Mangaluru: College principal accused of assaulting student, charges denied

Daijiworld Media Network - Mangaluru (DV)

Mangaluru, Jul 12: The principal of a college at Bajpe here has been accused of assaulting a student for coming late to class by a few minutes and abusing him.

Br Hector Pinto, principal of St Joseph's Junior College, Bajpe, allegedly assaulted Siddique, a student of second PU on Friday July 10, after which the latter was admitted to hospital with head and hand injuries. Siddique was discharged on Saturday July 11 night, sources said.

It is said that Siddique, who was fasting on account of Ramadan, had been to Friday prayers at the mosque and was late to class by a few minutes. Angered by this, Br Hector Pinto reportedly called him to his chamber and allegedly banged his head against the wall and the table which caused injuries. Siddique reportedly collapsed and was admitted to a private hospital.

Also, it is alleged that Br Hector told him not to go to the mosque for afternoon prayers and used derogatory words, and that he was harrasing the boy.

Sources said that Siddique comes from a poor family and had lost his father sometime ago.

It is also learnt that Br Hector visited the boy in the hospital along with other staff and apologized to him as well as to his family.

A case has been registered in Bajpe police station.

A meeting of the college management is scheduled to be held on Monday July 13 to discuss the issue, it is gathered.

Allegations denied

Speaking to daijiworld, Br Hector Pinto denied the allegation that the student was told not to attend prayers in the mosque. "We are allowing everyone to pray, especially during Ramadan. We have even changed our time-table to suit their prayer times, and we give them 20 minutes to offer prayers," he said.

"Many Muslim boys go to the mosque to offer prayers in the afternoon. On Thursday, a few boys came late to the class and they were warned. But on Friday, this boy (Siddique) and a few others came late again, while most other boys came on time. It is only a few boys that are creating this problem," he added.

He also denied allegations of harassment and assault. "I have not harassed the boy. He has been caught by teachers now and then doing some mischief or the other. Once he was caught carrying a mobile phone to class, after which he was suspended as per rules. On Friday when he came late to class, I took him to task and smacked his back twice, but it was not assault as alleged. It was nothing serious," he said.

Protest

Meanwhile, Campus Front of India (CFI) protested againt the principal on Saturday in front of St Joseph's Junior College and demanded action in the matter.

CFI district president Irshad Bajpe said, "The principal is curbing the religious freedom of the students by indulging in such behaviour. We must all join hands to provide justice to the student."

CFI in a press release stated that after the protest, the principal called CFI members and other local leaders to his chamber and apologized for the incident and even offered to resign. He also said that he would bear the hospital expenses of the student and tender a public apology, said CFI, after which the protest was withdrawn.

Time sense, discipline are some of the attributes that are taught in the school. It is slowly dying in many youngsters and that is also partly the reason behind the decline in quality of education. These days anything and everything gets limelight as soon as you paint communal color. Bring Media to the mix and you have it...
Let us salute our teachers and support them, rather than pull them with flimsy reason. By the way, getting admitted to Hospital it appears now is a mandatory practice before a complaint is filed in the police station.

It is unfortunate that Siddique lost his father. May be this is the very reason he is disturbed and misbehaving in school. My thoughts are with this poor kid.
School is a child’s second home where kids acquire the knowledge and skills which will enable them to start their future. I’m sure most parents beat their kids when they do something wrong. The very purpose of beating a child is to correct them and there is nothing wrong in doing so. I have taken a lot of beatings myself from my teachers and today, when I look back, I am thankful I was corrected.
It is a pity that people are blowing the matter out of proportion and looking at it from a religious perspective. I think these people have forgotten that sparing a rod means spoiling the child.
I personally know Br. Hector and I am proud to be his relative. His parents and siblings are lovely people. He is a very humble, broad minded person that always helps anyone in need. He is a sports enthusiast and encourages kids to actively participate in extracurricular activities. I know his students mean a lot to him and he is very passionate about their personality development. Although he has never taught me, I know his students speak highly about him.
Visiting the boy in hospital and asking for forgiveness speaks of his divinity!

    Dear DW Readers,

After having read the article and some of the comments to the article , I have mixed feelings to the issue.

Many of the readers do not read the article properly and make sweeping statements. Now, the issue could be that they were not fortunate to have received proper education for whatever reasons.

Now, if the Principal had indeed hit the student, whether the student was fasting or not, is a mistake. It is clearly reported that the Principal has apologized to the student which shows humility by the Principal.

However, some of the mischief mongers who know nothing but create communal discord blindly pass comments/statements in order to offend one's religion.

If people have issues with the way an institution functions (in this case, Christian) please send your children to schools/colleges run by your own religious figures. Why bother sending them to Christian Institutions and expect royal treatment from Management? The college/school has to run on certain policies and guidelines which need not be suitable for people of some mentalities.

99% of the population of South India can vouch for the contribution of Christians in all spheres of our day to day life. Education, Healthcare, Old Age Homes,Orphanages Etc speak volumes of this community's service to the region. Students (across religions) who have been alumni of colleges like St . Aloysius, Milagres, Agnes, Marys, Joesph's etc etc have been successful to not only progress financially but to learn values from these colleges/schools. Of course, there are exceptions, who will not learn no matter where you enroll them for schooling/education.

please all festival season as holydays, including one full month of ramzan full week of deepavali, ten days of dasara, one month for new year, etc.

at any cost discipline in students is not important. teachers should follow the instructions of students & parents.

every college should start PFI & ABVP branches in every class, so that students ca affiliate either this way or that way, and in future they will be well organised to participate in rally & protests in front of DC office during for & against burning issues of dakshina kannada.

for the purpose of prayer, shift the all the colleges to temple, mosque & churches OR shift all temples, mosques & churches to schools. if time permits read some books in between all extra curricular activities.

anyhow there will not be any job opportunities in our district in future.. all banks / educational institutions/hospitals/hotels/malls/real estates/ gulf opportunities have reached saturation.

nobody is interested /skilled in agriculture/horticulture/dairy/fishing / other traditional jobs.

so good training in attending political rallys/ protests/catching cattle theft/ fighting for free bhagyas/ protest for upliftment of poor / shoshitahru/etc ..

go ahead my beloved brothers of all caste & party & organisations.... our district will have bright future...

"guru devo bhava"... TODAY I AM IN GOOD JOB IN A MULTINATIONAL COMPANY..... because of the strict discipline of my teachers... fortunately PFI & ABVP were not there during my school days !!!

nothing much to comment. it is high time for the elders of all communities to take the younger generation of our district to take them in proper way of life...

    thank you daiji...

I was a student of this institute from 1973 to 1978.During the said period also the Principal had struggled so much to develop this college and the building, compound, etc was developed and constucted by the principal of that time.I being a student alongwith some students had supported the so called principal to the extent possible.
Br.Hector is so humble and courteous that he visited the student and apologised to the parents.I salute you Br.Hector.You are the true gentleman. We need people like you to carry on the good work of this Institute so that our future generation will be benefitted from this prestigeous educational and extra curricular activities.Somany children have benefitted from the good service of the management.Try to imagine how difficult would have been for our children/future generation to continue education without this institute.Fr.Bernard is no more today but still i remember the hard work done by him inspite of all problems and troubles.

now some people/organisation may demand to close the college. their main work is protest on the road. everyone knows that there are some religious festivals are more important in every community. celebrating the festival is individuals wish. Central/state govt was announced holiday for important religious festivals of all the community. except these holidays, anyone want to do the prayers/pooja on non-holiday working hour or class time, then they have to take a leave & perform the same. here the college has done the mistake by adjusting their timetable to allowing the students to perform their religious activity. the other religion students may request the institution to adjust the timetable during their festival/religious celebrations/rites & it may affect the communal harmony in the campus. to avoid all this confusion the educational institutions should frame the rules & regulations as per law. during the admission time the institution should inform all the students & their parent about the rules & should get the acceptance of them to adhere the rules framed by the institution. and also there should be a provision in the rules that any one who disobey the institutions guidelines they will suspended. if the students are agree to the rules then only can join to that institution else they may opt other institution.

Now a days, it is habit of blaming schools and colleges for religious issues. If any one is very much interested about religious Hindu may go to Ashram, Muslim may go to Madrasa, Christian may go to church.. Why they are wasting time in school and disturbing others who are not bothered about religious. Main intention is to bring bad name to school and to start their own religious school in locality.

Education institution should stick on their timeliness & guidelines. if they want to follow the religious time line how they can succeed. in that case they need to allow muslim students to allow to go to prayer everyday. again hindu students want to go to temple everyday. Christian student want to go to church. Sikh/jain.... for every religious student how they can accommodate & allow. and then when & how they will conduct the class & complete the subject. students comes to school/college for studying not for other work & they should follow the institutions rules & regulation else they need not to come to college. in education institution there should be any scope for religious activity.

I studied in St Aloysius school, We were taught to be disciplined by father and Brother of college, We are Non Christians but since that day they corrected us by Hitting us today we are in a good position, we had exams during our festival its so strange these PFI or uncultured people to interfere in the college issues, if they have problem with the management why they wanna join these Jesuit or Highly Disciplined colleges they can go to school which suits their profile. we are in democratic country here every one has a right to follow his religion but it should not hamper the crowd, its so annoying people cant respect the law of education system tomorrow when they grow bid defiantly they will not follow the law of our country no wonder, Its purely the mistake of the student to come to college late and I guess he can join acting school will have good scope, and some of these Cheddiless Non Bahkths are fit to create PIECE in the system.

I am hundred percent sure that this issue is blown out of proportion with exaggeration. I think the Brother has reprimanded the student for being late but I don't think he will assault any student the way it is claimed here. My nephew who was the pupil in that school for 10 years says, he has not seen the Brother touch or raise his hand anyone. The student in question must have some personal grudge on this brother and has concocted a story to falsely accuse the brother. If his head was banged against the wall and desk then why is he hiding is head in the photo? Why is he not showing the injury? Doesn't this fact say that "Dal mein kuch kala hai? PFI is infamous for violent behaviour. I hope & pray that they don't chop off the hands of the brother like they did to one professor in kerala.

Really i feel sorry for all those who protest in this prestigious campus of St. Josephs for a simple and petty issue. My association with this institution is most memorable. Even though i didn't studied in this school, games which i played in the ground most memorable ones.
During summer and October holidays we used to play football in the college ground. Br.Harrison, Br. Wilfred, Br. Pinto, Br. Almeida, Br. Avinash, Br. Sabino ,Br.Hector, Br. Theo , Thattil sir and also others used to join us. After the game we used to enter near by costam's coconut farm and used to pluck tender coconut to drink. Even though it is crime during those days it was like a fun loving game. One fine day owner of the farm came to know about this and he complained the incident to Brother Hector. Brother called us and advised us not to repeat this in future any more. We came to know that this crime. He didn't complained to baab (my dad).

In the recent past, we have all noticed that there are so many complaints by students against their teachers. Most of them have been false. Being a parent, all of us recognise the need to discipline their children. Most of us go to the teachers and tell them the child is not listening to us, plz advise him. Parent is the first teacher. when a parent refuses to acknowledge the fact that his child needs to be disciplined, he can expect the child to become a negative element of the society. Spare the rod and spoil the child is an age old truth. In the present case, I do not believe the allegations against Br. Hector. I am sure that he did try to discipline the child. but the fact that he hit the child's head on the table and against the wall. I don't think so. In these present days, when children commit suicide thinking they would get less marks in their exams, when students frame their teachers on cases of sexual molestation, anything is possible from a child. All the comments till date show that the Br. was a disciplinarian and a good teacher. The appreciation by the students on this page should testify that. Plz dont make it a matter of religion. Let the student, his family and the Principal with the school board handle it.

Sad story. Sad not only because the principal hit an orphan, fasting boy for a silly reason, but also because the incident has exhibited what type of mentality the principal has.Principal of a college plays an important role in molding the personality of a student - he should be compassionate, accommodating and supportive though he needs to adhere to the college rules & regulations. The modern approach is to abolish corporal punishments in schools, here we see an extreme form of corporal punishment. The principal would have apologized but his sick mentality is a grave concern. Needs to keep an eye on him.

    Dear Muslim Brothern
I would urge that since a small disciplinary action has blown up to a great extent against a selfless good educationists who has been appreciated for his good thoughts for many years by the students who are now holding good positions in the country and abroad
Kindly meet the Principal with a note of appreciation for whatever pain he has taken to correct your child. He could have left this student go without correcting like any other municipal school But with his concern to correct the student which will help him to become a good citizen the Principal took pain in correcting this indisciplined student.
Why are we not sending our children to government run or municipal run school though we get all eatables books free because we need to be disciplined in our life.
Please think over the fact and do not allow the evil thoughts of some youngsters who are bekaar and blow the issue.

Before making my comments to the media, I happened to go through comments made by people of all denominations and most of them are of the opinion that St. Joseph's school is well known for imparting quality education to young boys irrespective of caste and creed. I too am aware of the fact that Irish Christian brothers have provided yeomen service to people for decades all over India.

In view of the circumstances I appeal to the aggrieved student's relatives and friends to resolve this situation for the benefit of all.

There are certain rules & regulations for the educational institutions. These are not the religious places, you go to school / college to learn & get educated. But the strange thing is, there are certain people who try to disturb the atmosphere by using religion.
The school principal is right here to teach the discipline, if the boy can't follow the discipline, he can leave this college.

    Well mistakes happen.
And Br. Hector Is deeply sorry for that. And he is also giving a resignation based on moral grounds.
Well folks, Action speak louder than words. You guys know Br Hector very well than anyone else. So I request all you guys out there to kindly show your support and be there at Joseph's on Monday at 10am.

Rules for the educational institute is common to all the people, community etc. If we gave permission to the students to coming late or going early from the school or college for their festival or other religious issues there is no discipline in the college. Parents have to think in this direction and do your all the religious activities before or after the college hours.

......I might be wrong in this view, but Br Hector stated lot of my Muslim friends around have vouched for me and sent their solidarity messages from all over the world and in facebook, but I don’t see them openly supporting Br Hector here. May be religious obligations and identity among the community is much more important that standing for right and against wrong. This is nothing but a case of religious EGO support by jobless radical groups and gangs , influence by company of bad thugs who want to show their muscle power by making a respected principle come to his knees begging for apology to satisfy their false pride. The respect what our generation had for the teachers is no more there unfortunately.
Even though legally wrong , punishment to some extent should allowed and supported by parents if they want to discipline their kids, and of course tortures/grudge punishments by teachers or parents should be condemned and if it goes out of hand should be booked under law accordingly. But getting influenced by a bad elements of the society and flexing muscle against the Guru who is guiding you in life will only lead to next set of radical generations.

What will they contribute to society if allowed like this undisciplined ? This is not hard to believe the Ego and band company baggage these out of control buys nowadays carry along with, it would not take them much time to back answer. For sure Br dint lay his hand on him for "just being late". At least they are allowing them to go and pray, but these rowdy out of control boys are misusing it.

Religious radicals have brought these politics to highschool, college and PUC levels, only primary and Kindergarten is left out.

I know Br Hector personnely nor does he knows me. But being a localite of Bajpe in 90’s , I know about Br Hector and his discipline and the way primary students used to have this kind of fear of discipline in St Josephs High. This was required also. Even though I got a seat in St Josephs I had to leave an move towards Mlore and continue my studies there.
This case, by reading the news and acquisitions by the students and this fundo radical group, it’s a open and shut case of pure false made-up allegations. I won’t be surprised that as Br Stated in his FB page that he did hit him, but it may be a slap (I know legally this is not allowed, but you got to discipline brats in a controlled manner) or using a cane or a blackboard scale, but banging head against the wall is totally unbelievable. Am sure all the current & Ex-Josephites would support Br Hector in this situation of pure religion politics. He is for sure not a man who would do something like this. This is just like how you misuse SCST act, dowry act etc to settle scores.

When i were in Primary, my grandfather used to embarrass me in front of the whole class by loudly telling the teacher of the convent that if my grandson misbehaves, don’t show any mercy “ Sari Haakle” and we will not question. And so did the parents of other students irrespective of religion. We used to take those beating without any complaints also. There were no special change in academic time table to accommodate all these fasting and other religious obligations, but unfortunately, today education institutions are completed to adjust their schedule to religious fundoos and radicals. What a shame and Pity.....

Every Human being is bound to make mistakes. And hitting a student is not permitted, at least now. Making a mistake and then apologising is a greater human quality. We have been taught of this moral values by our teachers. And Br. Hector has apologised for his act. But giving it a communal turn is even a bigger mistake. My concern goes for the boy too. I being a Muslim have never felt anything partial in Joseph for 3 years, In fact I was more comfortable. I have gained a lot in Joseph's both in knowledge and moral values .As a part of the society are we doing the right thing by dividing society based on religion? Are we instilling the right moral values to the next generations ?
I guess more than 80% of people in Bajpe have gained from Joseph's in some or the other way.Request everyone not to make big fuss about this incident. I hope the teaching staffs of all the schools will be cautious about the way they treat the student in their upbringing.

One shouldn't take school time to relax in the name of religion. Students go to school/college to study. When other Muslim students could return in time, why not Siddique? It clearly shows how irresponsible and aggressive Siddique is? I do remember a incidence of a young boy who instead of corrected has been supported and pampered for his wrong doings, later the same boy brought disgrace and problems to his own family. Correction in childhood is always needed. GIDAWAGI BAGGADU, MARAVAGI BAGGITTEE. So many wrote so much good about Br. Hecter and I too heard so much good about him. Br. Hectors intentions were good.
I was happy to go through the comments of Mr. Shahnawaz Kukkikatte who clearly stated that only Christian instituions do lot of good work. We christins do respect all religious sentiments.
I request all those who support Siddique do not bring religion to school/college. Lets not encourage wrong doings.

The student was indisciplined and arrogant and hence the Principal tried to correct the boy. First of all the students should adhere to the rules given in the calendar and parents should strictly advise that their children be obedient and respect their teachers.
It is advisable to bring in a uniform code to all institutions as regards to the timings, dress etc. The religion and casteism should never be brought into the education system. God is for all and each one can worship and pray at his/her own free time either in temple or at home. The matters become worst when religion is mixed with other issues.
In this case we should appreciate Br Hector who indeed visited the boy in the hospital to see his wellbeing.

Can any body answer the question. Many Muslim boys went to offer prayers and one got punishment. Why ? If it is for coming late why did he come late?
During Ramdan fasting Muslims are also instructed to refrain from sinful behavior that may negate the reward of fasting, such as false speech, insulting, backbiting, cursing, lying and fighting.
This boys coming late to class will negate the spiritual reward and the punishment from the guru for his wrong doing will allow him to get the spiritual reward. So it is better to thank the Principal guru !

Beating and smacking is a taboo in a civilized society. Even the parents are not permitted to beat children in the western society. The Principal has agreed that he had smacked the boy twice in the back. So he is definitely at fault.
However, I feel that he has made enough amends for his mistake. He visited the hospital, met the boy and apologized. He did the same with CFI members and even offered to resign. Mistakes do happen and to accept the mistake and regret for the same is very rare these days. I feel sorry, my alma mater is in the news for all wrong reasons. The Principal should be advised not to repeat the same in future and the students - to attend the classes on time, Ramadhan or otherwise. A communal colour should not be given to this petty incident and the Principal should ensure that the students of a particular community is not pampered with at the cost of others. The matter should be treated as closed lest the student community will be divided on communal lines which doesn’t augur well for our beloved school in Bajpe.

Will any medical or engineering college allow any student who is a Christian during lent to go for prayers. Outsiders (CFI) should not interfere in the college matters, mind your own business. If you think that the student is taken to task please do start a college and see the problems you face.

I have written this before, and repeating again. I do not understand why parents still send their kids to convents and schools run by missionaries. Earlier convents had edge only because students there spoke good English. Now with globalization and educated parents kids learn English even before they are born!! So convents have lost their relevance. But age old colonial practices in convents such as abuses, corporal punishments, over discipline etc still continue, leaving permanent mark on students life. India's education system was always criticized previously, which was dominated by convents in last 50 years. Things have changed in last 5-10 years. Lots of CBSE, ICSE, international schools have opened aiming overall development of students. Parents need to be aware of current trends.

There are some rules and regulations which every student should follow, these students are misusing religious freedom, which will effect other students who are in ramadan fasting. Dont blame College or principal because from these institutions many talented and respected students have come out and being dignified citizens now also whichever religion may they belong to. Please stop putting religious colour to this issue.

This problem can be solved within the college. Why CFI has to come in the middle.

If the student is warned, he should take care of the timings. Always blaming the school is not good.

Principal:I took him to task and smacked his back twice.

There is no rule to hit or smack any students.
As there are rules set by the college management where the students have to follow same is applicable to principal to follow rules set by the education or by the govt.
Once you hit or smack students they have full right to complain and seek justice.Any teacher doesn't have any right to beat or smack students.
Anyhow during Ramadan students should not take advantage by coming purposefully late and the Islam doesn't allows to do the wrong things.
Students political wing should not take advantage of this issue to rake up instead they should amicably settle this matter with the college principal and Management.
    Hope everything will be alright.

Being a student of St joseph's I would like to mention that, the Principal has always been religious tolerant. Yes, the students are allowed to attend prayers in the noon. but there is time by which they should return. People opposing the Principal should notice one thing, the Principal didn't oppose the students from going to prayers from years, it is the Time which some may return back after loitering around is not tolerated. The thing is Bajpe has become so sensitive to issues that anything and everything leads to communal fights. The principal needed to take disciplinary action on the students who come late. He could have sent a note to the parents. but how many of you all think sending a note to parents would help? wont the parents in this case too accuse the Principal of being religious intolerant?
I am not supporting the Principal in banging the head of student on the wall(as accused here) or beating the student on the back(as the Principal says), But what i am saying is the Principal didn't beat up the student because he was of some other religion! Opposing the Principal on Beating up student? Do so!, but don't connect it to religion!

Ismail Saab, people are taking advantage of holy month of Ramadan. Other boys are coming on time after prayers why this boy coming late? instead of protesting people should educate this boy, otherwise one day he will be doing all wrong activities in the society. The teachers are punishing not for there benefits they wanted there student be a good citizen and to live good life.
