Mangaluru: State govt should bring stay on new Motor Vehicle Act - U T Khader

Mangaluru, Sep 11: MLA U T Khader said, “State government needs to bring a stay on the new Motor Vehicle Act for 6 months and frame new rules into the Act.”

Addressing media here on Tuesday, September 10, Khader said," Since the enforcement of new Motor Vehicle Act, it is creating lot of trouble and harassment to the common man. Paying hefty fines is not a right solution to bring discipline in traffic. Government is treating the citizens as their enemy by introducing hefty fines. When economic condition is pathetic, how can we expect a common man to pay hefty penalties? Before coming into power, government claimed to have war with Pakistan to stop terrorism. But now by bringing in such laws, government has called for a war with their own citizens.”

He also said, "The law states that if a minor is caught riding/driving, he will be fined Rs 25,000 and three years jail for his parents. At least there should be some awareness about this rule. If a person pays Rs 25,000, he will look into ways into recovering Rs 25,000. There is possibility that this will lead to more crimes and facilitate corruption.”

He further said, "Central government needs to re-think the Act and state government should bring stay on the Act for 6 months and re-frame the rules. As Central government is framing the Act, state government needs to frame the rules to be included in the Act. We need to appreciate Goa chief minister for his move with regard to implementing the Act in Goa.”

"I want to ask the department, what were the issues when the penalty was just Rs 100? Why did the department not show much interest while collecting low fines? Today a lot of interest in shown to collect hefty fines,” said Khader.

With regard to Sanjeev Matandoor’s statement, U T Khader said," When an official is working with sincerity, he should be encouraged. Instead, the statements delivered by Ananth Kumar Hegde, Umanath Kotian and Sanjeev Matandoor against former deputy commissioner are shocking. They have termed him as naxalite and anti-national. Deputy commissioner Sasikanth Senthil has put forth his opinion behind his resignation. MLA's are proving deputy commissioner’s opinion is valid by delivering such statements.”

With regard to Nalin’s statement on Siddaramaiah behind DK Shivakumar’s arrest, Khader said," Being in responsible position, this is cheap politics. People from other districts term Nalin as joker. It is shameful that a person of our district is called a joker in other districts.”

    Introduction of fines is absolutely fine...However,it would good if fines for the first month are waived untill people will come to terms of this new or revised fines.

    As long as you don/t break the law, why should you worry about the fine even if it is Rs.1 lakh? Drink and drive is a very serious offence in the United States. In some States, the offender stays in jail for at least 7 days. Then you hire a lawyer who charges at least $3000 (Rs.2 lakhs). They judge will put you on probation for 6 months with the condition of installing breath analyzer in your car at your own cost. There is a monitoring agency which charges you monthly fee for monitoring the analyzer and submitting the report to the court. Every time you sit in the car you have to blow into the analyzer otherwise your car will not start. Even if you are sober, it takes 10 minutes to start your car. There are chances that you will lose your job. You will have to take classes as ordered by the judge. Besides, this crime stays on your record for life. Every job applicant is screened for DUI. Ubar is a blessing for alcoholics.

    You are talking about Rs.10,000 fine for DUI? That is peanuts. In the USA it costs you at least Rs.5 lakhs. Boda Sheera? This is only the reason all drivers are self-disciplined and respectful to others. When it hits to your pocket, it hits hard on you. Modi's visit to USA is paying off.

    The flaw in your argument is comparison of India with USA. DONT COMPARE. The stringent laws would work if in INDIA their is NO CORRUPTION. In USA you cannot bribe a police officer who catches you for Drunk driving as they have Bodycams mounted on them. In India instead of paying 25,000 Rupees police will settle for 5,000 Rupees as a bribe. So if you really want to do comparison with USA bring the same reforms in police and make it corruption free as with other developed countries.

    Different people aired their opinions,views in this column,I appreciate it.I am not against the new traffic law to collect from the traffic violators,offenders.In order to educate traffic rule violators ,obviously one has to be punished mercilessly subject to the severity of the offence.But collecting hefty fines like the new rule what is there in the current scenario is unacceptable.A reasonable fines should be collect.Increasing double,triple the times of what is existing at present is really heart wrenching,unethical and which will not serve the prupose.On the contrary,it will create a more room for corruption,stealing and robbery.
    Besides before implementing new rule,the concerned department should have studies pro and cons of the consequences and created public awareness in depth.When the facilities like road condition,parking lots,bus bays, are inadequate,collecting hefty fines is not correct.There should be some leniency.Department,traffic police should be more strict about not wearing uniforms,badge,seat belt,helmet, reckless driving ,driving without proper documents,driving before attaining eighteen years and consuming while driving etc.Vehicle owners,drivers should know about all these things.There is a hue and cry from all the quarters for collecting huge fines.Which is not proper.This is my view.Present system of collecting hefty fines should be abolished by the state and central government.Provide proper road.

    Common people in this city have been the target of real estate mafia who has illegally acquired our parking space for shops and office space ones the building completion certificate is issued. I urge the concerned department to first act upon clearing these space which is our rights and then act on towing vehicles and implementing these huge fines. There are nearly 60-70 buildings in and out of hampankatta area who's parking has been used for illegal shop and office license.

    It is not about who pockets the money, It is about respecting the law,
    By this new law people will start learning the rules and regulations , will make everyone drive safely, will make everyone understand that driving is a pleasure , not stressful as it is now, less accidents, less widows, less orphans.
    I am not a fan of Modi , but I believe we need this new MV law for this country, and should be implemented and followed strictly.

    For those Blind Bhakhths who want to compare the present traffic fines to Dubai, please be so kind enough to compare our Indian roads to Dubai roads as well.

    I don't complain about the fines. But before that let Govt maintain good roads.

    Why should we pay fines in Dubai or Europe Standards for roads of Indian standard. Pls follow the same standard for both roads and fines. then its fair enough.

    Here Govt has gone bankrupt and to save their face Govt is looting money from RBI and through Traffic fines from common citizen.

    I do agree with your comment. Here govt just trying to implement after our PM visiting foreign countries, but not seeing the system there

    Before implementing make the infrastructure proper. Also in india first of all people dont follow proper driving rules and descipline. Reason is they are not taught or evavluated during giving license. Just they say putting 1st gear movment. When all this is not made strict how can u expect people to follow rules

    U r crying for 1000-2000 fine here, please look at dubai, there drivers are getting like Dhs 1200-1400 salary per month, in case if 1 rader caught for speeding car its Dhs 600 fine which is half salary, that the reason every one drive with more care...

    If they reduced to Dhs 5 fine, then every one will break the rule....

    Because of heavy fine, every one drive with more and more care.......

    UAE got independence in 1970's and look where they are and due to this mentality where we are even we got independence 3 decade prior to them

    This is India, not dubai, people are struggling to earn few hundreds daily, open your eyes and see the road conditions and compare to dubai, yes fine is required but there must be limit who can afford it.
    why you ppl are shouting one nation one rule, why there is no rule for police ppl and politicians , how many crore money has collected by police and how much is promptly gone to govt accounts.

    as i know in Udupi no one is unemployed, even the coolie is earning 700 Rs per day.
    Secondly, "people are struggling to earn few hundreds daily" dont own vehicle, so this law will not make any harm to them.
    even if they own a vehicle, does govt force them to violate law to pay fine??? no right? why u violate law so that u pay fine which is burden for you???????????

    Please note that govt is not forcing any one to drunk and drive, or to drive with out licence, or helmet or seat belt.

    Now dont tell people dnt have money to buy helmet due to global economy, if u have money to buy 70000 worth bike and alteration for 10000 more, please keep money to buy a helmet worth of 300-400 Rs.

    Dear Af, Please understand difference between Penalty for violating law and Haftha......
    There is fine for cow theft too... dnt theft cow no need to pay fine, stop blaming govt for each and everything

    Two months ago, I went to Vidhana Saudha. Could not get parking space. Then, took my car behind(near the railway station) and parked there. But due to space constraint and as there was no other option known that time, I had to park in a haphazard way(little bit obstruction to traffic). When I came back to take my vehicle, the cop was waiting for me. I got scared of expected penalty. Said sorry. He did not agree. He cut the challan. I thought that mera band baj gaya. When I saw the amount on it, it was Rs.100/-.

    If this much penalty only is levied, I will park wrongly every day and anywhere.

    Now those who oppose this law, please tell me, heavy penalty is good or bad. (Please note that I am a very law abiding citizen and last person to break the traffic rules).

    My relative came to visit Mangalore, and received 6 parking tickets in one week. When we informed her about the parking tickets .
    Her reply was -Oh ! Rs 100 per parking ticket? much cheaper than parking in USA. I like Mangalore, I can park wherever I want.

    These sudden whooping increase in times will be detrimental especially to utility vehicle and middle class owners especially in a very recessionary time, and will lead to suicides and crimes as opined by him!

    BTW, This opinion is being spoken across the country, not only by Khader!!

    Dear UT Khadar,

    I have very respect for you. I believe you are one of the rarest sensible politician of our state. But i don't expect this type of comments on the traffic fine issues. You know that, India is famous for reckless driving, drunk and drive, hit and run, traffic obstruction, road rage etc. Indian drivers are very bad drivers hence Indian drivers with more than 10 ,1 years of experience don't able to pass GCC driving test.So this is time to bring the drivers in discipline. Your comments about recession also not fair, you have to encourage people to take more and more public transport rather riding their own vehicles. The time has already crossed to implement very tight road and traffic rules and you like politician should support. It is my humble prayer don't mix politics in development works and security issues please.

    indirectly corruption will come down due to this law,

    Before fine for not wearing seat belt was 200, and people use to give 100 to police and escape.

    Now fine increased to 2000 and off course police will ask u for 1000 to escape.

    so people will wear seat belt for not paying 1000 fine.

    automatically while it was 100 illegal fine every one was okay with it, but now illegal penalty also increased to 1000 so every one will follow rules, no one have to pay bribe to police.

    Rules followed same time corruption reduced, and most importantly, why to break law to pay bribe to police????????????????

    Like Gujarat, state government can chose to reduce quantum of fine for select traffic offenses.
    I personally have lot of respect for UT Khader. But on this one, it is a wrong foot forward.
    The heights of shamelessness we observed on roads by 2 wheelers, autowalas and cab drivers here in Bangalore is next to none. These people think, that not following rules is the way of life and they even argue that they are right.
    Those who are protesting, if their protest is about wrong interpretation of rules and unfair implementation of fine, then I agree, that common man will face hardship getting it reversed through court etc.
    However, something needs to be done about errant drivers whose single point agenda on road is "driving by blocking others and delaying everyone behind" by not following rules.
    Wearing helmet is compulsory as average speed of bike has gone up over the years and number of cars and large vehicles on the same road has also increased.

    Penalizing traffic rule violators is perfectly alright. But the Penalty Fee should be reasonable and not exorbitant.

    The current Fines are more like a systemic loot by the BJP led government to fill its coffers.

    what is reasonable amount, also why u failed since 70 year to reduce accident?
    for your knowledge since 1939 (British era) there is Rs. 8.5 (Eight Rupee and 50 paise) fine for driving in Lungi(not wearing pant) , and every one violating law for more than 80 year (even who ruled in this time also dont know),

    Law is not amended since 1939 and now its increased to Rs 2000. even i came to know that such law is there in Indian Motor Act.

    even if they reduced to 1Rs for drunk and drive, many people will tell why 1 Rs? why not 50 Paise....

    dnt break law, no need to pay any fine....

    thats more more reasonable.....

    Even i was driving in opposite direction just to avoid 3 KM driving to take U turn, because fine was 150 Rs even if i was caught, But now i dnt take such risk because fine is 3000 Rs....

    in my openion even if they double the traffic fine also fine, it will decrease accident....

    Why be in a situation to pay fine in first place? It is easier to follow the rules which you are supposed to know if you have legally got a driving license . Politicians should make statements asking public to follow the rules rather than asking to reduce the fines. Fines were last fixed in 1988 and they had to be proportionally increased, otherwise people will keep taking chance of not getting caught and break the rules.
    If one person never breaks rules and respects other drivers on road, that person deserves the same respect from the other drivers too.

    Govt further amend rules

    1.Hit and Run - Rs. 1 lac plus 3 month Jail.
    2.Drink and drive - Rs.50000.00 Plus 3 month Jail
    3.Drink and drive with death of innocent pedestrians - Penalty to driver Rs.500,000.00 per person PLUS 3 Years Jail and permanent cancellation of License.
    3.Honking & noise pollution ( Near Schools / Hospitals/ home for the aged ) - Aed.10000.00

    By the way Khader Bai , please check the GCC Rules before you giving statement to Press.

    Vehicles, in the hands of monkeys, can kill. Speeding vehicles kill many on our roads everyday.

    According to the Government data, in 2018, there were 149,000 deaths in India due to road accidents. And there must be at least 300,000 people getting serious injuries every year.

    One way to cut down on these numbers is by controlling the road-monkeys using heavy fines.

    So, every state must implement the new Motor Vehicles Act - without diluting it.

    Only then there is some hope of cutting down the rate of accidents, fatalities and serious injuries.

    We should follow the Gujarat model. High fines for danger to others e.g drunken driving, dangerous driving fake number plates etc and reasonable fines for danger to self eg helmet seatbelt. Also as originals get spoiled due to rain, perspiration and digilocker and mparivahan have flaws(read reviews on play store,) also the problem of internet connectivity, notary certified copies of originals should be allowed.Or as an alternative parivahan and saarthi websites should have all updated facts and the onus be on the police to verify them,from their police app.

    ಮೊನ್ನೆ ನಡೆದ ಘಟನೆ. ವೇಗವಾಗಿ ಬಂದ ಬಸ್ ನನ್ನ ಕಾರಿಗೆ ಢಿಕ್ಕಿ ಹೊಡೆದು, ನನ್ನ ಕಾರಿಗೆ ತುಂಬಾ ಹಾನಿಯಾಗಿತ್ತು. ಬಸ್ಸಿನವ ವಿಮಾನ ದಂತೆ ಬಸ್ ಚಲಸಿತಿದ್ದ . ಪೋಲಿಸ್ ಸ್ಟೇಷನ್ ಗೆ ಹೋದಾಗ ಅಲ್ಲಿ ಅವನಿಗೆ 500 ದಂಡ ಕಟ್ಟಲು ಹೇಳಿದರು. ನಿರ್ಲಕ್ಷ್ಯ ಚಾಲನೆಗೆ 500 ದಂಡ. ನಾನು ಆಲೋಚಿಸುತಿದ್ದೆ ಸಣ್ಣ ದಂಡ ಆದ ಕಾರಣ ಬಸ್ಸಿನವನಿಗೆ ಸಣ್ಣ ಕಾರಿನವ್ರು ಕಾಣುವುದಿಲ್ಲ. ಇನ್ನು ಅಪಘಾತ ಕಮ್ಮಿ ಆಗುತ್ತದೆ.

    Penalizing traffic rule violators is acceptable. But, Govt should have started with small penalty amount and increased it month by month.

    already people of Gujju state of chaiwala reduced the fines. Rules are applicable to only rest of the country, especially south India.
    It is high time people should revolt against senseless laws. Without providing proper road facilities just increasing the fines is not right.

    after reading UTK statement "If a person pays Rs 25,000, he will look into ways into recovering Rs 25,000. There is possibility that this will lead to more crimes and facilitate corruption." when i link this one to DKS and chiddu case i felt one thing,

    If govt recover looted money, they will look into ways into recover same money after releasing from jail,

    Hence as per UTK, either dont recover looted money from them or dnt release them from Jail. never give them opportunity to loot them again.

    I thought you will support this MVA . I am not sure why you are opposing. If there is a drive in mangalore for document verification of the vehicles. i am sure some of the stolen vehicles will be soon returned to the actual owner. You know it very well who are the thieves in mangalore. I am sorry but you shouldn't be opposing this move. I know for a fact that most of the vehicles are stolen and duplicate records being created. Please do not support such kind of activity to favor particular community .

    Tell me what is harassment to common man?? Wearing helmet is not harassment, as u can wear Topi, Helmet is necessary while driving 2 wheeler.
