Daya Nayak Gets Clean Chit - Will be Back in Mumbai Police


Mumbai, Nov 12: Senior cops reject ACB pleas to prosecute suspended encounter specialist, paving the way for his return to the police force

Senior cops yesterday rejected the ACB's pleas to prosec- ute suspended encounter specialist Daya Nayak.
 
The decision, which was jointly taken by outgoing Director General of Police S Virk, Anti-Corruption Bureau (ACB) Deputy Inspector General Nikit Kaushik and Deputy Commissioner of Police Sanjay Parande, has cleared the way for Nayak's return to the force.


Nayak, who once served water at an Udupi restaurant in Andheri, attended a night school to complete his education.

He was inducted into the police force in 1996.

Rs 1 cr from actors

In 2001, the ACB received a mail, requesting officials to investigate Nayak's assets. It was alleged the encounter specialist had collected around Rs 1 crore from Bollywood actors.

But he was given a clean chit later that year by senior policemen. Nayak suffered the first setback when he was transferred from the Criminal Investigation Unit at Andheri (East) to Kandivli police station in 2002.

Arrest in 2006

On December 3, 2004, Nayak was charged with disproportionate assets worth Rs 41.75 lakh and arrested in 2006. Following investigations, it was discovered that only an amount of Rs 6 lakh, could not be accounted for.

Nayak, who has allegedly eliminated 82 gangsters so far, had accused the underworld of trying to silence him.

Nayak had explained that the money was part of the Rs 7 lakh the commissioner had given him from his secret fund to pay some informers.

Speaking exclusively to daijiworld from Mumbai, Daya Nayak said that he is delighted to know that he has got the clean chit.  "I have immense faith in the Almighty and confidence in my seniors. I am grateful to all those who stood by me during my difficult times," visibly relieved Nayak said.

    Ms. Juliana, Udupi. You wrote to Daya Nayak to "be sure before his next shot" and then about "innocent" people also. Daya is a good Police Officer. Resonable and justified. Also a kind one. Some years back Daya Nayak was hounered in one certain evening fuction organized by Catholics in Malad west which I had attended. He was addressed as "Encounter Specialist". In that fucntion he spoke in Marathi so that all will understand. Amongst other things, he said that in the Police life one has to undergo and face many things whether they like it or not. He gave an example that once it so happened with him that his own class mate was arrested by him in certain illegal activity. Then the culprit introduced himself in Tulu as Daya's Classmate in SSC. Daya helped him to live a better life. But in vain. That man again went into illegal things. It is not easy to correct the criminals. He further said when there is fight with criminals, Police over power and arrest them. He said " I have no desire/craze to kill the people but when the criminals fight with us with fire arms, we have no option but to depend ourselves to save our life. We can do that only by killing them". No innocent is punished. No unarmed persons is encountered. Later, what had happened with Daya Nayak is unfortunate and is also wrong. All know that. But in the systsem due to enimity in the Department or revenge from the underworld, as Days said he had to undergo a phase in the service beyond his control.

    Being a Police officer it is tough life encountering innocent as well as criminals every day. But India being a republic governed by people of the country has constitution comprising judiciary and the elected governance. It is natural that every person want to rule the other. In this process the less intelligent get trapped and punished. For this purpose to enforce rules of the nation on its citizens the Police force is deployed. It is to bring the people on track.

    There is judiciary to punish the wrong doers. Though justice delayed is justice denied, it is unfortunate to punish an innocent. Killing people is not like killing mosquitoes. Everybody should be given opportunity to convey innocence and time to correct. In this prospect dear sir I object your encounters and please sir be sure before your next shot. Also it is bad to learn that you had to spend days in prison. Such things should not have taken place. What is the meaning of convicting the innocent and punishing? As you are from nearby I am proud of your acts but please confirm your limits and do accordingly for the betterment of you, us and the whole nation. Because the dead can't speak truth or lies.

    Its funny to know so many people congratulting him on reinstatement with out any charge sheet and trial. As fs as i know all encounter specialists have a cupboard full of skeleton. The lure for money is more when one is involved in clandestine operations with little proof and no judicial scrutiny of their work. Only the dead would know whether they innocent or eliminated elsewhere and later d died in encounter. Money can be made in both the ways by tipping off rival gangsters about presence of their enemies in a particualr area by disclosing their hideouts. Entire encounter team has earned the wrath of police and public. Roys giving clean chit to him is surprising and premature. Anyway Nayak being kannadiga we have to support him.

    Daya Nayak (Dayanada Nayak) is a jewel of Mangalore’s throne, his life and his success is nothing less than a block buster movie. As I hail from his native place I had an opportunity to have a close look at this entire issue and how whole village stood up with him. Daya’s mistake was he had a noble cause he wanted a fully equipped school to his village where nobody can imagine an ordinary new school. For school not only him everybody did contribution some by money some by volunteering. I still remember the day before inauguration of school we were working there till 3 am it was like a festival for us some thing new some thing unique and some thing we cant imagine on our wildest dream. There is no doubt that a strong conspiracy ran behind this entire issue, some people was jealous that “after all a boy who was a waiter” became talk of the town some don’t wanted Daya to do more damage to their business so every body jumped into it to prove that he is a culprit its another thing that no one succeeded and truth prevails. I said strong conspiracy because it’s a country where there is a scam every day may be its fodder scam, harshad mehtha scam or the father of all scams Telgi scam no case got hype like this one, where a innocent man picturised as culprit and no cases was in news as long as this. As a Yenneholean I want to say to Daya is we were with you we are with you and we will with you no matter what will happen. You are our hero and you will forever

    Dear Daya, Have you heard the expression that a kite (gali pata) cannot fly unless there is breeze against it. Stronger the breeze higher it flies. So too is your case - your history. You were falsely accused - cases were filed against you and all attempts were made to bring your image down. However you have come out clean and preserved your name and the name of your family. I do not know you but am convinced that you are a fine officer. Are you from Dakshina Kannada?. I wish I have your phone number as I would indeed like to talk with you. Just for your information I have a number of friends in The Law Enforcement Department including former D.G.P's present I.G.P's and several S.P.'s May you continue to do well and remember that success is measured by your actions.
