Mistaken identity : ANF guns down cattle trader, SDPI, PFI condemn killing

Chikmagalur, Apr 19: The Anti-Naxal Force (ANF) gunned down Mangalore based Kabeer on Saturday, April 19. The incident took place near the Sringeri checkpost on the Chikmagalur-Karkala state highway.​

Source say that the ANF police shot him as they suspected him to be a naxal. He was a resident of Jokatte.

According to the reports, Kabeer, a resident of Jokatte along with five others were transporting cattle in a mini-truck from Theerthahalli to Mangalore. The ANF officials – who were on night vigil – shot Kabeer dead, after the officials mistook the vehicle to be Naxals'.

The tragic incident occurred when they were stopped at the checkpost around 3:30 am. While Rafeeq alighted from the truck to collect toll receipt, his cousin Kabeer reportedly started running on sighting ANF personnel. The latter opened fire suspecting him to be a “Naxal”, killing him on the spot.

Panicking at the sudden turn of events, truck driver Pramod and Rafeeq fled the scene and arrived in Mangalore in another truck, while the ANF personnel nabbed Sheikh Ummer Farooq, who was still in the mini-truck. The fifth passenger, Sarfaraj, has gone missing.

Speaking to the media in Mangalore, Rafeeq said five of them were transporting 20 cattle from Thirthahalli to Mangalore abattoir after purchasing the cattle from a broker. When he alighted at the checkpost, “...the ANF personnel asked all the persons in the mini-truck to step out and seconds later I heard five rounds of firing and screams of Kabeer”. He and the driver  immediately fled, he recalled.

Stating that the vehicle documents were in order, he said his cousin and he were daily wage labourers, who had got into cattle business three months ago and were not into illegal trade.

Chikmagalur SP R Chethan said the ANF opened fire at the  civilians when they started running from the mini-truck.

“The ANF presumed they may be Naxals,” he said and added that one person has been killed and a case has been registered.

After the incident, when Kabeer’s body was taken to a hospital in Sringeri, his family members were assaulted by activists of the Bajarang Dal. They were threatened and told not to take the body to the victim’s hometown. The activists also brutally attacked vehicle driver Salam as he was about to set out with the body. 
 
After this altercation between Dal members and the family of the deceased, the body is now on its way to Surathkal. The incident has stirred much opposition in many sections of the population with the SDPI even issuing a press release demanding a CBI probe into the matter.

According to latest report, a complaint has been registered against the Bajarang Dal members,  said Chetan SP Chikmagaluru

SDPI, in the press release, stated that the incident throws up many unanswered questions. It said that there seems to be a conspiracy that was hatched before the shootout and added that Kabeer had a clean track record without any criminal cases lodged against him.
 
The release further said that this raises serious doubts on the way the encounter was carried out. The ANF had said that they shot at his chest, when they signaled Kabeer’s vehicle to stop and he attempted to escape. According to reports about the way events unfolded, after they stopped the vehicle, he ran; reinforcing their suspicion that he was a Naxal thus, leading them to fire at him. 
 
The SDPI release said that if he was running away, the bullet would have penetrated his body from behind. But he was shot from the front. The SDPI also suspects the involvement of Bajrang Dal activists and demanded that the government bring in the CBI to investigate the matter.
 
The Popular Front of India (PFI), in its release, strongly condemned the act saying the incident has led minorities to live in great fear.  Breathing fire against the RSS, the PFI said that since a branch of this outfit had attacked the family, it supports the theory that the Bajarang Dal is involved. It has also demanded a transparent investigation to reveal the truth behind the fake encounter.

    I have been to Kudremukha many times, have seen ANF roaming around without troubling any civilians. What we need to understand is, this is a naxal infested area. Whenever we go for a forest trek, we co-operate with this chaps. One has to be careful and not act over smart. Guys who are blaming ANF should realise,couple of months back Naxals blew a police check post at Kerekatte. So obviously, ANF guys will be on their heels during night time. Dont be a fool and start your comic conspiracy. Let the ballistic and postmortem report come in. Than you start your non sense. Another point,criminals and naxals are there in both the community.So please cry foul for whatever happens against Muslims.

    My dear Indian, with due respect to your education, I would like to ask you one simple question. If any business or food claimed to be as illegal, is it fair to kill those people who are in to? As you are a cultivated Indian, why can’t you demand or call to kill ANF person himself, who killed innocent which is an illegal Act and also call to kill most of the politicians who have lot of criminal background. Kindly check you fact by using your education, then only you will come to know the propaganda behind this incident. If those boys illegally supplied cattle let the police arrest them and take action according to the law instead shoot them directly to the chest point.     Many here sympathise the dead & accuse ANF & BD. Does carrying 23 cattle in a Pick Up mean a human act ? Why no questions is asked on this subject.     Please check the TV news again & again. During night it is common that Police or ANF perform a nakabandhi & perform their routine check up. Because most of ciminal activities are carried & got caught in night. When Police where doing their routine work, had he co-operated & with Police in intoragation, he would at the most be fined or vehicle seized. But activities as running or so naturally leads to suspecion, & the problem aggrevates.
    Contrarily, why cattles are junked in & transported in midnight only ? & why not in broad daylight ? If they do it in day, they will be brought to law. It is simple just respect the law of land & do work.

    For poor families in villages cattle is the only source of their livelihood. They take loans or sell their ornaments to buy cattle & animal fodder... for them cattle is more like a family member. So please dont steal cattle from these poor families.

    Latest Naxal Hideouts: Sakleshpur near sringeri.. Why Kabeer goes all the way to Sringeri to carry the Cattle.. Let the police department investigate and find the truth. Be patient. Since Sringeri is a holy place of hindu's BD is more active..that might be the cause of immediate retaliation from BD. Act of BD is completely condemned.

    1)It is not practical to ban cow slaughter, instead legalizing is a better option. Still, if you are adamant then make sure there is enough space & fodder for them since the number is going to add up in millions every year.
    2) Most of the transportation takes place during the night. In the morning the trucks are unloaded, loaded in the afternoon & the bills are processed late evening. By the time the truck departs the sun sets. This is a common practice in the transport field.
    The Karkala - Sringeri road is a part of NH 13 & not a remote road, even though it is narrow & windy from S. K. Border to Nemmar.
    But in this case I believe they were smuggling ( transporting without document ) cattle. I don't believe they have stolen them, since cattle theft is an extremely rare case in those areas.
    3) The Sulugodu check post near Nemmar is a frequent target of naxalites & since it is election time, I guess the ANF were anticipating an attack & the suspicious behavior of the deceased might have made them to misidentify him as a naxal. If the deceased stopped the vehicle & negotiated, he might faced an arrest or allowed to pass with a little bribe, but certainly wouldn't have lost his life.

    If ANF- killed kabeer mistakenly –Govt is responsible – Govt should give huge compensation to kabeer fly.
    If they did illegal cattle transport let govt choose the punishment for the remaining person according to law –
    Also, should ban for selling cows/cattle to anyone –need punishment for sellers also
    Here now happening only transporter getting punished- not the seller –

    This is a serious matter for the present Congress Government to brush aside\to ignore.
    If they delay like many earlier instances involving moral police\BD\Senee etc. off shoots of BJP\RSS, there will be serious repercussion in the future.
    From the way it is mentioned here the guy was running away and was shot in the chest!!! Is someone training some goondas to become encounter specialists?
    Forensic will reveal a lot - the gun that fired and the bullet that killed - if this investigation is done without any outside intervention or influence.
    A high level inquiry and result in the quickest time is the need of the hour with the culprits punished.

    Try to know the truth from the local residents of the deceased,then you will come to know what was happened really...After the cattle vehicle stopped upon the command of ANF,they asked the deceased who were sitting back seat of the vehicle to get down after they came to know it is cattle vehicle.Once he got down they shot him instantly.be patient,you/we will read this real story soon,they you may question me.

    If he tried to run,bullets should hit n pass through his back or side,but here it shot to his heart,now can you say how was it possible if not they intentionally killed him??? I have seen the picture of the dead body in fb.

    When the cattle transporters were unarmed and when there was no armed resistance, then it was the duty of the ANF to stop them for inspection or chase and catch hold of them and look into the matter. So they had no opportunity to know whether that Vehicle belonged to any Particular community and what they were transporting and to which community the occupants of the vehicle belonged to. So it is wrong to say that ANF was prejudiced. Name of the Religion or Caste is not written on the truck in big letters, and the occupants were not visible from far.     Grow up man Mr For Justice & Mr. Mohammed Bantwal. How come you know he was innocent & ANF did fake encounter ? Where you in the venue when the incident occurred ? Do you know clearly the law of land on Cattle transportaion ? Do you know details of the things prevailing in Cattle transportation(legal or illegal) ? First check the details & then speak. Don't advice me of the facts.
    If you check all the Newspapers during previous State Govt., you can find the way in which cattle where stacked in each vehicle...Number of cattle in each truck...methord of transportation...etc. & With present govt., it extended to theveing from house with a threat...& our useless State govt. keep supporting such immoral acts with political blessings. Here also, perhaps, it looks like the guy was found to be suspicious behaviour, & ANF might have mistook him to be a naxalite. Naturally, you cannot expect a naxalite to be caught with a lathi, as they most of time posses deadly weapons, & this might be case.

    ANF forces are very very less sensitive with regards lives of human.They shot dead their own comrade in Belthangady couple years back.Perhaps ANF might inducted BD goons in their battalion.The mindset of police still not changed even after change guard took place in Karnataka.How they(he) mistook Naxals.This encounter is suspicious and Govt must institute a judicial inquiry.

    I tell you what during BJP govt in Karnataka, especially in Mangalore and DK the govt run by RSS/BD/RS etc senas...There were no rule of land anywhere in twin districts.Take for example of MORAL POLICING...those indulged in taking law on to their hand were Scot free
    instead victims were more victimized by police.The same police forces still active in undivided DK police department.There is a word in police language of FIXING which I heard face to face.Home minister must look in to the fact very seriously need to change required biased officials.In fact when BJP took the guard, they changed, reshuffled and transferred police officials those who are not toed their line(BD LINE)
