Victory for Land Trades Builders - SC upholds licence of 'Solitaire' apartments

Mangaluru, Aug 3: Supreme Court of India in its judgment upheld the building licence given to Land Trades Builders & Developers’ prestigious residential project ‘Solitaire’ by Mangaluru City Corporation (MCC).

Aggrieved by the city corporation’s proposal for widening of one of the approach roads to Solitaire, some residents of the locality had approached the high court with a Public Interest Litigation (PIL) challenging the building licence given by MCC for Solitaire. After listening to the arguments of all parties, the high court had upheld the building licence given to Solitaire as legitimate and concurred with MCC’s decision to give the licence.



After that, the petitioners had appealed the high court order before the Supreme Court. Now in its order dated July 19, the Supreme Court too has dismissed the PIL and upheld the legality of building licence given by MCC for Solitaire. The Supreme Court has also directed the MCC to issue completion certificate for ‘Solitaire’ expeditiously in accordance with law. In the same order, the court has also vacated its status quo on road widening by MCC of the approach road to Solitaire. Accepting the advice of the judges to address the grievances of the petitioners, the city corporation has undertaken before the Supreme Court vide written affidavit to construct a retention wall for protecting the structures of three of the petitioners at the time of road widening. With this, all the legal hurdles with regard to road widening have been overcome.

“Solitaire is a prestigious project where we have tried to set a new benchmark for excellence. Litigation regarding this project was pending before the courts for a long time. Now we are glad that our building licence for Solitaire has been legally validated by the highest court in the land,” said K Shrinath Hebbar, proprietor of Land Trades. “I am grateful to our customers and associates who have reposed their complete faith in me during this period,” he said.

    I guess MCC should know the future plans at least 10 to 12 years in advance. Why they give permission first and struggle later? I do not see any fault in builder. He got permission and started the building process. You can not catch them high and dry after giving approval.

    My thoughts on the subject matter:

    What about on those who will loose part or all of their ancestral homes that they had been living in for decades?
    Will they be compensated per their wishes?
    If road widening was the issue, shouldn't the builder have widened the road first before starting the construction, or first construct the building and then widen the road?

    If would be nice to hear back on the above from the builders

    For we residents of solitaire this is a big relief after hearing so many rumors and propaganda regarding this PIL. Even banks used to scare us away when asked for loan. This is a big lesson to naysayers and rumor mongers.
