FALSE treason case against you...then only you will know how it feels....If you scream Chor Chor all the time....Even when REAL chor comes people will ignore you...

    Look if he has committed treason ....go ahead and file the case ....if he get acquitted after 5-10 years both you and NSA should go to prison....simply don't file silly treason cases for heck of it...

    He bought oxygen cylinders with his own money after every government official looked the other way.His only fault was that he mentioned this to the press.This ruffled the feathers of the great CM who decided that this man should be harassed.He was put in jail on trumped up charges and when he was released the central government used their machinery to put him inside again. God is the witness to everything. Evil cannot triumph always.

    On 19 April 2018, while responding to an RTI query, the BRD administration admitted that it was facing shortage of oxygen cylinders on the night of 11 August 2018. It said that around six cylinders were bought from other hospitals and the then nodal officer Khan had arranged four oxygen cylinders on his own. On 25 April, Khan was released on bail after 9 months of imprisonment. The court ruled that there was no evidence of medical negligence on his part.On 27 September 2019, Khan was acquitted of all charges. According to the departmental enquiry report, "The allegations against the accused are insufficient... Therefore it is submitted that the accused officer is not guilty. While in prison, Khan's wife alleged that he was denied medical care in prison. Two days later the allegation,

    on 19 April 2018, the police took him for a medical examination, which had been due a week earlier

    On 10 June 2018, Khan's brother, Kashif Jameel was shot by unidentified assailants who were on motorbikes. He received three bullet wounds on his right upper arm, neck and chin, but survived the attack.On 24 February 2020, Khan's uncle, a property dealer, was shot dead in Gorakhpur.

    Now Swathi, tell us who tried to kill whom and how the government mechanism tried to eliminate Dr. Kafeel Khan. You can be blind but not so much blindness that you yourself fall in a ditch.

    This well respected once assistant professor doctort who did his his MD (Paediatrics) from KMC, Manipal try to save ICU childrens in a Gorakhpur hospital by begging Oxygen cylinders at midnight from nearby private clinics. Still 60 childrens died due to lack of oxygen. Oxygen procurement was denied to the govt. Gorakhpur children hospital by Adityanaths govt. despite seversl reminders. This doctor was later victimised by govt. since he saved many childrens. He is still being victimised because he saved childrens.

    In this Gorakhpur hospital, enquiry confirmed that from weeks, administration alerting shortage to government and oxygen supply was denied to hospital for obvious reasons. You can see many documentary evidence in "Youtube" channels. Please dont believe paid news in TV channel
