If a vehicle rear ends another vehicle, then the vehicle which hit from behind is always at fault. Reason being: Either the trailing vehicle was following the one ahead too close to stop or was over speeding due to which it could not stop in time. In USA, there is a 4 second guidance, which is what is the recommended gap in terms of reaction time between two vehicles.
