Bangalore: Sexual assault on child - Govt cracks down on school, cases filed


Bangalore, Oct 24 (PTI): Acting tough, the Karnataka government has filed a cheating case against an institution, where a sexual assault on a three-and-a-half-year old girl student took place three days ago, besides booking it under the RTE Act.

Karnataka Public Instruction Commissioner Mohammed Mohsin said several cases were filed last night against the institution, for violating rules.

"We filed a case under section 34 (acts done by several persons in furtherance of common intention), 418 (cheating with knowledge that wrongful loss may ensue to person whose interest offender is bound to protect) and 420 (cheating and dishonestly inducing delivery of property) of the Indian Penal Code against "Orchids, The International School," he told PTI.

Chief Minister Siddaramaiah said ".. investigation is going on. We are doing it seriously."

"I have told the police and the education department to initiate action against the management of the institution," he told reporters.

The school also has been booked under section 18 (5) of the RTE Act which stipulates that if a school operates without a certificate of recognition, it shall cease to function, Mohsin said.

It also shall be liable to pay a fine up to Rs one lakh, and in case of continuing violations, a fine of Rs 10,000 would be levied for each day that the violation continues. The school has been cheating people saying they are affiliated to CBSE and playing with the future of students there,he said.

"It has also been teaching CBSE syllabus without prior permission for the same. The school is not affiliated to the Central Board of Secondary Education," he added.

Meanwhile, police are yet to arrest the culprit. "No arrests and detentions have been made so far in the case. However, we have interrogated many. We are doing our best to nab the culprit," Additional Commissioner (Law and Order) Alok Kumar said.

The school staff members were being questioned and the CCTV footage being examined by police, he said.

A criminal case has been registered under the Protection of Children from Sexual Offences Act 2012 and IPC section 376 (rape) on a complaint from the child's father.

    nowadays school are mushrooming like grocery shops. loike "ABC International School" "PQR International School", "XyZ international School" parents also feel proud to tell that there children are studying in international school. but God knows how many these so called international school have license.

    our education department is also sleeping like kumbhakarna...

    Few months back same thing happened in another school.Still government was sleeping. Now another. How long public can tolerate? What crack down by state government filled with 'Cracks'?? Public should crack minsters head!!

    It is school managements' responsibility to take care of students/children (especially small children) from picking up from home to till back to home. School teachers/management shall be aware of all the activities. At present most of the educational institutions motive is profit making so they are not caring of children so my personal opinion/suggestion to concerned authorities to cancel the license of so called school and that is the lesson for other educational institutions

    After one week of the incident police are still to view the CCTV footage of such a serious allegation!!
    Is this a conspiracy to windup the proof just by throwing some case against the school to fool the public?!
    Why there is no transparent system for the general public to know if the school is affiliated with CBSE or not?

    The Law and Order in Karnataka has gone to dogs !!. See the violence against children and ladies going on unabated everywhere. The HM also has joined with the CM in the slumber , it looks like. Nidderamayya is busy strategizing the countering Param's claim for DCM and the constant threat of DKShi. Last one year rule is the worst period and Nidderamayya is the worst CM Karnataka has ever seen. This govt deserves to be thrown out.

    Dear Prasad, this kind of crimes happens not because of State govt or police. This is because of weak law and constitution in India. There are lawyers to fight for the culprits. If lower court punished, Supreme court will stay the punishment. Now 56" chest holder became the Prime minister, please advise him to change the law and constitution. Police arresting the criminals, court releasing them on bail. what is the use of arrest.
