Goa: High Court dismisses petition seeking admission to MBBS at GMC

Panaji, Sep 24: Petition filed by two students seeking admission in general category into the first-year degree course at Goa Medical College’s MBBS course for the academic year 2019-20 was dismissed by the High court of Bombay at Goa.

As reported in TOI, the two petitioners who were ranked 103 and 104 in the merit list declared that they did not secure admission into the course after three candidates who were ranked 79, 84 and 93 preferred to be admitted in the general category instead of under the Economically Weaker Section (EWS) quota.

Justice Mahesh Sonak and Nutan Sardessai who presided over the bench, noted that the three students who were granted admissions are 'more meritorious' than the two aggrieved petitioners in the general category itself and stated that the Supreme Court has clearly stated that candidates who are eligible to be considered under both general and reserved category must be admitted through general category if their merit positions so permit.

The court stated 'Such candidates cannot be forced to take admission only for reserved category against their wishes.”
