Udupi, Apr 20: Judge of the third additional civil court court here quashed a public interest litigation (PIL) filed by relatives of Abdulla Saheb and some members of the general public against transferring land on which women's and children's department of the district government hospital stands to private persons for the construction of multi specialty hospital. The petitioners contended that the government had violated the terms on which the said land was donated to it, in vesting its ownership to a third party. The original donor of the said land is stated to be the late Haji Abdulla Saheb.
Advocates for the petitioners and defendants placed their arguments and counter arguments before the court. Judge of the court, Ram Prashant V S, who heard the arguments, pronounced the order on Tuesday April 18.
The court observed that there are not enough evidences to prove that the land belonged to Haji Abdulla Saheb. It further said that the government had not violated any law or rules in entering into agreement with a third party for hospital construction there. Advocates said that the court dismissed the petition, duly observing that there are no proper grounds for continuing with the case.
The petitioners said that they never expected the case to go against them. "We had enough documents to prove our contentions. We bow before the order of the judge. We will appeal against this order in the senior division court. If necessary, we are also prepared to approach the high court," they clarified.
