Court to decide Mickky’s fate on Nov 26

Margao, Nov 3 (TOI): Margao chief judicial magistrate (CJM) Kalpana Gawas will pronounce her order on November 26 in connection with a criminal case filed against Nuvem MLA Francisco Xavier 'Mickky' Pacheco and Mathew Diniz of Kentucky shack, Colva, for alleged criminal intimidation and assaulting Gerald Fernandes, former general manager of Casino Treasures, Majorda, in 2009.

The court has to decide on whether to frame charges against the duo or to discharge them from the case.

Advocate Anacleto Viegas has sought that the case against the accused be dismissed on grounds that the chargesheet is illegal. Both the accused were present in the court on Monday.

On June 18, 2009, the Colva police had registered an FIR against Diniz and Pacheco under Sections 341, 352, 506 (ii) read with Section 34 of IPC on a complaint filed by Fernandes. Initially, the accused had an altercation with the casino gaming staff over the betting limits and rates. Subsequently, they allegedly assaulted Fernandes.
