Bangalore: Jayalalithaa convicted, sentenced to 4 yrs in Jail; 100 cr fine

Bangalore, Sep 27 (PTI): Tamil Nadu Chief Minister J Jayalalithaa was today convicted and sentenced to four years jail in an 18-year-old corruption case in a judgment that will unseat her from the post, disqualified her immediately as an MLA and can impact the Assembly elections due in 18 months.

Since she has been sentenced to a term of more than three years, the Chief Minister has been taken to jail and she can apply for bail only from Karnataka High Court.

The 66-year-old AIADMK supremo has also been slapped with a fine of Rs 100 crore, highest imposed on any politician, by a special judge John Michael D'Cunha who heard the case of Rs 66.65 crore disproportionate assets acquired during her first term as Chief Minister between 1991 and 1996.

The conviction in the high-security court complex of Parappana Agrahara near here came amidst dramatic scenes outside where AIADMK supporters burnt effigies of DMK leader Karunanidhi and Subramaniam Swamy who had initially raked up the case.

The conviction also evoked sporadic violence in Tamil Nadu where public vehicles were attacked and shops closed.

The Directorate of Vigilance and Anti-corruption had filed a charge sheet in the case which was transferred to the court here in 2003.

The court also convicted three others--Jayalalithaa's close friend Sasikala, Sasikala's niece Ilavarasi and her nephew and Chief Minister's disowned foster son Sudhakaran --and sentenced them to four years of jail term.

Special Public Prosecutor Bhavani Singh said a sum of Rs 10 crore has been imposed on the other three convicts. He said the four can apply for bail by moving an application before the High Court.

Under a Supreme Court judgment of July last year, any MP or MLA who is convicted of a crime with more than two-years sentence will be disqualified as an elected representative from the date of conviction.

Unless the conviction is stayed or overturned by a superior court, she will be disqualified under the Representation of the People Act from contesting elections for a period of 10 years--four years from the date of conviction and six years thereafter.

Jayalalithaa has had the dubious distinction of having to resign in 2001 following a Supreme Court judgment that nullified her appointment in view of her conviction in TANSI land deal case.

 

Violence erupts in Tamil Nadu after Jaya's conviction

Violence broke out in several parts of Tamil Nadu today after Chief Minister J Jayalalithaa was convicted in a graft case with angry AIADMK supporters indulging in stone pelting and arson and forcing closure of shops.

Tension prevailed as protesters burnt effigies of DMK President M Karunanidhi, his sons M K Stalin and M K Alagiri and tore party posters in various places including in Chennai and Madurai.

While some protesters pelted stones at the residence of BJP leader Subramanian Swamy, DMK and AIADMK supporters clashed at Gopalapuram here.

A state-owned transport corporation bus was set on fire at Veppur village and some 20 buses damaged in stone-pelting in Cuddalore district, police said.

Stone pelting incidents were reported in Ambattur here, Edapadi in Salem district, Cuddalore and in Srirangam, Jayalalithaa's assembly constituency, police said.

Shops and commercial establishments downed shutters in various parts of the state.

Protesters also damaged two-wheelers parked alongside roads in Madurai, they said.

In Chennai, effigies of DMK leaders were burnt in Poes Garden area.

In Madurai, AIADMK men blocked traffic and asked the shops and business houses to close their units.

Police said some shops were ransacked and stones pelted in Tiruchirapalli and Dindigul.

Security personnel in large numbers have been posted to maintain law and order, police said.

Bangalore, Sep 27 (IANS): Tamil Nadu Chief Minister J. Jayalalithaa was convicted Saturday in a Rs.66 crore disproportionate asset case by a special court here.

Following this, Jayalalithaa, also known as Amma (mother) by her party cadres, is disqualified as a member of Tamil Nadu assembly.

After an 18-year court battle, judge John Michael Cunha convicted 66-year old Jayalalithaa, who is general secretary of the AIADMK.

He held Jayalalithaa and three others - Sasikala and her relatives V.N.Sudhakaran and J.Illavarasi guilty. Sasikala is the close aide of Jayalalithaa.

Jayalalithaa was charged with acquiring assets worth around Rs.66 crore which is disproportionate to her known sources of income.

During her first tenure (1991-1996) as the chief minister, Jayalalithaa had announced that she would take just Re.1 as her salary.

The charge against her was that her assets were around Rs.3 crore in 1991 and had grown to around Rs.66 crore between 1991-1996.

The AIADMK was voted out in 1996 as it was perceived to be corrupt.

Incidentally, DMK MP T.M. Selvaganapathy lost his Rajya Sabha seat this year after he was convicted in the cremation shed case by a CBI court. He was the local administration minister in Jayalalithaa's government when the scam broke. He later switched sides to the DMK.

The disproportionate assets case filed in 1996 by the then DMK government led by M. Karunanidhi saw several twists and turns during its course.

When the AIADMK returned to power in 2001 several witnesses turned hostile. On a petition filed by DMK leader K. Anbazhagan in the apex court, the case was transferred to Bangalore from Chennai.

Since then, the case meandered, with several petitions filed by the defence and several adjournments.

Over 255 prosecution witnesses and over 95 defence witnesses have been heard in the case.

Jayalalithaa was also summoned by the trial court in 2011 and answered over 1,300 questions posed to her by the judge.

This is not the first time in her political career that Jayalalithaa has been convicted by a court. In 2000, a trial court sentenced Jayalalithaa for three years and two years imprisonment in two cases.

The big question now is who will head the government in the absence of Jayalalithaa. Again this is not the first time such a question has cropped up.

In 2001, Jayalalithaa had to step down as a chief minister following a Supreme Court verdict which held that she cannot hold the office after being convicted for criminal offences.

However, she made O. Panneerselvam, a senior minister in her government, as the chief minister.

In 2002, Jayalalithaa again became the chief minister after being acquitted by the Madras High Court. She was later elected from Andipatti constituency.

AIADMK leaders do not rule out re-run of such an arrangement.

Friends and foes are in awe of Jayalalithaa, who is the tallest Brahmin politician in a state where anti-Brahminism is a part of political discourse.

Even her critics admit that Jayalalithaa is a fighter and has an iron grip over her party.

The judgment against her was delivered in a state where she was born.

Born in what was then known as Mysore on Feb 2, 1948, Jayalalithaa moved to Chennai with her mother, who started acting in movies.

Jayalalithaa studied at the Bishop Cotton Girl's High School in Bangalore and another Christian convent, Church Park, in Chennai. A bright student, Jayalalithaa ventured into acting and made her debut at the age of 16 in a Kannada movie.

Her first Tamil movie was the memorable "Vennira Aadai". But it was the grand success of "Aayirathil Oruvan" pairing with the legendary M.G. Ramachandran (MGR) that turned Jayalalithaa into a leading light of Tamil movie world.

She has paired with almost all the leading Tamil heroes. She has acted in over 100 movies, mostly in Tamil, Telugu and Kannada.

A charismatic leader who is at home in Tamil, English and Hindi (a rare quality in Tamil Nadu politics), Jayalalithaa has also sung many songs and written several stories. But when she entered politics, few could have predicted her meteoric rise.

AIADMK founder-leader MGR made Jayalalithaa the party's propaganda secretary in the early 1980s. In 1984, she entered the Rajya Sabha.

Jayalalithaa, who chose never to marry, was elected to the Tamil Nadu assembly for the first time in 1989. Just two years later, she became the chief minister, sweeping the election of 1991 held in the wake of former prime minister Rajiv Gandhi's assassination.

She lost her huge mandate within five years amid corruption charges.

    Just being a devil's advocate. When the case was transferred to Karnataka at the request of DMK, for a possibility of political influence, not sure why the case was transferred to Karnataka. In Karnataka, everyone has grudge against her because of her rhetoric and success in Cauvery issue. When DMK moved SC to transfer the case, a Congress was on power in center. There could be a larger conspiracy to transfer the case to Karnataka. We know the state of judiciary and how judges are appointed. The whole of Karnataka and Mandya district in particular celebrated her sentence.

    This women was primarily responsible for arrest of Swamiji of Kanchi Kamokoti Peetha few years back based on a case. He was arrested on the day of Deepavali while getting ready for Pooja, & taken away from the place of worship. When she felt this case would not stand, she resorted to arrest of Junior Swamiji with another case. Everyone knew these complaints where fake one, with false intention, & people knew her intention was different from what was being said. Every efforts where made to damage their name & fame, & media too hectically highlighted it. Just few months back the case was evicted, & these swamijis where relieved.

    Now, what she did to these highly respected Swamijies has begun to come back to her. This nothing but her Karmaphala ( Deeds of her past karma ).

    Sad that Jaya turned into criminal due to bad company She hung around. She was a good person when I knew her and many members of DMK party in Madras(now Chennai)She was follower of Late Anna Dorai and party member of Karunanidhi as well as MG Ramachandran. She was close friend of Mr.MGR. She lived very close to my residence when she was starting Actress,living with Her actress Mother. She was also in Anti Hindi movement. This is the movement that created DMK Party of Anna Dorai.
    At the same time Judge John Michael D'Cunha was a Lawyer with Attorney Mathias and B G Pereira.
    Judge is from Gurupur. Well known to me. His Dad Victor D'Cunha was a well known Craft Master in St.Aloysius with whom I did craft work for Charities.
    Greed and bad company led to Jaya's down fall.

    Finally the booty queen has been brought to the book of justice. She is one of the most corrupt politicians in the history of our country. I don’t think anyone has forgotten 100-crore she spent on her foster son’s marriage, whom she disowned later. See the support she still has despite her conviction. Her supporters seem to be blind who don’t care how much public money she looted. These stupid people are even ready to die for her.     I was happy that Tamil Nadu was stepping ahead with our honorable Chief Minister Ms. Jayalalitha. Only the people in Tamil Nadu can own the credits of her service. She has done so much for the children in terms of education, providing food to beggars at roadside, helping woman financially for their marriage and pregnancy, nutritious food to all children, day-by-day monitoring of health inside the school premises so that children can come out with flying colors, etc. What not? We need her back and I am damn sure she is the iron lady of Tamil Nadu and no one else can substitute her place. Justice should be even to all.

    Just 4 years of imprisonment is not the solution to such crime..
    She has fattened herself using the taxpayer's money. All those who thought that she is a goddess have been fooled by a few deeds to show that she is doing great work. The fact is, she has used all the hard earned income of public to fill in her stomach.
    She should be asked to first repay all the money and wealth back to poor people first. Then she should be put to hard labour so that her fat is reduced.
    Let common man learn a lesson from this case as to what happens if they vote for such cunning person.

    Now the only question is, will she be really put behind bars or will she come out with the help BJP? She has already been licking the a..... of BJP leaders in the center. They will naturally create some excuses to release her from Jail. Let the public get together and see that this does not happen.

How big or powerful one may be, if guilty has to go behind bar..All corrupt politicians irrespective of their party, must face the music of our legal system. Their property and wealth to be confiscated and returned to the treasury and should be banned from holding public office or contesting elections for life time. Then only people will realize the heavy handedness of law. Please look at Sharad Pawar, Howq much wealth he has amassed. He has only one daughter who is too rich and is MP but still the greed for money is not gone...He has enough wealth to feed the whole of African continent for 10 years...

    Few years back Kanchi Pontiff was framed & arrested on a false case by this Madam when she was then in power. When Senior Pontiff was about to be released on bail, Junior Pontiff was arrested with another false case. Over years these pontiff had to suffer the truama because of wrong deeds of this Madam, & untill recent when the Court gave its verdict on Kanchi Pontiff's being not guilty.

    Now its payback time for Madam, results for her Karnamas. Let's wait & see what will happen, just as a saying goes, 'Every Saint has a past, & every Rogue has a future'.

    She had even eyed on Nethravathi river also. Such a greedy person she is.

    So I am very happy about this. Hope she will be in jail for atleast 5-10 years
