Panaji: 'Re-open case against Amit Shah after comments of SC judges'


Panaji, Jan 13 (IANS): The criminal case against BJP president Amit Shah should be re-opened in view of Friday's press conference by four senior Supreme Court judges, Goa Congress state president Shantaram Naik demanded on Saturday.

In a statement issued here, Naik also said, that the case related to the death of Special CBI judge Brijgopal Harkishan Loya should also be re-visited.

"The criminal case in which the national president of BJP, was one of the accused, should be re-opened in view of the press conference held by the four judges of the Supreme Court," Naik said.

"Similarly, case relating to the death of Brijgopal Harkishan Loya, Special CBI Investigation judge, in suspicious circumstances in Nagpur should be re-visited," he also said.

"If it is held that the procedure prescribed for the allotment of cases cannot be questioned in Parliament, then how is that cases decided by the Government, exercising its executive powers, are admitted by the Supreme Court," Naik asked, calling for a more transparent administrative mechanism within the apex court.

    Agree the case against Amit Shah must be reopened as it is of national importance and involves a very senior functionary of the ruling party. The Supreme Court in the past has suo moto taken up many public interest litigations and this is a fit case to be examined by the supreme court.

    SC Should reconsider its dismissal of appeal against Amit Shah’s discharge in Sohrabuddin Case.
    Citing interviews with Loya’s relatives, an investigative report by Niranjan Takle in the Caravan on Monday has pointed to glaring inconsistencies in the cardiac arrest story. These include:

    large variations in the precise time of his death
    the absence of any prior medical history suggesting the possibility of a heart attack
    why he was taken to hospital in an auto-rickshaw in the early hours of the day
    the mysterious signature on the post-mortem report by “maiyatacha chulatbhau”, or paternal cousin, when his family says there is no such person in the family,
    the wiping clean of all data from Loya’s phone before it was returned to the family
    the presence of blood on his clothes
    the role played by an “RSS activist” in telling Loya’s family about the location of his body, and delivering his phone, to the family
    Within 29 days of Loya’s death, a replacement judge ruled that Amit Shah had no case to answer and discharged him from the case before the trial had even started. The CBI, which is the prosecuting agency, never bothered to appeal Shah’s discharge – or the discharge of a number of the other accused in the case despite the fact that it had probed the Sohrabuddin fake encounter at the request of the Supreme Court.
    Although, the hospitals had concluded that Loya’s death was due to natural causes, a post-mortem was conducted on his body. However, no panchnama was prepared – as is normally done after a post-mortem nor was a medico-legal case filed.
    The signature of the ‘paternal cousin’ on the post-mortem is another mystery. “I do not have any brother or paternal cousin brother in Nagpur,” Loya’s father told Caravan. “Who signed on the report is another unanswered question.” As is the deletion of data from Loya’s phone.
    Former P. Sathasivam and Dipak Misra has collaborated with government and undermined the most respectable Judiciary institute.

    If 1984 Sikh massacre investigation & case can be opened by the CJI after 34 yrs. Than why not this case of amit Shah encounter case be investigated where the judge was found in mysterious circumstances.
