Bangalore: False case against husband amounts to cruelty, says high court

Bangalore, Jan 7: The Karnataka high court has ruled that false complaints of dowry harassment, ill treatment, cruelty or extra-marital affairs filed against husband without evidence amount to cruelty against the husband.
The ruling has come after complaints that anti-dowry and other such laws are increasingly being misused by women to harass husbands.
Written or oral complaints against the husband of sexual relationship outside marriage without proof also amount to cruelty under the Hindu Marriage Act, says the court ruling. Also, filing false cases against the husband or his family and making them face court proceedings also is cruelty, the court said.
Unfounded allegation against the husband regarding his character also is cruelty. False complaints adversely affect his reputation. Such acts by the wife will be sufficient for obtaining divorce in the court.
The court gave its ruling while granting divorce to a man on grounds that his wife had lodged a false case against him of illicit relationship with a female engineering student. The wife had also that his weakness was responsible for her not bearing a child.
