Mumbai, Dec 8 (mb): The Bombay High court on Friday asked the state government how does mere nudity amounts to obscenity?
The question, asked by division bench of Justices R M S Khandeparkar and Amjed Sayed, arose during the hearing of a case related to seizure of cigarette lighters and ball-pens, worth more than Rs five crore, by the Social Service branch of the Mumbai police.
The court has asked public prosecutor Satish Borulkar to file a reply in this regard by December 17. Borulkar argued that depiction of nudity without any purpose amounts to obscenity.
Social Service branch of Mumbai Police had recently seized nearly 9,26,000 cigarette lighters and roughly 36,000 ball-pens. The items project a nude woman's image in the same way as the slide projector.
The importer of the consignment from China, Shakeel Ahamed Mohmmed Yasin Siddhiqui, has moved the High Court against the seizure.
