Three held guilty of both gang rapes in Shakti Mills


Mumbai, Apr 3 (IANS): A Mumbai court Thursday held three men, convicted earlier for gang rape of a call centre employee in the Shakti Mills complex here, also guilty of the rape a photojournalist later in the same complex.

Principal Sessions Judge Shalini Phansalkar-Joshi Thursday convicted the trio - Vijay Jadhav (18), Qasim Hafiz Sheikh alias Qasim Bengali (20) and Salim Ansari (27) - for gang rape in the two cases committed July 31 and Aug 22, 2013, under section 376 (E) of the Indian Penal Code.

The quantum of punishment is likely to be pronounced here Friday. The rape charge under the amended section 376 (E) of the IPC could attract a death penalty for the convicts.

The three convicts have already been sentenced to life imprisonment till death in the July 31 gang rape of an 18-year-old call centre employee. They later committed a repeat offence targeting a photojournalist Aug 22, 2013, in the same abandoned Shakti Mills complex.

The three convicts moved the Bombay High Court challenging the enhanced section 376 (E) of the IPC slapped on them, but the court declined to interfere with the sessions court's decision in the matter.

Last month, four accused - Jadhav, Bengali, Ansari and their accomplice M. Ashfaque Shaikh (26) - were convicted for the July 31 gang rape of a call centre employee and sentenced them to life imprisonment till death.

Later, the prosecution sought enhanced charges and punishment against three - Jadhav, Bengali and Ansari - who were also accused in the Aug 22 gang rape of a photojournalist - under the Criminal Law (Amendment) Act, 2013, for committing the repeat offence.

Two minors, one in each case, are being separately tried by the Mumbai Juvenile Justice Board and the hearing will start this month.

The three men were found guilty under Section 376 (D) for the gang rape and other sections pertaining to wrongful restraint, criminal intimidation, conspiracy, common intent, unnatural sex, and sections of the Information Technology Act as the attackers had also made a video clip of the attack.

    These three boys may get the death penalty. It is a right punishment and sends a strong signal to the offenders. But, see the other side, where these rapes go on day in and day out in Mumbai's some police stations. Believe it or not, it is a fact.

    I just give one real life example. An Arab was walking along with a girl on Byculla bridge and police understood that the girl to be a prostitute. The policeman took them to Byculla police station and asked a fine of some thousand rupees. Since he did not have ready that much money, he told police that he was staying in Hotel Heritage, Byculla and he would bring the money. He left the station, leaving the girl behind. When he came and paid the money, they allowed them to go, but the girl was not looking normal. Arab asked her what happened, she said during the time he was away, three policemen raped her one after the other. Like this, it is going on in many police stations, if they find a prostitute or a wayward girl by chance, they do not leave them.

    Also, there are many people, even many mangaloreans, so called respectable people in Mangalore, who run brothels in Mumbai. Do you think the prostitutes there, are coming for business themselves? No, 80% of them were lured for some respectable jobs and brought to Mumbai and later forced into brothels. This forced prostitution is worse than rape, because rape is a one time act, but, this is a life long event. In Bhandup, Mumbai, a Mangalorean was running a brothel with 200 beds. All the policemen there, were saluting him, because they were paid hefty hafta. In addition to wine, dine and women for policemen, he was providing car with the driver while sub-inspector or inspector were going on vacation to their native place. Tell me, what should be the punishment for the policemen who frequently rape, and to these business men who force girls into flesh trade? Nothing I suppose, they go Scot free.

    Without wasting much time..send them to Gallows so that the remaining lakhs of similar cases get enough time.
