Mangalore: Scissors inside woman's body - U T Khadar expresses shock

Daijiworld Media Network - Mangalore (DV)

Updated

Mangalore, Jun 29: A day after the shocking incident of a woman finding a pair of scissors inside her four years after her surgery, came to light, minister of health and family welfare U T Khadar said that the district health officer has been asked to submit a report on the incident and that appropriate legal action would be taken by the authorities concerned.

Ayesha (name changed), a resident of Madoor on Saturday June 28 had alleged doctors of Mangalore Nursing Home in the city of negligence, after X-rays had revealed that a pair of scissors had been left behind by the doctors who operated upon her.

The surgery for hysterectomy (surgical removal of uterus) had taken place in February 2010, and ever since, Ayesha had been suffering from joint pains and other ailments which had rendered her unable to work. Dr Poornima, one of the doctors who had performed the surgery, in her defence had said that it might have been done by some doctor too, and that the location of the instrument (in pelvic area) was not exactly where the surgery was performed.

Speaking to daijiworld over the phone, U T Khadar expressed shock at the incident and said,"If such negligence could occur in a well-known hospital such as Mangalore Nursing Home, what about hospitals in rural areas?"

"I have asked the DHO to submit a report. We can take suitable action against the guilty under Karnataka Private Medical Practitioners Act," he said, adding that the doctors at Mangalore Nursing Home are usually good, but this was shocking.

He also said that after the incident came to light, Ayesha's family had contacted him. It is learnt that on Sunday June 29, Ayesha got admitted to Unity Hospital to get the pair of scissors removed through operation.

Mangalore, Jun 29: There have been numerous cases around the world of doctors leaving behind a surgical instrument inside the patient's body during operation. In a similar incident reported on Saturday June 28, a lady in Mangalore found out that her doctors too had done the same to her, only, she learnt of it over four years after the surgery took place!

The patient, Ayesha (name changed) from Madoor here, on Saturday appeared before the media at Mangalore Nursing Home and alleged that the doctors who had operated upon her four years ago had left behind a pair of scissors inside her.

Speaking to media persons, Ayesha said that more than four years ago, on February 22, 2010, she was admitted to Mangalore Nursing Home for hysterectomy (surgical removal of the uterus). After the surgery, she developed swelling in the joints and especially in her knees, and consulted some doctors who told her that such swelling was common in patients who undergo hysterectomy.

Nevertheless, she continued to take treatment, but to no avail. She was not able to do any work, which sent her into depression and her health further deteriorated. For four years she took various treatments for her pain.

A few days ago, she consulted another doctor who referred her to a skin specialist, who in turn asked her to take X-rays and undergo other tests. She did so accordingly, and to her utter shock, the X-ray revealed a pair of scissors resting in her pelvic area!

She then came to the hospital to demand an explanation from Dr Poornima Nair and Dr Rohit Gatti who had operated upon her.

Accusing the doctors of negligence, she said, "When I came to the hospital today, I was told to negotiate and hush up the matter without letting anyone else know. However, I decided to bring the matter before the media so that it does not happen to other patients. I will not compromise on this."

She further said that though she had not decided on her future course of action, she said she was determined not to seek any further treatment in the same hospital.

Dr Poornima Nair, in her defence, said that a surgery is a team work and if any such incident occurs, it is the responsibility of the entire team and not of any single person. She moreover pointed out that the surgery was done on the central portion of the pelvis where the uterus was located, whereas the pair of scissors was found towards the side.

"We cannot say for sure that it was our mistake. It may have been done by some other doctor. Unless we operate again we cannot know what exactly happened," she said.

I have been a patient of both Mr. Gatti and Poornima Nair. I have found them to be totally caring and very committed to their patients. In the same year that Ms. Ayesha underwent the surgery, I also underwent a major surgery in Mangalore Nursing Home. I found all the staff very caring and committed. Although I sympathise with the patient, I cannot believe that the two doctors were negligent. I have no explanation for what has happened. Since the media has given the incident so much publicity, I wish the matter is thoroughly investigated and matters cleared.

Many questions need to be answered here
    1) She I presume was 31 years when she underwent Surgery, Was Hysterectomy needed? Alternate treatment discussed with the patient? 2) The nurses who assisted the surgery were they qualified? 3) DO they keep a board displaying instruments and mops in OT? 4) WHy was womens complained ignored and not investigated properly when the patient has symptom for 3 years? 5) The Doctor takes the maximum money during surgery and he must take responsibility for the same. 6) Mistakes do happen and but the patient must be compensated for the pain and suffering she underwent.

"An excellent doctor and even better human being" - these words aptly describe Dr. Rohan Gatty. He is a doctor who was and is always ready to help needy patients. At times helping patients financially for surgeries, chemotherapy, radiation therapy and so on. He is been a life savior for many. I believe the Almighty also showers blessings on this dedicated doctor who believes in serving the needy people.

We all are being judgemental about this case. Looking at one prospective of it. Well, there are so many issues in this matter. Its a negligence but we need to enquire about this case thoroughly as she has undergone surgeries before and after the hysterectomy.
We always try to look at what the victim says , but do not even investigate what might have actually occurred. First of all its a hemostat forceps which is being wrongly projected as scissors. Please I request the media to bring the facts out and our educated people to investigate the procedure and leave derogatory comments harming the reputation of a well known doctors who have been angels for many.

With many colleges charging capitation and letting in average students but have the money and no commitment, this is what you get. in the west getting into medical college is very strictly controlled with the brightest getting in and going through rigorous training. Just like our IIT'S.it's time we did the same.

I hope no doctor will forget to take operation charges.

Do some commentators say that the victim herself kept it after operating and asking CBI inquiry?!

Mangalore Nursing home is fully responsible for this act.

The victim must be compensated fully.

In my opinion no need to file court case against them.

A warning from health department is highly imperative to doctors for their negligence.

They have doctors Medical Association. Let them compensate to the victim.

Anyone here commenting that these doctors mint money, I clearly would like to defer. Me and my family have personally known Dr.Rohan Ghatti for few years, after my Mom underwent a major surgery. He always has words of hope that would get any patient enough strength to get ready for a process of healing. He is a well experienced doctor, blessed with patience and healing power. He is one of the very few doctors who works on ethics and not money intended. You really need to know them, even before passing negative comments n curses. It's very easy to tarnish someone's name but difficult to take back words n the harm already done when proved they are not guilty. Let proper investigation take place and the true culprits n intentions behind this incident come to light. Until then, please STOP negative comments n harm! I am sure, anyone who has been treated by this Doctor, who has taken treatment under his care, happened to talk to him of any medical issue, will agree with what I have stated and support him. Dr. Rohan Ghatti..we will support you. I am sure God is at your side and you will surely come out clean hands by His Grace! God is going to use you mightily for many more healing....

There are many issues here. As far as I have known, the patient got treatment/surgery 3 hospitals after this surgery in MNH. If a new operation is to be performed, the existing accused doctor should be permitted alongwith proper legal advisors to take full view of surgery now. Also, it is necessary to probe into all details of operations/surgery/treatments she has taken since the first operation. Politics is also seen to be craving in to take some mileage.
Best is to give the matter to COD/CID investigation. As this is matter relating grievences of public.

    Dear Mohandas,
Now you say that there were other surgeries/treatments after that 4 year old surgery. First of all it seems like you went and checked with the patients if that was done or not.
However, treatments dont get forceps inside a human system. and for surgeries, a person is not a fool to give a try for surgeries for the sake of it, is that a game to play with.
Moreover I do find that reasons given by surgeons are silly and not conducive to their profession.
First was blaming OT staff. and second is that the surgery was done in central part where as the instrument is shown at the pelvic region. Do you think in 4 years the instrument will stay at once place with our bowel movement.
Thank God she is alive because the forceps are not pointing to her lower bowel region which could have been disastrous.

    Mr Alex,
If such a pointed instrument, remained for 4 years, or as you say if kept moving, she would have suffered terrible pain, or her other parts could have been damaged because of sharp point. If you check for details, you can know that she had been in touch with other hospitals & had taken treatment. Naturally, equal blame will fall on all approached hospitals, as risk might have come from any corner.
Please read my comment carefully. I have been insisting for COD/CID enquiry in to the matter, & not speaking on any behalf. Because only a deep enquiry can reveal truth.

They forgot to remove the scissor after killing the the patient (by charging exorbitantly!)
Nowadays, charges for medical services by the private hospitals and clinics are very costly. The Govt. Hospitals and clinics are either not approachable because of their lethargic approach and lack of facilities and cleanliness. Despite all schemes and promises, steps taken by the Government, the medical industries are here to loot the public can't even afford to go for a simple x-ray scanning. I think the reason for this is due to the high cost for medical education and the instruments they import, where they have to pay heavy taxes to the Governments. Can Govt. do something on their part, may be reducing the taxes or any other kinds of cost (if any) so that we can hope for some kind of respite in the future?

I've seen him grow into the surgeon he is today, of the many cases we have operated together and time spent in and out of operating room I have learnt immensely from him. One thing that always is on his mind is his patient well being, be it day or night, he has never hesitated to come out and help a needy patient. His operating skills are second to none and his dedication towards the profession is infallible. He is an asset not only to the medical fraternity but to the patients at large. Errors are committed by persons, but by Surgeons it should never be condoned, simply he was good.
One mistake can do away with all the good done previously.
Now a days they do money by doing too many surgeries on a day without giving proper rest to oneself, which is the root cause.

If the Patient suffered for 4 years for the fault of a physician/system uting a known validated scientific procedure , there is some thing wrong.

Could be the system , ignorance or failure of government malpractice insurance structure.

For example , If the court finds that physician is liable for the mistake , he/she should pay drastically lot more insurance premium and/or face suspension.

Without the proper incentives/punishment in place mistakes like this will continue to repeat .

On doctors point, it could be too early to conclude that the fault is with the doctor. As she points out, it is not just her : But the system, policies and procedures .

In the end ,we all know/heard things like this have happened : at times, patients paying it with their life.

It is the responsibility of the government to step in to address these kind of issues and create incentives that facilitates improvement in healthcare . An honest investigation to find out what went wrong should be supervised by the government to prevent further incidents of this kind. Mr. U.T Khader is stepping in that direction is sign.

Dr Nair has been my Gynec for 3 surgical deliveries and I can vouch that she is a good Doctor
Surgeries are done by a team of Doctors and Nurses who are human and like all human beings can make errors. Please be aware of the conditions under which surgeries are done. Doctors do multiple surgeries in a single day and each surgery may sometimes take hours. Once the Doctor enters the OT she cannot exit until all surgeries are completed.
Under these circumstances, if a mistake happens which is not very common, please be understanding. Sometimes a patient may die during surgery - Is the Doctor to blame ?
It is sad when there is a chance everybody jumps in to critisize whether they know anything at all of the circumstances or not !

I hope no doctor will forget to take operation charges.

How come this object/thing is forgotten.

The pain and the sufferings which the patient had will not be compensated through money alone.

It is only imposing a penalty to those Doctors.

Feel disgusted to read the statement of shameless Doctor to the media. Instead of accepting the moral responsibility and saying that the hospital will investigate the matter as to where the negligence has happened, she is trying to drag the entire team by passing on the blame to others. It may sounds like any other small incident of negligence but the 4 year sufferings of patient cannot be simply overlooked as it could have caused more damage had it not been found at this stage. Hope the concerned authorities will not try to bury this issue coming under any sort of influence and see to that the patient in discussion gets a fitting compensation and the responsible doctor's license must be suspended at least for the number of years that surgical tool was there inside the stomach.

This incident also reminds me of the similar negligence came to know in Bosnia where the surgical tool was left inside for about 9 years. Have look at this. Google, man-in-agony-for-nine-years-discovers-scissors-in-his-stomach. Patients who undergoes any kind of surgeries or hospitalizations for major treatments must remember to take a detailed report of the treatment they have undergone (copy of treatment sheets) at the time of leaving the hospital as it the basic right of patients to know what kind of treatments they have undergone. Normally hospitals do not give the above while discharging the patients fearing future consequences.

Now the media and public will decide and pass judgement on whose 'fault' it is. If something of such grave nature has really happened then the patient must approach consumer court first and get suitable justice. Patient, public and media can have hundreds of opinions. If doctors are at fault in such cases then its a just straight forward case, justice can be delivered in short time. The patients statement is unclear here. We don't know if this patient had undergone any surgery before or after this incident. It could have happened anytime. Such a large scissors in abdomen is unlikely not to give any serious trouble for four years. Something is wrong here. Let the patient file a consumer case and let her be investigated by competent specialists.

Ethical practice is completely forgotten in India thus resulting in deteriorating doctor-patient relationship. I would completely support the victim here if her case is true. But I have some doubts as everyone else.
    1. Survival for 4 long years with a gib pointed scissor in the abdomen where there are delicate organs is questionable.
    2. A foreign body in the abdomen would cause pain in the tummy in the beginning usually and not joint pains.
    3. If she had joint pains why she was not referred to an orthopedic surgeon or a rheumatologist and instead sent to a dermatology?
    4. Why on earth a dermatologist would routinely do an x ray abdomen when his specialty mainly involves specialised blood tests and skin biopsies where necessary.

Only a detailed investigation would bring more light into this and the culprit (doctor/patient) must be penalised and the victim (doctor/patient) must be compensated. Good luck to both as I'm just a commentator and and have no special interest in either of them.

Dr.Poornima are you fooling society or are you fool yourself. Before you operate in pelvic region is it mandatory to examine the patient with x-ray and scan and you did not notice pair of scissors? God please save my country from butchers.Let the patient sue the doctor and hospital for negligence.

serious negligence. This patient should sue that hospital for at least 1 crore compensation. Moreover she has undergone 4 years of pain. Now it is time to think before visiting any doctor and forget about undergoing any surgery. You may be taking huge risk. Quality of work has been reduced in every part of this country.

SAD to know such a dangerous act of professional act of doctors who least take care of such a sad incidence. It is very important to focus of professionalism rather ignorance of mindset of such a irresponsible doctors. Doctors supposed to be a healers all respect them like closer to god who save life to many with the hands they perform surgeries. Many doctors tempted to money and do too much bad stuffs now a days

Utter negligence of doctors again instead of accepting their mistakes find excuses which have logic at all I'm sure they would pay heavy price for that.

It looks that this surgeon is trying to cover up her mistake. They always do a swab and instrument count at the end of surgery which obliviously they have failed to do. Worse part is that the surgeon is trying to blame someone else.

What doctors are saying? The Lady should immediately take a lawyer specialized in medical cases and file a case.she is supposed to get Penalty Money from doctor ,she cant get out of this affair That I am 200%sure.she operated and took Money .A operator is responsible for the deed and Operation Nurse.A Nurse has to tell the operator before closing Abdomen whether her instruments and swabs are complete and even needles ,when not search for it.operator should not Close till they tell complete.even after op.when they miss instruments after cleaning and packing, has to be reported.so is the rule. And just telling,it is not a scissor (it doesn't have Fixing teeth below). The Lady should not take up the case.after all she suffered a lot four years and spent lot of Money on doctors and medicines,.doctor is trying to slip away from the matter.

This act is unpardonable. This lady should get justice for each and every seconds she suffered for last four yrs she underwent. These health and education sectors which we DK peoples are boasting off should be brought to book.

What a negligence n irresponsible reaction from the doctors! When she claims that it is not any particular doctor's fault,It reminds us how the congress leaders were shielding Rahul n Sonia Gandhi after the shameful defeat in the L S election saying it was collective responsibility n not individual!

    Shame on you ...

Hats off to the brave lady who decided not to compromise for the sake of other patients.

Shameful incident. Such type of negligent doctors always either BUY the degree by bribes & donations. 'ONCE UPON A TIME' doctors were considered as a GOD. But now a days Doctors have become just like a butcher who doesn't care about the pain of animals at the time of slaughtering. He just care about the money. There is no difference between Doctor and Butcher in present scenario. It is the materialistic world, everyone is in hast to earn money at any cost. Social values are just like expired medicine. In this case , doctor forgot to get back the scissors from the patient stomach. It shows the negligence of Doctor.
