Mangalore: Court holds auto driver guilty of raping minor

Mangalore, Oct 18: The 6th additional district sessions and disposal of sexual offences court here has held an auto rickshaw driver guilty of raping a minor. Finding that charges framed against Harish Gowda (26), an auto rickshaw driver from Kundadka in Kenja village of Beltangady taluk have been proved, the court, in its verdict dated October 17, reserved its orders on quantum of sentence.

The court is likely to announce quantum of punishment during next week.

Uppinangady police, who had registered a case of rape against Harish, had charged him of raping the victim on September 13, 2012. The girl in question, who was aged 13, was a ninth standard student. She used to attend school by staying with the family of her maternal uncle. As the school had held a programme of distribution of bicycles on that fateful day, the girl, who availed the opportunity to visit her mother, was going back to the house of her maternal uncle, when she was spotted by a person named Dinesh, who was travelling by an auto rickshaw driven by Harish Gowda. Dinesh, who knew the girl well, invited her to travel to her uncle's home with him. After Dinesh alighted from the auto rickshaw at his home on the way, Harish promised to drop the girl at her uncle's house.

Harish, instead of taking the girl to her uncle's home, drove his three-wheeler to a secluded spot in the reserve forest area in Yennegadde village, where he raped her. After threatening the girl not to reveal what had transpired, he dropped her off near her uncle's home. The girl, who was unable to stomach what had happened to her, revealed the details to her mother a week later. A complaint was thereafter filed in Uppinangady police station, and Harish was arrested the next day.

Uppinangady police inspector, Suresh Kumar, filed charge sheet in the court on December 20, 2012, and hearing began on June 6, 2014. After hearing the case and examining 18 witnesses, judge of the court, S H Pushpanjali Devi, came to the conclusion that charges of rape levelled against Harish Gowda have been proved beyond reasonable doubts.

In this case, the prosecution was represented by public prosecutor, K Shivaprasad Alva.

    the lesson for everyone , who is running behind the girls in terms of raping, the law should very tightened and more penalty should be there, which they are not able to pay, n keep them inside the cage forever..all countries getting better, but our Indian law is very flexible with rich and poor people...e.g jayalaitha been released being a corruptive , all political leaders curruptive , like where is the honey bee will be there, and where is treasure there is political leaders, all under the table maamla.

    oh my God it took 2 years to prove!! dont worry Mr. Gowda, appeal to supreme court or high court catch one lier lawyer get bail and walk freely on indian roads. This is only drama!! a few days later we will read that this gowda has been peoved innocent. Now no news of Mohan (serial killer) Thank you Indian law.. I appreciate your good work.

    when one hears such acts ,one cannot believe the rickshawalas at all.Of course all are not same.one in a Group is enough to bring bad Name to all.very sad Poor Girl who knows how Long it will take to recover from this shock and if at all she can believe anybody.One has to allow a child to be a child.Dont look at it with a bad Intention.may be tomorrow your child also can be a victim.He should get severe punishment and compensate the Girl for the pain and Grieve he did to her.

    Punish the Auto- Driver by delivering the quantum of sentence by all means. Also see to it that...
    1.His gear becomes defunct.
    2.His clutch has no grip.
    3. his oil tank because of the above (1 and 2) always remains dry.

    No Mr.ISMAIL K PERINJE., PERINJE this is Indian judiciary.Soon the accused will be released on conditional bail,he will attend one or two times to court hall,with that his case is closed and then he can roam freely on the road without any fear,revert back to his profession of auto-driver and start again the same activity.This courtesy,sympathy,feeling is only four Aam Aadmi like us.I know that how much trauma,pain that girl of ninth standard might have undergone? These B*****ds should be hanged,then only people will realize and think twice before committing any crimes.Now they are the kings.

    Congrats to prosecution team and the culprit deserves life imprisonment as victim was too young to digest the atrocity and mental trauma.In other words criminal virtually murdered the young victim so that he deserves very harsh punishment.
