Mangalore: Man convicted for fraudulent land deal, heavy fine imposed

Mangalore, Sep 28: The fourth JMFC court has convicted a person on seven charges of cheating filed by a woman, and imposed a heavy fine running into several lacs of rupees.

Sampath Raj (33) was convicted for duping a woman identifed as Rajeshwari Shetty in a dubious land deal.

In 2012, Sampath had shown a property to Rajeshwari and asked her to buy to a portion of it, saying that he would buy the remaining portion. He asked her to pay in cash.

Believing his words, the lady paid him Rs 33 lac in installments, only to realize later that she had been duped.

She then filed a private complaint in JFMC IV court, which convicted him on seven charges under the Negotiable Instrument Act.

As punishment under two charges, the court ordered Sampath to pay a fine of Rs 6.12 lac or face two years' imprisonment, in three charges he was told to pay Rs 5.10 lac or face two years imprisonment, and for another two charges, he was ordered to pay Rs 4.08 lac or face one-and-a-half years in jail and Rs 2.56 lac or one year in jail.

He was ordered to pay the above fines by October 21.

Sampath Raj had previously been arrested for cheating a US-based Mangalorean dentist with a similar fradulent land deal.

    The JMFC court has convicted the cheat. Good news. There are several such cheats especially people who are politicians or with political clout who are doing such cheating acts day in and day out. Persons like Mr Yogeshwara who is MLA is having the blessings of the party leaders and safe.We only hope that the law will give long rope to such persons as it has happened in the case of Jayalalita.

    This lady realised the fraud only after paying Rs. 33 Lakhs. What a irresponsible woman. What is wrong with people of India that they get easily conned. Disgusting.

    I think this news item is not properly understood and explained.no one can be punished for fraud under Negotiable Instruments Act.This Act is applied only in cheque bounce cases. Fraud/cheating is dealt under Indian Penal Code. Proceedings and punishment are totally different in criminal cases and cheque bounce cases.

    Lady paid 33 lakh, but the punishment is 11.5 lakhs n jail. How her remaining will be compensated?

    The verdict of court is o k but what is the recovery of the 33 lacs paid by the lady to him which is more important than his jail.That amount has to pay by him within certain period with all losses incurred to lady.

    Nothing is mentioned recovery of the 33 lacs paid by the lady to him which is more important than his jail terms which he will be subjected to only if he fails to pay abt 18 lacs in total which is much less the amount of 33 lacs.
    The jail sentences passed if they are simultaneous, then he will be jailed for maximum of 2 years only....!!
    Looks to me this sentence is in favour of the accused forcing the lady to file another court case for recovery of her amount in full with interest\legal fees.
