Puttur, Mar 21: Dakshina Kannada district Consumers Grievances Redressal Forum has upheld the complaint that had accused an obstetrician and hospital staff of being negligent during delivery, and thus causing the deaths of the mother and the unborn baby. The forum has passed an order, instructing doctor of a hospital at Puttur, identified as Poorna C Rao, to pay compensation of Rs 17,43,440 to the aggrieved.

Swapna Rai, daughter of Kamalaksha Rai, resident of Alankaru Parari in Perabe village in the taluk, had been admitted into a hospital at Puttur at 9.30 pm on December 28, 2010. Swapna died on the night of December 29. The unborn baby too died in the womb. Kamalaksha Rai thereafter filed a complaint in the district consumers forum accusing the obstetrician and hospital staff of negligence, which he claimed, had accounted for the death of his daughter and her unborn child.

The obstetrician had recorded in the hospital record that Swapna Rai had died of a rare complication known as amniotic fluid embolism. However, postmortem report stated that she died due to acute lung defect. Rai said that no effort to save the pregnant woman was made and actual health complication which had caused the death had not been determined through specific processes. As per the rules of obstetrics science, the deceased woman, who suffered heart attack, should have been operated upon within four minutes to save the child, he said with which the forum too agreed.

The district consumers grievances redressal form, taking into account the above facts, concluded that this is a case of medical professional negligence. The compensation of Rs 17,43,440 has been ordered to be paid to the first son of the deceased and her father. The verdict was delivered by president of the forum, Vishweshwar Bhat D.

    My condolences to the bereaved Rai family, indeed no compensation can fill the loss. However, we must remember that the forum has given a judgement about an isolated incident where the aggrieved party has demanded justice. I know for sure that the concerned Dr Poorna Rao is a skilled obstetrician and has saved many other mothers and babies and she will sure appeal the decision. She has served in a small town where resources maybe limited and given her heart and soul to her profession. And it is wrong to paint her or the entire profession in bad light without knowing the circumstances of the particular case. If words were bullets by now it would have killed the doctor. So please allow doctors to work with security and maintain an atmosphere of trust and harmony. This kind of confrontational attitude is going to see both doctors and patients lose.

    4minutes!!!! Are u kidding me!!!! U expect pt to be shiftd into the ot ... anaesthesia to be induced in a nursing home, all in 4minutes!!!!!

    This case wudnt have a chance to stand if the courts had consulted reputed obgs for an opinion.

    The problem is that, people think the process of delivering babies is as easy as getting into the hosp, then delivery, then everybody goes home like one happy family....

    Certain sections are as risky where even the most experienced doctors sweat.

    Just because the hospitals charge high money, doesnt mean that doctors are cut throats and aftr ur money.... if u cant afford the money, plz go to wenlock...

    Its like u want the features of merc, but can afford the money of only a honda city.

    Avery hard verdict .They must have had a good lawyer.What about poor People who doesnt have enough Money to pay a lawyer even Patient has right?I dont understand one Thing.when Patient had lungdefect as Postmartum Report says,why it was not detected, previouslyand treated?otherside they say had amniotic embolism.which is right.As someone say they should have saved the child when she had cardiac Arrest,how should it function when Baby was already dead in Uterus ?Shoud the Baby or mother save first?mother should get treated first so that Baby gets Oxygen and mother too.it is a very dangerous Situation.The one cant understand it who doesnt deal with Situation.Hope the Money will help her People ,then it is fine.but no Money can get back their dear ones.Or the doctor goes to high court?

    The verdict is too harsh on the doctor. There was no negligence on her part. The baby died inutero. This was followed by cardiac arrest in the mother. There might have been excessive bleeding and coagulation failure. The available clinical data fits in with the diagnosis of amniotic fluid embolism. The first proved case of amniotic fluid embolism in India was reported by self in 1972. For some unknown reasons amniotic fluid embolism seems to occur more frequently in this part of India than elsewhere. The postmortem finding of a 'Defect in the lung' could not have been handled by the obstetrician . She would have attempted cardiac resuscitation by external cardiac massage. But she cannot be penalised for the fatal outcome.

    No effort has been made to treat the Lung defect? Very sad. Every effort shoudl have been made to treat the lung defect. Secondly the baby wasn't delivered when mother developed cardiac arrest. I feel overall there is severe degree of negligence here and the verdict was very right. These days Medicine or Healthcare has become an industry and there is no compassion in medical science As a result many people are dying because of inefficient care and treatment. Every effort must be made so that Medical treatment remains good and humane. Every human live is precious and it must be handled with utmost care. Physicians who handle human lives must understand that every life is precious and every effort must eb made to save human lives. Doctors must be very careful and treat every human being with utmost respect and care. Doctors must think beyond their income and serve the population. Doctors must not think fo money ut only service. Doctors must be ready to go villages and serve the needy population. I am sure the new generation who are now studying will understand the need for service in rural areas and go there and serve the needy population with service. Doctors must provide selfless service and help the needy population in our country. These days Doctors sometimes get beaten in their line of duty.I feel this happens mainly because of lack of compassion and communication among the Doctors. Though sometimes a violent patient party may attack doctors for no fault most times Doctors themselves are to blame for lack of communication. Doctors must communicate well and always explain the condition of patient to the bystanders. Sometimes nowadays I feel Medicine has become a business like thing with no regards for patients life. We must always discourage these tendency. Doctors must respect and treat each human life with dignity.     The root cause is the medical and dental councils of India which is corrupt to the core. In the past 5 years the corruption has been very obvious.People who have been a part of these councils have become millionaires.There is no scope in India for quality medical and dental practitioners in the near futures.We can expect a lot of such negligence from the doctors.God save my country!
