Mangalore, Jan 26: As per amendment done to Indian Penal Code no one can obtain bail from police stations henceforth. The amendment has made it clear that most of the criminal activities will not be granted bail. The accused cannot be brought out from the police station for whatsoever reason without the orders of the court.
So far there was the option that the accused could get bail in the police station and then get released in trivial cases. Those who were convicted under Section 506 could easily obtain bail from the police stations. This was very much prevalent in small assault cases, excise department cases etc.
But as per new amendments only court can grant bail and no one can obtain it from police station. Once taken to police custody, the accused must be produced in the court and it is only court which can grant them bail.
This has sent shivers down the spines of criminals who managed to get bail in police station and get released. While this has added weight to law and made it clear that a criminal must undergo procedures of law, it is also very clear that no one can influence some top police officials to get their men out from jail on bail.
