Anti-dowry law misused, no automatic arrest in such cases: SC


New Delhi, Jul 3 (PTI) : Expressing concern over misuse of anti-dowry law by "disgruntled" wives against her husband and in-laws, the Supreme Court ruled that police cannot arrest accused in such cases "automatically" and it must give reasons for taking such steps which would be judicially examined.

The apex court said the attitude to arrest first and then proceed with the rest is "despicable" which must be curbed and directed all state governments to ensure that police do not resort to arresting in all offences punishable up to seven- year jail term including dowry harassment cases.

"We direct all the state governments to instruct its police officers not to automatically arrest when a case under Section 498-A of the IPC (dowry harassment) is registered but to satisfy themselves about the necessity for arrest under the parameters laid down flowing from Section 41 CrPC," a bench headed by Justice C K Prasad said.

It said that the police officer shall furnish the reasons and materials which necessitated the arrest before the magistrate.

"Section 498-A of the IPC was introduced with avowed object to combat the menace of harassment to a woman at the hands of her husband and his relatives. The fact that Section 498-A is a cognisable and non-bailable offence has lent it a dubious place of pride amongst the provisions that are used as weapons rather than shield by disgruntled wives.

"The simplest way to harass is to get the husband and his relatives arrested under this provision. In quite a number of cases, bed-ridden grand-fathers and grand-mothers of the husbands, their sisters living abroad for decades are arrested," the bench said.

The bench said the arrest curtails freedom, brings humiliation and casts scars forever and no arrest should be made only because the offence is non-bailable and cognisable.

"The existence of the power to arrest is one thing, the justification for the exercise of it is quite another. Apart from power to arrest, the police officers must be able to justify the reasons thereof.

"No arrest can be made in a routine manner on a mere allegation of commission of an offence made against a person.

It would be prudent and wise for a police officer that no arrest is made without a reasonable satisfaction reached after some investigation as to the genuineness of the allegation," the bench said.

Referring to crime statistics, the apex court said 1,97,762 persons were arrested in 2012 for offence under Section 498-A and nearly a quarter of those arrested under this provision were women depicting that mothers and sisters of the husbands were liberally included in their arrest net.

"Its share is 6 per cent out of the total persons arrested under the crimes committed under Indian Penal Code. It accounts for 4.5 per cent of total crimes committed under different sections of penal code, more than any other crimes except theft and hurt," it said.

It said the rate of charge-sheeting in cases is as high as 93.6 per cent, while the conviction rate is only 15 per cent, which is lowest across all heads and as many as 3,72,706 cases are pending at trial stage.

The apex court said that police in the country has not come out of its colonial mindset.

"It has not come out of its colonial image despite six decades of Independence, it is largely considered as a tool of harassment, oppression and surely not considered a friend of public. The need for caution in exercising the drastic power of arrest has been emphasised time and again by courts but has not yielded desired result.

"Power to arrest greatly contributes to its arrogance so also the failure of the magistracy to check it. Not only this, the power of arrest is one of the lucrative sources of police corruption. 

The attitude to arrest first and then proceed with the rest is despicable. It has become a handy tool to the police officers who lack sensitivity or act with oblique motive," it said. 

The apex court said that failure of police officials will be liable for department proceedings and amount to contempt of court for not complying with its direction.
It said, "Authorising detention without recording reasons as aforesaid by the judicial magistrate concerned shall be liable for departmental action by the appropriate High Court."

"Our endeavour in this judgement is to ensure that police officers do not arrest accused unnecessarily and magistrate do not authorise detention casually and mechanically," it said.

The apex court said a person accused of offence punishable with imprisonment for a term which may be less than seven years or which may extend to seven years with or without fine, cannot be arrested by the police officer only on its satisfaction that such person had committed the offence.

It said police officer before arrest, in such cases has to be further satisfied that such arrest is necessary to prevent such person from committing any further offence or for proper investigation of the case or to prevent the accused from causing the evidence of the offence to disappear.

"Law further requires the police officers to record the reasons in writing for not making the arrest. In pith and core, the police office before arrest must put a question to himself, why arrest? Is it really required? What purpose it will serve? What object it will achieve?

"It is only after these questions are addressed and one or the other conditions as enumerated above is satisfied, the power of arrest needs to be exercised. In fine, before arrest first the police officers should have reason to believe on the basis of information and material that the accused has committed the offence," the bench said.

"We are of the opinion that if the provisions of Section 41 CrPC which authorises the police officer to arrest an accused without an order from a magistrate and without warrant are scrupulously enforced, the wrong committed by the police officers intentionally or unwittingly would be reversed and the number of cases which come to the court for grant of anticipatory bail will substantially reduce," the bench said.

    i am also panic with this 498-a low itis very bad actually my wife had afair and she was accepted even i told i forget everty thing aboout your past but she didn'stay in my house now my marriage finished 2 years but she din'nt stay with me and now her father and she asking like blackmail and using this low for blacmail me and asking 25 lakh money ,i don't now she did't stay with me she how asking money and now i am in big trouble ,befor her father told internaly cmompromise but now her father give me waring abourt dowri and harasment case ,now i am in outside in india they make problem for my familay ,please support me and try to help me

    The ugly truth really nowadays are that wives and their relatives use laws, which were made for protection of women, as their weapon to spread legal terrorism, to extort meaningless amount of money as ransom for avoiding arrest by filing false dowry cases against them, you can see the history if a newly wedded wife complaints, she would claim husband is an impotent, after passing some months or years the allegation becomes dowry harassment, domestic violence is so freely put in all cases as you say a vegetable vendor to put some coriander with some green chillies for free in the vegetables bought by you,my wife accused me of dowry harassment and domestic violence charges, whereas i hadn't even touched her without keeping in mind about her consent and comfortability, reason of her differences between us is her mother that's why i was washing my clothes with my own hands on her directions, they were demanding divorce, permanent custody of our son child, thirty lacks of rupees as ransom, and reason for all this was just that i had not attended a marriage function of her mama's daughter, she left 7 days earlier saying if you will not come to attend it i will head for divorce and the only way for her family to get their wishes fulfilled was to file a false complaint, i was neither eager nor able to fulfill their demands as a result i was arrested on 4th of June and got bail on the 6th June after they got all my household items all furniture which i bought 4-5 years earlier before my marriage, they left nothing even salt, pepper, spices, my undergarments, my clothes, soaps, detergent, they robbed everything they could, and are showing themselves as a very reputed persons in HIND CINEMA premises of kaithal, Haryana but reality sights among them who faces it, kisi ne kaha hai " aap mare bina swarg kisne dekha " .at least there should be a fair investigation with proofs before arresting to defame a husband which is his right of humanity, and justice should be done looking it genderlessly.

    Hey Guys,
    You have to see how some people\agents(match makers) do marriage proposals taking money in advance. They have lots of girls in their files who are not married, but act as if girls are in shortage (may be good once with good looks) and these girls start looking for proposals soon after they finish their college. God only knows how some managed to get double masters degree in total 2 different fields while the boy is more work experienced. These matchmakers show off as if the girls are independent, hardworking, with great looks. With great difficulty you will be able to see the girls photo, but before that they want all the details of the boy like his age, education, income, bank balance, property, old people at home and much more after all this you will be given the girls photo to be seen. They never give the contact details of the girls to talk over phone to know abt her expectation or in general abt her. They say it's a girls matter and they have to careful before they reveal anything, they have to inform her parents and her relatives, meet & impress them and if they agree then only meet the girl.

    After all this when you meet the girl who has high expectation and wants the boy to be of her own age (never heard in rest of the world) , you will be in a shock to see a girl who looks like(OMG forget it :)) … the photo was of her high school days and edited. Later you will find she has got a FB account with every nonsense in it, but wants well planned arrangement to meet a boy. When you meet her she asks all non sense stuffs or makes you feel odd in one meeting itself. Why she wants unwanted stuffs if she has achieved so much in her life.

    We put our efforts not only to get degrees, but travel far to earn money and work experience to hear all this :)?

    This section is 498-A of the dowry harassment is a one sided law where the girls take advantage of this law. I am the one along with my family member who suffered due to this case where my ex wife and her family member filed a false police case against us and demanded 50 Lakhs for dowry harassment and toucher and then agreed for out of court settlement and we had to shed a few lakhs to take the false case back and pay their lawyer and now they are enjoying their life in my hard earned money

    This is money making scheme government is provided for Ladies in india even I had come across same situation.after marriage when I came to Dubai for Dubai my ex-wife started troubling my old parents for property share when they objected she filed a dowry harassment case 498A.my sis and bro in law whose have visited india for 4 years case filed against them. how could be this possible after shedding some lakhs of rupees the case is settled out of court now that lady is enjoying my hard earned money. Even the police is corrupt they want commission after the settlement. Now a days some girls want money they are not looking for good relation.

    I totally agree with Manish. I am also the one who had to suffer due to this one sided Indian Law were my EX wife and her family with help of few corrupt lawyer framed a false case and i had to shed a few lakhs as out of court settlement and now they are enjoying in my money in Dubai

    There are several innocent husbands are suffering due to false statements from wives or females. There is one incident like this- the person accountant in profession, arrived with a suitcase from dubai having shop for his family & utter to his surprise he found his flat door locked. He checked with immediate nabour & they told him that they sold that flat(which was in his wife name) & gone to dubai with their only one daughter. Hearing this he fainted & this person admitted in ICU. The lady who absconded to dubai, involved with a married man & she got a child from that stranger & after few gap that stranger had parrelized & this lady is in soup now. Without divorce she absconded leaving her matrimonial house & husband & some one has to pay a price. But what was wrong from her husband who was working for their own family sake.

    Manish Shetty, Derebail/Mangalore, I know 5 such cases in my friend's circle that too Mangaloreans. 3 of them happened within 3 month's of marriage. They had to pay hefty amount to get a divorce other than the amount they spent for wedding. Specially it happens with NRIs as they have to sacrifice their job and future if the case goes to court. Compromise outside the court is only the solution for them. Even though it is unbelievable for the honest and straight forward people, the fact is it is happening.

    A great day for all the innocent in-laws and victim husband. Myself was warned blackmail by my ex wife cause of this law to put all my relatives and my old mother to jail. Even though we did not ask anything. When it is proved in court that they are wrong it would be too late cause all would have visited jail.
    Now most of the marriages will be come stable since this law was easier money earner for wife. Like lottery. Those who have not seen 1000 rupee note could make lakhs in a month by harassing the husband.
    Thanks god SC recognizes this.
    Note: Before any ladies comment on this, Please remember mother sister are also women, Tomorrow you will have a son and if his wife put you in jail because of this law then you would understand what i mean.

    Manish , I can understand your anguish. Having come across only the gentle and the soft ,it's very difficult for me to imagine that the kind you have described exist.
    Those I think must be like the 'Crabs' with the 'thick outer cover'. Otherwise every other fish is smooth and lovely like,'Kaane' , Anjal, Silver fish, like that. Is it not? Tried again?
    If you get 'Crab' at first attempt , it's your 'hard luck' , is it not? Crab usually grabs and bites....Then you become wary -and once bitten twice shy type. Don't worry...Females in general are very good. It's the 'particular' which is a matter of concern.
