Mangaluru, Aug 7: The sixth district and sessions court here, through an order passed on Tuesday August 6, sentenced two persons to seven years of rigorous imprisonment. They have been found guilty of murdering a friend during a quarrel that broke out between them.
The guilty have also been fined Rs 25,000 each.
The persons who have been ordered to undergo the said sentence are Jaeevan (37) and Dilesh (33), both from Taliparamba Mayil in Kannur district, Kerala. They had been accused of killing K C Sajesh from their village, who was their friend, on April 2, 2014 in the city.
Dilesh was working for Kerala State Electricity Supply Company. Jeevan, Dilesh and Sajesh were friends. The three had come here in a car from Kerala as there is ban on liquor consumption in that state. They had told their families that they were visiting the city to donate blood to a needy person. They hired a room in a lodge. On April 2, the three had a fight over money matters. The fight occurred when Sajesh asked Jeevan to pay back Rs 30,000 that was lent to the latter by the former, by borrowing the money from his aunt. After the fight gave rise to lot of noise and disturbances, the lodge management had asked them to vacate the room. They vacated the room at 7.30 pm on April 2.
Later, Jeevan and Dileshi killed Sajesh near a petrol bunk at Ujjody near Pumpwell here at about 11.30 pm the same day by hitting his head with an interlock. Both had fled to Kerala thereafter.
On the next day, the petrol bunk employees saw the lifeless body near their outlet and informed the police. Police personnel of the rural police station here, during the scrutiny, found identity card on the body. They conveyed information to relatives of the deceased at Taliparamba. The police registered the case on the basis of complaint made by Sajesh's sister. They succeeded in arresting the accused on April 24, 2014. The then police inspectors, Harish Kumar and Pramod Kumar investigated case, and Pramod Kumar filed charge sheet in the court.
The sixth additional district and sessions judge, Sayeedunnisa, who conducted the hearing, concluded that this is a culpable homicide not amounting to murder and handed down seven years of rigorous imprisonment and Rs 25,000 to both the accused. In case they fail to pay the tine, they have been ordered to undergo additional one year's imprisonment.
20 witnesses were examined in the case, and 41 exhibits were scrutinized. Evidences adduced by the staff of the lodge and aunt of Sajesh played major role in nailing the accused. Public prosecutor, Judith O M Crasta, had presented arguments on behalf of the government.
