Mangalore, Sep 29: Christian community has urged honourable Justice Somashekara Commission of Enquiry, Bangalore to recommend to the state government to direct the deputy commissioner or such other officials to make proper enquiry into the church attacks and disburse the compensation as per the guidelines in the Motor vehicles Act and Workmen’s compensation Act.
In a submission made by the advocate M P Noronha on behalf of the Christian community suggesting brief points for inclusion in the report in respect of the interim report to be submitted to the government by the commission, it is urged that compensation has to be granted to the wounded or to the person whose property is damaged citing that the Kerala High court in the similar circumstances as that of Karnataka’s case held that state is primary liable to pay the compensation to the injured or victim of the loss of property irrespective of the fact whether there is negligence or not. This apart demand for establishment of secular bureau of investigation by the government which shall solely collect information regarding any acts of commission or omission calculated to create communal disharmony and report to the police and the government from time to time for heir action and peace committee which has got statutory powers shall be established in the state level, district level and each police station level with committee members being the ones suggested by religious heads and particular committee with no government intervention among others have been mentioned as brief points that needs to be included in the interim report.
The community has also urged that interim report cannot be submitted on the points referred on the following aspects namely, whether the incidents reported were attack on place of worship or not or they are stray incident, with regard to passing of any new legislation since inquiry is not completed and whether there is failure of the district administration cannot be given unless inquiry is concluded. However prima-facie failure of the district administration and the intelligence as borne out from video records, photographs and lot of evidence placed by the Christian Memorialists could be looked into and interim measures could be suggested to prevent police atrocities in future.
